Hallam St. 711 Walnut Street Aspen, CO 81611 Boulder, CO 80302 Phone: (970) 920-5355 Phone: (303)449-9009 gary.tennenbaum@pitkincounty.com david@westerneco.com PROJECT NAME: FILOHA-RARE PLANT WEED CONTROL START DATE: May 21,2018 END DATE: December 31, 2018 The Master Service Agreement for Provision of On-Call Ecological Services (the "Agreement") dated May 26,2017 between the Board of County Commissioners of Pitkin County(the"County") and Western Ecological Resource, Inc. 711 Walnut Street Boulder, CO 80302 (the "Contractor"), shall include the following services. 1. Contractor's Obligations. The false helleborine orchid (Epipactis gigantea) is a critically imperiled plant that occurs at Filoha Meadows Nature Preserve. One of the primary threats to Epipactis gigantea at Filoha Meadows is noxious weed invasion by Canada thistle (Cirsium arvense) and ox-eye daisy (Leucanthemum vulgare). Therefore, this proposal involves developing and implementing an experimental noxious weed control plan adjacent to and within populations of this plant in order to determine the most effective way of controlling the noxious weeds without detriment to the rare plants. The preservation and protection of rare plant populations is an important goal of PCOST. However, leaving things "as-is" can sometimes be just as harmful as performing too much management. Therefore, this study aims to elucidate the best ways of controlling noxious weeds without detriment to the rare orchids. Contractor will use an integrated approach to weed management. More specifically, contractor will investigate the use of biocontrols (i.e., the host-specific pathogenic rust fungus,Puccinia punctiformis for Canada thistle, mechanical control (hand pulling), and careful use of selective herbicides such as Milestone, an aminopyralid. Contactor will establish test plots prior to weed control activities to estimate the health, vigor, and density of the Epipactis populations in the weed 1 Master Service Agreement#: 117.2017 Rev:2018-01-17 btf control areas. These same areas would be monitored in future years to determine the efficacy of treatment methods and any impacts to the rare plants. Contactor will also "piggy-back" on the Filoha Rare Plant Monitoring Study to greater efficiency and cost savings. Any application of herbicides would be conducted by Rea Orthner, who holds a Commercial Pesticide License with the Colorado Department of Agriculture. Herbicide applications would likely be conducted in late summer or early fall after the orchids have senesced. We will work with Karen Rosen of the Palisade Insectary for releases of the pathogenic rust fungus. Denise Wilson, who completed her Master's Thesis of Epipactis gigantea at Filoha will also aid in this study. At the end of the study contractor will document methods, weed treatment procedures, and initial results in an Experimental Weed Control Plan. Please note, additional monitoring in 2019 will be necessary to successfully evaluate the treatment methods. Costs for the 2019 monitoring are not included in this cost estimate. Once we have determined the best weed treatment methods, we would aim to expand the treatment area to the entire extent of the rare plant population. Contractor has tentatively scheduled a meeting with Karen Rosen of the Palisade Insectivory to release the pathogenic rust fungus the week of May 21, 2018 at which time contractor would also collect baseline pretreatment data of Canada thistle stem density. Contractor would then conduct two additional site visits later in the summer or early fall for mechanical weed control and limited herbicide application for the other test plots. Budget Estimates: Professional Time $19,015.00 Expenses 2,254.00 Project Management @ 12% 2,552.28 Total $23,821.28 2. Compensation and Expenses, Invoicing, Payment and Offset. The County shall compensate Contractor for its services in accordance with the Project Budget and Schedule set out in Paragraph 1 of this Task Order. It is expressly understood and agreed that in no event will the total compensation and reimbursement to be paid hereunder exceed the sum of twenty three thousand eight hundred twenty-one dollars and twenty-eight cents ($23,821.28) for all services rendered. By Task Order or Task Order Amendment, the County and Contractor may reallocate the budget among project tasks if the total budget amount remains unchanged. Contractor shall invoice for the project monthly based on hours worked, with payment expected within thirty (30) days of invoice, but any payment by the County may be offset by any amount the Contractor owes the County for any reason. Any invoices not sent in the following manner may have payment delayed. All invoices for this Task Order shall reference Task Order 117.2017 C-19 and Filoha-Rare Plant Weed Control. Invoices shall be sent electronically in PDF format to gary.tennenbaum@pitkincounty.co with copy to fran.soroka@pitkincounty.com. 3. Pitkin County's Obligations. Pitkin County shall administer this contract through a County Representative. Gary Tennenbaum, Director Open Space & Trails will manage the project as the County's Representative. The services provided and products delivered by the Contractor under this contract will be subject to review by the County's Representatives, or a designee, for compliance with Contractor's obligations prior to final payment. 4. Formation of Task Order. This Task Order is issued in accordance with the provisions of the Agreement. Contractor agrees to provide services subject to the terms of this Task Order and for the 2 Master Service Agreement#: 117.2017 Rev:2018-01-17 btf avoidance of doubt this Task Order consists of the terms set out in the Agreement.
