406 ACRES WITHIN TfM THOMPSON DIVIDE

RECITALS
WHEREAS; Pursuant, to 30-35-301 C.R.S. the- Board of County Commissioners,("BOCC'?) of
Pitkin County, Colorado, a Home Rule County is aulh6rized to make and publish otdinancog fo.f
carrying.,into effect or discharging the powers and duties conferred upon such counties bylaw
and as seems necessary, and
WHE,REAS,'Pursuant-to., Section 18.1 of the Home RuIeChafter ("HRC'), the BOCC is
authorized to take official.action by Ordinance for certain platters where action is. proscribed
pursuant suatit, to the Colorado Revised Statutes as amended, and
WHEREAS, The Voters of Pitkin County and the Pitkin County Commissioners established an Open
Space -and Trails Fund for the purposes of preserving and providing open space and trails resources,
and established an Open.Space and Trails Board of Trustees to guide, the expenditure of thaw funds,
and,
WHEREAS; On April :8 the Board of County Commissioners adopted Ordinance 012-2620,
authorizing thepurqhase of Three contiguous parcels comprising. approximately 06 acres within
the Thompson Divide, and appropriating. $4,5,00,000 for this purchase, and
WIV_REAS, -the'Coutity has gi&e, obtained a ffiial appraisal on dj--
e: property which, has the effect of
getting the purchase price at $5,000,000,and
WHEREAS, Great OutdoorsZolorado has. awarded Pitkin County a grant in the -amount of $854,014
toward ;the purchase price of the Property, and
WHEREAS, satisfaction of the, Great Outdoors Colorado Grant requirements involves multiple
consultants and reviews, and the seller is anxious to close the transaction in advance of the completion
of qi-psedetails.. and
WHEREAS, Great Outdoors Colorado -is able: to: reimburse the C0.mtyafter the closing, and
WHEREAS, this change. requires an increasethe prior appropriation of funds for this purchase, and
WHEREAS, the Cboiity. Charter also allows the County to reserve the flexibility to consider later re-
conveyance of Open Space property subject to a permanent conservation easement and the omission

prior to the Purchase., and,
WHEREAS,, the_?itkin County Open Space- and Trails Boardrpoommejff&ihese amendments to. the
structure ofthis purchase, and;
WHEREAS, The BOCC finds that adoption of this ordipance is necessary- for the immediate
preservation of the public health, safety and welfare of the citizens of Pitkin County And therefore
declares this -ordinance and -legislation to be effective immediately upon adoption, and,
WHEREAS, The ROCC finds that adoption of this: ordinance is in -the best interest of the citizens
of Pitkin. Coianty.
NOW, THEREFORE, BE IT ORDAINED by tfie Board of County Commissioners of Pitkin
County, t6lorado that it hereby Adopts an Ordhiaiice Amending Ordinance 012-�2020 in. the
fdllowingmanner:
