The application is being submitted by the owner, the Marcus, and Lara Bach Revocable Trust (hereinafter “the applicant”). A letter from the applicant authorizing Newland Project Resources, Inc., to submit this application on their behalf is attached as Exhibit 2. Background An Amendment to the existing Activity Envelope and Site Plan associated Administrative Review for the parcel has been approved and recorded (see Exhibit 3). A variance was also granted for two encroachments to place a Soil Treatment Area for the septic system, a buried fire suppression tank, and a buried propane tank. The Board of Adjustment Resolution for these variances is also attached within Exhibit 3. At the time of the initial variance request the specific location of the driveway was not known. The property is zoned AR-10. The parcel has a conforming lot size of 32.5-acres. The applicant, who purchased the property in late 2020, desires to construct a single family home together with the improvements required to provide access and utility infrastructure. This infrastructure includes water lines, septic (OWTS), electricity and propane gas, all of which will be buried underground. The applicant is requesting that a variance be granted to allow an area of the 50-foot road setback to exceed 6-feet of fill for the driveway. As shown on the Exhibit 3 to this letter, the approved Activity Envelope for this parcel is exceptionally long and narrow and is located between the road setback along Snowmass Creek Road and the 100-foot stream setback from Snowmass Creek. Snowmass Creek Road is between 20- and 30-feet above the Activity Envelope, with steep slopes dropping down to the envelope from the road. Because of this vertical drop and the narrow width of the Activity Envelope, it is not possible to place a driveway without placing the 6-feet of fill within the setback and conform to County and Fire District Access requirements. 2 2 Response to Code Standards Section 7-10-030 (c) (2) of the Land Use Code provides the standards by which the Board of Adjustment considers applications for variances. This section provides that the Board may grant variances: 'Where, by reason of unusual narrowness, shallowness, or shape of a specific piece of property at the time of enactment of the regulation, or by reason of unusual topographic conditions or other situation or condition of such piece of property, the strict application of any regulation would result in peculiar practical difficulties to, or undue hardship upon the owner of the property... ". In order to grant the Variance, the Board is also required to find that the relief can be granted to the applicant "Without substantial detriment to the public good and without substantially impairing the intent and purpose of the Comprehensive Plan and the Land Use Code". With respect to the first standard, the applicant believes that in this case there are unusual situations or conditions causing practical difficulties and hardships for the owner. These unusual situations and conditions have been described above and include the fact that although this property is over 32.5 acres in size, the vast majority of the lot has been found to be inappropriate for development. This is due to the required stream setback on both sides of the creek and the critical wildlife and steep slopes to the west of the creek. The remaining +/- 2-acres within the approved Activity Envelope ranges from 50-feet to 100-feet in width making development of the parcel challenging, especially when placing the access. The variance also provides topographic relief to the owner by allowing the driveway to interface with the County Road at the best location for sight distance. This allows the driveway to be safer to use both for the applicant and the traveling public. With respect to the second standard, there are no houses anywhere proximate to the proposed driveway and the driveway design provides a flat platform with a perpendicular approach to the County Road, both of which are required by County Road standards. In discussions with the County Engineering Department, a Right-of-way Permit for the improvements can be issued in conjunction with the Board of Adjustment variance. Rather than being counter to or impairing the Comprehensive Plan for the area, this variance request actually enhances the Plan by supporting and complying with its goals, including siting access points along this narrow, winding stretch of Snowmass Creek Road so that they comply with safety standards. Without the variance, the driveway will not comply with these 3 3 standards and could have more impact on the sensitive riparian areas associated with this property. The current required Front Yard Setback from West Sopris Creek Road on the south of the property is 100’-0”. The buildable area of the property is hindered by several unusual site constraints including the Shippee Ditch maintenance setback at the north and the irregular shaped activity envelope caused by the steep slope of the property. The topographical hardship generated by these restrictions on the north and compounded by the 100’ setback on the south, result in the practical difficulty of leaving the site completely unbuildable for the owners. In 2018, the Board of Adjustment approved a 60’ Front Yard Setback Variance to the 100’ required setback, resulting in a revised setback distance of 40’. This variance has since expired. Additionally, the driveway location as shown on the site plan was approved in a 2007 Access Driveway Development Permit. With the form and design of the home further developed, the owners are requesting a 45’ Front Yard Variance to the existing 100’ required Front Yard Setback, resulting in a revised setback distance of 55’.
