PITKIN COUNTY, COLORADO, REPEALING RESOLUTION NO. 014-2020
ADOPTED ON MARCH 17, 2020 RATIFYING THE PITKIN COUNTY
MANAGER'S ACTION ON A DECLARATION IMPLEMENTING A LOCAL
EMERGENCY DISASTER AND RESCINDING THE LOCAL EMERGENCY
DISASTER DECLARATION RATIFIED IN RESPONSE TO THE COVID-19
PANDEMIC
RESOLUTION NO. 018-2022
RECITALS
WHEREAS, Pursuant to Section 2.8.4 (Actions) of the Pitkin County Home Rule Charter
("HRC"), all matters not required to be acted upon by ordinance or formal resolution may
be acted upon by informal resolution, and;
WHEREAS, on January 30, 2020, the World Health Organization declared the worldwide
outbreak of COVID-19 a public health emergency of international concern; and on January
31, 2020, the United States Department of Health and Human Services declared the virus a
public health emergency; and
WHEREAS, on March 8, 2020, the Colorado Department of Public Health and
Environment(CDPHE) confirmed a case of COVID-19 within Pitkin County; and
WHEREAS, pursuant to Section 24-33.5-709, Colorado Revised Statutes, the presence of
COVID-19 in Pitkin County represented an imminent threat to the health and wellbeing of
Pitkin County residents and visitors,requiring emergency action to avert illness and possible
death, as seen in other parts of the nation and world; and
WHEREAS, on March 12,2020 the Pitkin County Health Department issued a Public Health
Order to implement measures to protect Pitkin County residents and visitors from the
imminent threat of COVID-19; and
WHEREAS, on March 12, 2020 the Pitkin County Manager signed an Emergency
Declaration in response to the threat of COVID-19; and
WHEREAS, on March 17, 2020 the BOCC adopted Resolution No. 014-2020 ratifying the
Emergency Declaration and extended the declaration until rescission by the BOCC; and
WHEREAS, Pitkin County residents have achieved a very high rate of vaccination against
COVID-19 resulting in decreased incidence rates and hospitalizations due to COVID-19; and
WHEREAS, on February 10, 2022 the Board of Health voted to rescind the County's 12th
Amended Public Health Order - Winter COVID-19 Restrictions effective 12:00 a.m.
February 22nd; and 1
WHEREAS, The BOCC finds that it is in the best interests of the citizens of Pitkin County
to approve this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Pitkin County, Colorado that it hereby:
1) Repeals Resolution No. 014-2020 Ratifying the Pitkin County Manager's Action on
a Declaration Implementing a Local Emergency Disaster; and
2) Rescinds the Local Emergency Disaster Declaration ratified by Resolution no. 014-
2020 in response to the COVID-19 Pandemic; and
3) Authorizes the Chair to sign the Resolution and upon the satisfaction of the County
Attorney as to form, execute any other associated documents necessary to complete
this matter.
