ASPEN DAILY NEWS AS THE OFFICIAL NEWSPAPER OF RECORD FOR LEGAL NOTICES AND ADVERTISEMENTS Resolution No. 056-2022
RECITALS WHEREAS, Pursuant to Section 2.8.3 (Actions) of the Pitkin County Home Rule Charter
(“HRC”) official action by formal resolution shall be required for all actions of the Board not
requiring ordinance power on matters of significant importance affecting citizens, and;
WHEREAS, Colorado Revised Statutes §24-70-103 requires any and every legal notice and advertisement be published in either a daily, triweekly, semiweekly or weekly newspaper of
general circulation, published or printed in whole or in part in the County in which such notice is required to be published; and WHEREAS, Colorado Revised Statutes §24-70-103(1) requires the newspaper in which any legal notice is published to have been published in any such county continuously and
uninterruptedly during the period of at least six months prior to the first issue containing such notices or advertisements if the paper is published daily; and WHEREAS, Colorado Revised Statutes §24-70-102 requires that a publication be admitted to the United States mail with periodicals mailing privileges to be a legal publication; and
WHEREAS, the Aspen Daily News is a legal publication published in whole or part in Pitkin County; and WHEREAS, Colorado Revised Statutes §30-15-405 regarding publication of ordinances requires
that any ordinance must be published in a newspaper having general circulation within the limits of the County in which such ordinance effects; and WHEREAS, Sections 2.8.1.4, 2.8.1.6, 2.8.2.3, 2.8.2.4, 2.8.3.3, 2.8.3.5, 2.8.5.3 and 2.8.5.4 of the Pitkin County Home Rule Charter require that proposed ordinances and resolutions be published
in the official newspaper of record no less than ten days in advance of any public hearing, and after final adoption of said ordinance or resolution; and WHEREAS, the Aspen Daily News is a daily newspaper published in Pitkin County, Colorado, which meets the necessary publication and mailing requirements as established by Colorado
Statute; and WHEREAS, the BOCC finds that it is in the best interests of the citizens of Pitkin County to
approve this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado that it hereby adopts a Resolution Designating the Aspen Daily News as the
Official Newspaper of Record for the purpose of publishing legal notices, advertisements,
ordinances and resolutions as required by Colorado Revised Statutes and the Pitkin County Home Rule Charter, as of the date of July 29, 2022 and authorizes the Chair to sign the Resolution and upon the satisfaction of the County Attorney as to form, execute any other associated documents necessary to complete this matter.
