Home My WebLink Aboutbocc.res.020.2022 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS ("BOCC") OF PITKIN COUNTY, COLORADO AUTHORIZING THE CHAIR TO SIGN AN AMENDMENT TO PASSENGER FACILITY CHARGE (PFC)APPLICATION#15-09-C-00 ASE WITH THE FEDERAL AVIATION ADMINISTRATION TO REFLECT A CHANGE IN PROJECT SCOPE RESOLUTION NO. 020-2022 RECITALS WHEREAS, Pursuant to Section 2.8.3 (Actions) of the Pitkin County Home Rule Charter ("HRC") official action by formal resolution shall be required for all actions of the Board not requiring ordinance power on matters of significant importance affecting citizens, and; WHEREAS, Pitkin County(County) is the owner, sponsor and operator of the Aspen/Pitkin County Airport(Sardy Field), (Airport) located in the vicinity of Aspen, Colorado and operates, maintains and develops the Airport, in part, with federal grants, state funds, Passenger Facility Charges (PFC), and user fees, and; WHEREAS, On December 17, 2014, the Federal Aviation Administration issued a Final Agency Decision (FAD) for a Notice of Intent authorizing the County to collect and use funds for the purchase of three pieces of airport snow removal equipment, which consisted of a blower,plow and runway broom for use at the Airport, and; WHEREAS, The County has determined that an additional two runway brooms would better meet the Airport's snow removal requirements than the scoped blower and plow. This change is contained in the Airport Snow and Ice Control Plan and was approved by the FAA for regulatory compliance on December 4, 2020, and; WHEREAS, On October 8, 2021,per Title 14 of the Code of Federal Regulations (CFR) Part 158.23, the Airport provided written notice of the amendments to air carriers having a business interest in the airport. Then, on November 12, 2021,per Title 14 of the Code of Federal Regulations (CFR) Part 158.24, the County issued a formal public notice of the intent to amend PFC No. 15-09-0000-ASE and held a virtual PFC Airline Consultation Meeting with our airline partners. Following the required 30-day public comment period(no comments were received), the Airport transmitted a formal written Notice of Intent to the FAA to amend PFC No. 15-09-0000-ASE, and; WHEREAS, In accordance with Title 14 of the Code of Federal Regulations Part 158.37(a) and(b), the County must formally amend its PFC application to reflect the change in scope and/or funding, and; WHEREAS, The BOCC finds that it is in the best interests of the citizens of and the visitors to Pitkin County to approve this Resolution apthorizing the Chair to sign an amendment to the PFC Application#15-09-C-00 ASE to reect a change in project scope. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado that it hereby approves a Resolution Authorizing the Chair to Sign an Amendment to Passenger Facility Charge Application#15-09-C-00-ASE with the Federal Aviation Administration to Reflect a Change in Project Scope and upon the satisfaction of the County Attorney as to form, execute any other associated documents necessary to complete this matter. 2 INTRODUCED AND FIRST READ ON THE 23RD DAY OF FEBRUARY, 2022 AND SET FOR SECOND READING AND PUBLIC HEARING ON THE 9TH DAY OF MARCH 2022.
