Contractor's Obligations. Contractor shall complete the following. 1.1 Analysis of Existing Documentation and Team Coordination The Contractor shall review existing documentation with DHM, Lotic Hydrological, and Irrigation team. All existing riparian and ecological assessments and plans will be reviewed and will form the basis of data for riparian/wetland intervention permit and CD level documentation. Meetings: • One Meeting with Lotic Hydrological and Peak Ecological to review plan and identify project needs • One Meeting with irrigation team to address strategy and overall concept • Hydrosystems - One meeting to evaluate site conditions and irrigation strategy • Samuelson Pump Co - One meeting onsite to evaluate and test existing system 1 Master Service Agreement#: 008.2019 Rev:2018-10-10 btf Deliverables: • The contractor will provide a detailed plan of action for coordination and milestones to develop permit and construction documentation. 1.2 Permit Drawings and Construction Documentation The contractor will create a permit level and construction drawing package incorporating the restoration plans for ponds and the surrounding hayfield (to be restored to a riparian habitat and sagebrush shrublands), construction access points and connections, maintenance access, and erosion control measures. The intent of this product is to provide an exhibit submitted to Pitkin County to accompany the Earth Moving Permit Application as well as a detailed construction package for implementation of the plan. The subcontractor Lotic will manage all aspects related to water rights. Lotic will also work with the design team to ensure that the water diversion, storage and distribution infrastructure adhere to Department of Water Resources administrative rules for water use. The Contractor will submit the information and follow up to acquire an official Jurisdictional Determination letter from the US Army Corps of Engineers (USACE). The Contractor will provide a permit drawing and construction documentation which will include details for modification of the landform and area of restoration activities; a planting plan that identifies woody riparian species for the restoration and identifies the planting method; a seeding plan that addresses a native seed mix, seedbed preparation, seeding methods; soil amendments and erosion control measures; and irrigation design. The Contractor will develop restoration success criteria, or performance standards. Following Hydrosystems' field visit to evaluate existing conditions and identify tasks to implement temporary irrigation of the plantings, they will create an irrigation design for permitting and construction. DHM has documentation of the existing infrastructure. Hydrosystems will produce an irrigation plan,details and specifications. Samuelson Pump is to conduct a field investigation of pump infrastructure and create a technical report detailing the rehabilitation of the pump to make it operational for irrigation. Lotic is to provide the County guidance as it pertains to water rights administration at the site. Lotic will also function as a liason to the local water commissioner. Meetings: • One meeting with Lotic Hydrological and Peak Ecological for plan review and coordination • One meeting with Pitkin County to review permitting requirements and package Deliverables: • Site materials and grading plan • Design details for planting, erosion mitigation, and re/vegetation protection fencing • Annotated seeding plan and schedule with planting and seeding notes • Detailed notes and steps outlining the order of operations and directives to minimize disturbance • Calculating the area of disturbance and upholding the plan to the corresponding County mandates • Irrigation construction drawings, details and specifications - KDI/Hydrosystems 2 Master Service Agreement#: 008.2019 Rev:2018-10-10 btf • Pump rehabilitation technical report and construction details - Samuelson • Permit Application • Construction Management Plan • Specifications Package 1.3 Final Submission to Pitkin County The Contractor will submit a final construction set to the County for bidding and construction purposes. Deliverables: • Final Drawings and Packages Budget(see attached spreadsheet) 2. Compensation and Expenses, Invoicing, Payment and Offset. The County shall compensate Contractor for its services in accordance with the Project Budget and Schedule set out in Paragraph 1 of this Task Order. It is expressly understood and agreed that in no event will the total compensation and reimbursement to be paid hereunder exceed the sum of twenty eight thousand, two hundred and ninety nine dollars and eighty cents ($28,299.80) for all services rendered. By Task Order or Task Order Amendment, the County and Contractor may reallocate the budget among project tasks if the total budget amount remains unchanged. Contractor shall invoice for the project monthly based on hours worked, with payment expected within thirty (30) days of invoice, but any payment by the County may be offset by any amount the Contractor owes the County for any reason. Any invoices not sent in the following manner may have payment delayed. All invoices for this Task Order shall reference Task Order 008.2019 A-7 and SMP Irrigation Pond & Riparian Restoration Plan. Invoices shall be sent electronically in PDF format to lindsey.utter@pitkincounty.com and gary.tennenbaum@pitkincounty.com with a copy to kim.arensdorf@pitkincounty.com.. 3. Pitkin County's Obligations. Pitkin County shall administer this contract through a County Representative. Gary Tennenbaum & Lindsey Utter, Planning & Outreach Manager will manage the project as the County's Representative. The services provided and products delivered by the Contractor under this contract will be subject to review by the County's Representatives,or a designee, for compliance with Contractor's obligations prior to final payment. 4. Formation of Task Order. This Task Order is issued in accordance with the provisions of the Agreement. Contractor agrees to provide services subject to the terms of this Task Order and for the avoidance of doubt this Task Order consists of the terms set out in the Agreement.
