AGENDA ITEM SUMMARY REGULAR MEETING DATE: September 10, 2003 AGENDA ITEM TITLE: An Ordinance Revising Commercial Airline Landing Fees Second Readi__4~g STAFF RESPONSIBLE: Jim Elwood DESCRIPTION OF ISSUE: The first reading of revising commercial airline landing fees ordinance for the second half of the year was approved by the Board on August 27, 2003 and set for second reading and public hearing today. .The suggested 6% reduction in landing fees for the commercial airlines is an effort by the airport to be proactive and offer assistance. The credit (reduction) given to commercial airlines will be retroactive fi.om July 1, 2003. The adjustment of 6% for six (6) months offsets the 3% increase in landing fees established in January. The 2004 rates and charges will be reevaluated following a meeting with the airlines scheduled to take place in September. During this meeting the airlines will have the opportunity to discuss the proposed 2004 Airport budget in detail and offer input. This meeting will also look at the five (5) year budget and review the capital expenditures that are being mandated by the FAA through the ESID plan. The financial impacts of this 6% credit would be close to $30,000 if the new rate was established for a twelve (12) month period, however since the larger portion of the landings take place in the first part of the year the impact for the proposed July-December revision is approximately $11,300. The following is the anticipated financial savings to the airlines: July-December United Express (Air Wisconsin) $ 9,905 American West (Mesa) $ 830 Northwest (Mesaba) $ 529 TOTAL $11,264 RECOMMENDED BOCC ACTION: Motion to Approve Ordinance Revising Airport Landing Fees for the second half of 2003 FY. AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTy, COLORADO, REVISING AIRPORT'S COMMERCIAL LANDING FEES FOR THE SECOND HALF OF 2003 Ordinance # -2003 RECITALS 1. Pitkin County ("County") owns, operates and sponsors the Aspen/Pitldn County Airport ("Airport"). 2. The County has authority to set, charge, collect and enforce rents, fees and charges for the occupancy and use of the Airport, pursuant to, i_nter _aha, Sections 41-4-101 et seq., 30-11-107, 30-15-401 and 30-35-201 and 202, 1973 C.R.S., as amended, the Pitkin County Home Rule Charter, as amended, and the Pitkin County Code, Title 10, Airport Regulations, as amended. 3. The County set initial landing fees for 2003 (per one thousand pounds of maximum allowable gross landing weight) at $1.53 for Signatory, Pre-signatory, and Multi-Seasonal Airlines, and $2.14 for all others including Seasonal Airlines. 4. The County desires to reduce commercial airline landing fees by 6% for the second half of 2003. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Pitkin County, Colorado that: 1. Section 10.16.010 of the Pitldn County Code is hereby repealed and reenacted as follows: "Landing fees for commercial air carriers. There is imposed on, and shall be paid by, all FAR Part 121 or 125 air carriers and scheduled FAR Part 135 (air taxi and/or commuter) operators authorized to serve Pitldn County and using the airport, a rate or charge on all arrivals of aircraft from which such carrier or operator shall derive revenue, equal to the following amounts per one thousand (1,000) pounds of maximum allowable gross landing weight: $1.44 for Signatory, Pre- signatory, and Multi-Seasonal Airlines, and $2.01 for all others including Seasonal Airlines. There is hereby imposed on, and shall be paid by, such carriers or operators, a rate or charge on all arrivals of aircraft from which such carriers or operators shall not derive revenue, equal to $.25 per one thousand (1,000) pounds of maximum allowable gross l~-~:mg weight. 2. The landing fees established herein shall be effective on and after July 1, 2003. INTRODUCED, FIRST READ, AND SET FOR PUBLIC HEARING ON THE 27TH DAY OF AUGUST 2003.
