COUNTY, COLORADO, APPOINTING HEARING OFFICERS TO SERVE AS
THE BOARD OF EQUALIZATION AND APPOINTING ARBITRATORS TO
HEAR APPEALS FROM DECISIONS OF THE 2003 BOARD OF
EQUALIZATION
RESOLUTION NO. ~'J~'~' 2003
1. Pursuant to C.R.S 39-8-101 the Board of County Commissioners of Pitkin
County shall comprise the Board of Equalization (BOE)
2. The BOE is charged with the duty of assuring that the Assessor fairly and
equally applies appraisal procedures.
3. The volume of appeals in 2003 will exceed the amount of time that the Board
of County Commissioners has available to sit as the BOE.
4. Pursuant to C.R.S. 39-8-102(2)(I) the BOE has the authority to appoint
independent referees (hearing officers) who are experienced in property
valuation to conduct hearings, and on behalf of the BOE, make findings and
submit recommendations to the BOE for its final action.
5. The Board of County Commissioners wishes to appoint hearing officers to act
as the BOE.
6. Pursuant to C.R.S. 38-8-108(5) if a petitioner is not satisfied with the BOE's
decision they can choose to go to arbitration.
7. The Board has considered the applications and qualifications of the persons
interested in acting as hearing officers to act as the BOE and of arbitrators for
the appeals of the BOE's decisions, and desires to make appointments at this
time.
NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners
of Pitkin County, Colorado that the persons on the attached list are hereby
appointed to serve as hearing officers to act as the BOE and as arbitrators for the
appeals process of the BOE decisions, for a term commencing July 1, 2003 and
continuing for one year, unless otherwise terminated by the Board. Arbitrators
shall only hear appeals of BOE decisions that were made by hearing officers
other than themselves.
