Comments: Application material was referrer! to. - Zoning Officer: DATE: July 30, 2022 TO: Pitkin County Board of Adjustment FROM: Pitkin County Residents and Landowners Stephanie Sobotik and Julie Jordan RE: Request for variance on setback due to hardship created by existing structures We, the permanent residents and homeowners of 284 Riverside Road in Carbondale, CO, Pitkin County, are requesting a setback variance to build a cover over an existing concrete parking pad to protect our camper from weather, sap, branches, etc. The existing concrete pad where we park the camper has been within the setback of the north property line since 1980. We are requesting a 20' setback variance for the camper cover. We are only requesting to build a cover (with no electricity, water or walls) over the existing concrete pad. • The camper cover would only cover the camper [not the entire parkingarea] • The camper cover would require a setback variance to within 20' of the Narth property line on existing concrete • We currently park the camper on this existing concrete pad • No new materials will be added to the area other than the poles/supports roof for the raver • All materials will match the existing structures We are basing the setback variance request on existing hardships that prevent us from placing camper/cover anywhere else on the property. Hardships for consideration of the setback variance and placement of the camper cover: • Legally existing permanent structures: House, garage, and concrete patio [bu[it in 1974) • North property border. legally existing concrete driveway and concrete RV parking (since 1980) • West property: River/river setback along the entirety of the west side of the property (water well located on northwest portion of property). West side of property to driveway is considered Flood plain. Driveway and parking areas are not in the floodplain. • South property: Legally existing concrete patio, septic tank, leech field and several 40+-year-old mature trees • East side of property behind house and garage is a steep hill rising to the back of the property In November2021 our contractor started construction of the project thinking a permit was not needed in Pitkin County fora pole barn structure. He learned a few days later that a permit is needed and ceased construction until we obtain the proper permit. He has since met with the planning committee and determined a setback variance is needed by Pitkin County. Photos of the existingconcrete pad and parked camper are included, as well as surveys to show the entire property, existing hardscapes and proposed location of the camper cover. Designs and drawings are also attached. The finished product will match the existing paint color, shingles and style of the existing house and garage. We have applied fora land use assessment as well. It is with the committee and pending approval. Please let us know if we can answer any additional questions or provide more information. The Quaker Condominiums are comprised of four units in two duplex configurations. Units 1 and 2 are on Lot 53; Units 3 and 4 are on Lot 52. The structures were originally cabins that were moved to the site and cobbled together In the 1970s to create two duplex units. Over time, units 3 and 4 have been substantially renovated, with the most recent renovation concluding in 2017. Due to the steep nature of the site at the road, the duplexes were built down on the lot in an area that was somewhat level (see sheet A•D02 far slope analysis}. Mountain Laurel Drive is between 20-25 feet higher in elevation than the entry level of these units. Almost from the time they were built, parking has been an issue. The parking area for both lots is not on their property but on a railroad tie supported gravel area within Mountain Laurel's Right of Way (see A-001 red crass hatch area). This has proved to be completely Inadequate for thelr needs and creates hazards to Mountain Laurel Drive. Sometimes the back end of the cars encroaches on the pavement of Mt. Laurel. There is currently no parking on the lots. The Quaker Condominiums Association applied for an Activity Envelope and Site Plan review to locate four SDO square foot garages and improvements. This was approved by the County with Administrative Decision No. 05-2022 and the Plat has been recorded in book 133, Page 3. 3 Board of Adjustment Application, Quaker Condominium Association 27 Variances to height and setback are being requested due to hardship based an the location of the garages on the site. Per section 2.40.110 we are requesting variances from the Board of Adjustment for the garage height and setbacks. Height: The Land Use Code requires an accessory building height limit of 20 feet as measured from existing grade. Apart from garage 1, the proposed garages exceed this height limit due to the steep slope of the site. Garage 4 is on the steepest portion of the site and requests the greatest variance; 1(Y- 7" SSee section 2/A-303). The strict application of this requirement is a hardship For the following reasons: 1. This specific property is the only lot in Mountain Valley that does not have any parking on their lot. They have shared common parking on Lot 53, and this parking is within Mountain Laurel's right of way. (See sheet A-001 red cross hatched area). At same point in the future the Quaker Condominium Association may formally split, leaving each lot with no opportunity for parking on their lots. The Proposed garages are in the only location on their lot that is feasible. 2. The nature of the lot is that it is narrow and steep along the road. The proposed location for the proposed garages is over steep topography. (See sheet A-002). From the edge of pavement to the back of the garage the grade drops nearly 21 feet. It is impossible to build any structure in this location that is under the accessory height (See section 2/A-303). 3. We have designed the garages to have as low a roof form as possible. The garage roof of Unit 2 and 3 are flat, and Unit 1 and 4 are %":12. They have a plate height of 9'-6'. This allows them to have a low profile. The garages meet the height requirement at the street front. The highest point of the roof is 12'-3" from the apron (See A-201-204). The garages do not create a detriment to the view along Mountain Laurel Drive's streetscape. Setbacks: Per the Land Use Code, the Front Yard setback is 30 feet. The proposed garages will be located on the lot line within the setback. This requires a front setback variance. Also, there is a shared property line between lots 52 and 53. The proposed design will require a side yard variance as well far the shared lot line. The East side yard and read yard setbacks meet the Coumy's requirements. The strict application of this section of code is a hardship for the following reasons: 1. There is no practical way to meet the 30 foot front yard setback on these lots for the garages. We have located the garages on the front property lot line. The lot starts sloping dawn at the edge of the pavement. If we tried to push back the garages to give some setback, we'd have even greater challenges far the height (See A-303). Allowing the garages to be built on the property line allows the least impact on Mountain Laurel Drive. 