HomeMy WebLinkAboutbocc.con.212.22 - BOCC1 EMERGENCY RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS (“BOCC”) OF PITKIN COUNTY, COLORADO, AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT BETWEEN LA PLATA COUNTY AND PIKTIN COUNTY FOR ECONOMIC ASSISTANCE SERVICES RESOLUTION NO. 049- 2022 RECITALS WHEREAS, Pursuant to Title 29, Article 1, part 2, Colorado Revised Statutes, as amended (the “Intergovernmental Relations Statutes”) and Article XIV, Section 18 of the Colorado Constitution, governments may contract with one another to provide any function, service or facility lawfully authorized to each of the contracting units and any such contract may provide for the joint exercise of the function, service or facility, including the establishment of a separate legal entity to do so, and WHEREAS, Pursuant to Section 2.8.3 (Actions) of the Pitkin County Home Rule Charter (“HRC”) official action by formal resolution shall be required for all actions of the Board of County Commissioners (“BOCC”) not requiring ordinance power on matters of significant importance affecting citizens, and; WHEREAS, Pursuant to Section 2.8.5 of the HRC the Board is authorized to approve emergency resolutions, which shall become effective immediately upon adoption, and; WHEREAS, the La Plata County Department of Human Services has requested temporary assistance from the Pitkin County Department of Human Services to provide technical assistance in determining eligibility for La Plata County Economic Assistance programs, and; WHEREAS, the entire cost of the project will be absorbed by the La Plata County Department of Human Services and the hours worked by the Pitkin County Eligibility Specialists will not be during regular work hours, and; WHEREAS, the assistance provided to La Plata County will ensure that their residents are able to access the benefits necessary to maintain stability for their families as well as promoting goodwill and mutually beneficial intergovernmental relationships, and; WHEREAS, the BOCC finds that approval of this resolution is necessary for the immediate preservation of the public health, safety, and welfare of the citizens of Pitkin County and therefore declares this resolution to be effective immediately pursuant to the HRC Section 2.8.5. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado that it hereby adopts an intergovernmental agreement between La Plata County and Pitkin County for Economic Assistance services and authorizes the Chair to sign the Resolution and upon the satisfaction of the County Attorney as to form, execute any other associated documents necessary to complete this matter..
