LLC PO Box 827, 301 Boulder Canyon Drive Nederland, CO 80466 (the "Contractor"), shall include the following services. 1. Contractor's Obligations. Contractor shall complete the following. 1.1 Field Reconnaissance In 2018,the Contractor implemented an integrated approach to weed management.The Contractor set up several test plots in the areas of rare plants and Canada thistle and applied biocontrols (i.e., the host- specific pathogenic rust fungus, Puccinia punctiformis for Canada thistle), mechanical control (hand pulling), and careful use of selective herbicides such as Milestone, an aminopyralid. In 2019, the Contractor will revisit these test plots and monitor the health, vigor, and density of the Epipactis populations. If no significant adverse effects to rare plants are occurring,the Contractor will continue the weed control efforts in the early fall of 2019.More specifically,the Contractor will continue to work with Karen Rosen of the Palisade Insectary to release biocontrol agents, continue the hand-pulling of the Canada thistle,then likely use a small hand-held sprayer to spot-spray the Canada thistle in the herbicide test plots,which is more time efficient than the"hand-painting"of herbicide that was conducted in 2018. The Contractor will also "piggy-back" on the Filoha Rare Plant Monitoring Study for greater efficiency and cost savings. Any application of herbicides would be conducted by Rea Orthner, who holds a 1 Master Service Agreement#: 008.2019 Rev:2018-10-10 btf Commercial Pesticide License with the Colorado Department of Agriculture. Herbicide applications, if used, would be conducted in early fall after the orchids have senesced. Denise Wilson, who completed her Master's Thesis of Epipactis gigantea at Filoha will also aid in this study. 1.2 Reporting At the end of the study the Contractor will document their methods,weed treatment procedures,and initial results in an Experimental Weed Control Monitoring Report.Please note,if additional treatments are used in 2019, the Contractor will recommend that additional monitoring take place in 2020 to successfully evaluate the treatment methods. Costs for the 2020 monitoring are not included in this cost estimate, however they would be similar to the 2019 costs. The Contractor will aim to expand the treatment area to the entire extent of the rare plant population, once the best weed treatment methods are determined. Budget(see spreadsheet) 2. Compensation and Expenses, Invoicing, Payment and Offset. The County shall compensate Contractor for its services in accordance with the Project Budget and Schedule set out in Paragraph 1 of this Task Order. It is expressly understood and agreed that in no event will the total compensation and reimbursement to be paid hereunder exceed the sum of ten thousand, two hundred and ninety dollars and fifty four cents ($10,290.54) for all services rendered. By Task Order or Task Order Amendment, the County and Contractor may reallocate the budget among project tasks if the total budget amount remains unchanged. Contractor shall invoice for the project monthly based on hours worked, with payment expected within thirty (30) days of invoice, but any payment by the County may be offset by any amount the Contractor owes the County for any reason. Any invoices not sent in the following manner may have payment delayed. All invoices for this Task Order shall reference Task Order 008.2019 A-11 and Filoha Meadows Eperimental Weed Control. Invoices shall be sent electronically in PDF format to lindsey.utter@pitkincounty.com and gary.tennenbaum@pitkincounty.com with a copy to kim.arensdorf@pitkincounty.com.. 3. Pitkin County's Obligations. Pitkin County shall administer this contract through a County Representative. Gary Tennenbaum & Lindsey Utter, Planning & Outreach Manager will manage the project as the County's Representative. The services provided and products delivered by the Contractor under this contract will be subject to review by the County's Representatives,or a designee, for compliance with Contractor's obligations prior to final payment. 4. Formation of Task Order. This Task Order is issued in accordance with the provisions of the Agreement. Contractor agrees to provide services subject to the terms of this Task Order and for the avoidance of doubt this Task Order consists of the terms set out in the Agreement.
