RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY, COLORADO,APPROVING THE JOHNS(BIONAZ GULCH)SUBDIVISION
EXEMPTION TO CREATE OPEN SPACE PARCELS

RECITALS
1. Pitkin County Open Space&Trails ("Applicant")has applied to the Board of County Commissioners of
Pitkin County,Colorado("BOCC") on behalf of Dan and Heidi Johns for a Subdivision Exemption to
create three parcels from Lot 1 of the Irvin Naylor Lot Split. A.3.5 acre parcel(Lot 1)will contain the
existing single family home development and will remain in private ownership. A 1.4 acre parcel(Lot
2), and a 30 acre Parcel(Lot 3) will be conveyed to Pitkin County for open space and recreation
purposes.
2. The property is located at 26501 Highway 82,and is described as Lot 1,Irvin Naylor Lot Split.
3. The property contains approximately 36 acres and is a conforming sized parcel in the AR-10 zone
district.After the subdivision exemption separation,two of the three lots will be non-conforming.
4. The BOCC reviewed the application at a duly noticed public hearing on January 27,2016,at which time
evidence and testimony were presented with respect to this application.
5. The BOCC fords that the application is consistent with the applicable provisions of the Pitkin County
Land Use Code;2-30-30(h) (4).
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Pitkin
County,Colorado,that it does hereby approve the Johns(Bionaz Gulch)Subdivision Exemption to create
open space parcels, subject to the following conditions,which shall run with the land and be binding on all
successors in interest:
1. The Applicant shall adhere to all conditions and material representations made in the application and
public meetings except as amended herein.
2. Within 60 days of the date of this approval,the applicant shall submit a Subdivision Exemption Plat to
the Community Development Department for approval and recording.
