HomeMy WebLinkAboutbocc.res.068.20221 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS (“BOCC”) OF PITKIN COUNTY, COLORADO, OPTING OUT OF THE FAMILY MEDICAL LEAVE INSURANCE PROGRAM RESOLUTION NO. 068-2022 RECITALS WHEREAS, Pursuant to Section 2.8.4 (Actions) of the Pitkin County Home Rule Charter (“HRC”), all matters not required to be acted upon by ordinance or formal resolution may be acted upon by informal resolution, and; WHEREAS, Colorado voters approved Proposition 118 in November of 2022, authorizing a state-run Paid Family Medical Leave Insurance Program (“FAMLI Program”), and; WHEREAS, Local Governments must decide to opt-in or out of the program by January 1, 2023, and; WHEREAS, Pitkin County (“the County”) currently offers a robust employee leave program that includes Family Medical Leave, Short-term Disability, and Parental Leave, and; WHEREAS, The Board of County Commissioners met in a work session on August 16, 2022, and after a presentation by staff, determined that the County’s leave benefits exceed the benefits of FAMLI, and; WHEREAS, The BOCC finds that it is in the best interests of the County and the staff to opt out of the FAMLI and approve this Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado that it hereby adopts a Resolution Opting out of the Family Medical Leave Insurance Program and authorizes the Chair to sign the Resolution and upon the satisfaction of the County Attorney as to form, execute any other associated documents necessary to complete this matter. 2 INTRODUCED, READ AND ADOPTED ON THE 14TH DAY OF SEPTEMBER 2022.