2. If the garages met the 30 foot setback the garages would he on top of the existing duplex (See sheet A-DO1). This is not a practical solution. 3. Again, the garages are designed to present a low profile along the street scape. We are not proposing a large mass looming over the property. 4 Board of Adjustment Application, Quaker Condominium Association 28 4. Along the North side there is a shared property line with Lot 53. The side yard setback is 10 feet. We are requesting 5 Feet for the corner of the garage, the same as the current utility easement. (See sheet A-002). 5. We have consulted with the County Engineer, GR Fielding during the Activity and Site Plan review process regarding the aprons and associated structure within the right of way. The Quaker Condominium Association will agree to a Right of Way permit with Pit kin County Public Works. In summary: The strict application of the land use code is not feasible for these lots due to the steep topography and shape of the property. The most practical location for the garages is within the Front 30 foot setback with direct access to Mountain Laurel Drive. The height along the road is under the accessory height. By granting relief from the strict application of the Land Use Code, this project will not cause substantial detriment to the public good. We feel that the experience along Mountain Laurel Drive will be enhanced, and the safety of the road will he improved by taking the cars off the right of way. This project has been discussed for decades by the owners of Quaker Condos. The current parking situation has never worked for the owners or the neighborhood as it creates safety issues for Mountain Laurel Drive. The hardship created by the difference between the elevation of the homes and their access off Mountain Laurel Drive necessitates the requested variances to the Land Use Code. This request for four garages and associated infrastructure will meet the Quaker Condominium Association's needs and benefit the Mountain Valley community. Each unit owner is requesting a 500 square foot garage. Pursuant to Section 5-20-70: Measurement of Floor Area, duplexes within the Urban Growth Boundary and in the R 15A zone district are allowed up to a maximum of 1,000 square feet of garage per lot. Each of the two garage structures, as proposed, are 1,000 square feet. 4. Enclosed storage space, not tD exceed 5'6" in height, is proposed under the floor of the garage. Comments were received from the County Enginccr, the Zoning Oiiiecr, and the HOA. The HOA supports the project finding that the project removes parked vehicles from the roadway. The Director finds that the application complies with the applicable provisions of the Land Use Codc ("Code"), as amended, found at Sections 7-20-20(b)&(c) as follows: A. The lots are in a legally platted subdivision, recorded prior to 1972. The Mountain Valley Subdivision Filing 2 was recorded in 1969. Filing 2 includes Lots 52 and 53. 13. Given the steep slopes of the property, the Applicants propose to construct the garages cantilevered over the steep slopes of the front yard of the property and to anchor and enclose the area below the garage floors. This location for the garages is the only alternative to construct garages on the property. C. A Letter of Observation from RI Engineering & Consulting, Inc. provides observations of the slope and disturbance to the slopes. The letter comments that the slopes greater than 30% will be impacted by the construction of the garages and it is the engineer's opinion that the steep slopes appear to be minor slope anomalies as compared to other portions of the lot, believing they are a result of the construction of Mountain Laurel Drive. The letter observes that the stability of the subsoils and slopes would not be adversely affected with the construction of the garages. However, per the requirements of these code sections, the Applicant, at the time of building permit submittal, will be required to provide more detailed engineering demonstrating compliance with Section 7- 20-20(c)(1)(a)&(b). Any permanent shoring elements (e.g., soil nails) shall be contained within the activity envelope on site and shall not extend into the ROW. Pitkin County Engineering recommends a road ROW permit to accommodate these minor improvements. 10. The garages are proposed within the front yard setback of both properties. A Board of Adjustment variance is required to locate the garages on this portion of the property. 11. The Applicants propose to install solar panels on top of the garages. The garages have flat roofs and the panels will protrude approximately 5-13" above the roof. However, because the garages step over the steep slopes the height of the garages, as measured from natural grade, will exceed the maximum allowed height of 20' for accessory structures as defined in the Code. A Board of Adjustment variance is required for the height of the garages, including the solar panels. Permits were toquircd in the Crystal River valley after 1973, and die 100' stream setback was established in 2006 making the single-family residence a pre-existing, legal, non -conforming structure in the Crystal River setback pursuant to Sec. 9-50-20, T+Tn County records exist indicating that the accessory struclnn axistu d prior to County pcmriiting requirements. Existing drains within the structures stab support the stated use and the likely pro-1973 existence of the structure as a washing facility. Per a Pitkin County Code Enforcement Officer letter dated, November 21, 2007, the owner was instructed to submit for a building permit to legalize the sheds. A permit application was submitted in 2008, however a final inspection was never completed to verify that 2 of the shads were removed, and the remaining sheds were relocated beyond 30' of the identifiable mean high water mark as required by the permit, 'therefore the existing 5 sheds remain unpemritted structures. No records have been provided demonstrating that the sheds or carport were pro -existing or legally permitted shuchures. The Applicant is proposing to remove ail but two of the sheds.
