Comments: Application material was referrer! to. - Zoning Officer: DATE: July 30, 2022 TO: Pitkin County Board of Adjustment FROM: Pitkin County Residents and Landowners Stephanie Sobotik and Julie Jordan RE: Request for variance on setback due to hardship created by existing structures We, the permanent residents and homeowners of 284 Riverside Road in Carbondale, CO, Pitkin County, are requesting a setback variance to build a cover over an existing concrete parking pad to protect our camper from weather, sap, branches, etc. The existing concrete pad where we park the camper has been within the setback of the north property line since 1980. We are requesting a 20' setback variance for the camper cover. We are only requesting to build a cover (with no electricity, water or walls) over the existing concrete pad. • The camper cover would only cover the camper [not the entire parkingarea] • The camper cover would require a setback variance to within 20' of the Narth property line on existing concrete • We currently park the camper on this existing concrete pad • No new materials will be added to the area other than the poles/supports roof for the raver • All materials will match the existing structures We are basing the setback variance request on existing hardships that prevent us from placing camper/cover anywhere else on the property. Hardships for consideration of the setback variance and placement of the camper cover: • Legally existing permanent structures: House, garage, and concrete patio [bu[it in 1974) • North property border. legally existing concrete driveway and concrete RV parking (since 1980) • West property: River/river setback along the entirety of the west side of the property (water well located on northwest portion of property). West side of property to driveway is considered Flood plain. Driveway and parking areas are not in the floodplain. • South property: Legally existing concrete patio, septic tank, leech field and several 40+-year-old mature trees • East side of property behind house and garage is a steep hill rising to the back of the property In November2021 our contractor started construction of the project thinking a permit was not needed in Pitkin County fora pole barn structure. He learned a few days later that a permit is needed and ceased construction until we obtain the proper permit. He has since met with the planning committee and determined a setback variance is needed by Pitkin County. Photos of the existingconcrete pad and parked camper are included, as well as surveys to show the entire property, existing hardscapes and proposed location of the camper cover. Designs and drawings are also attached. The finished product will match the existing paint color, shingles and style of the existing house and garage. We have applied fora land use assessment as well. It is with the committee and pending approval. Please let us know if we can answer any additional questions or provide more information. Owners/Trust currently complaining that camper cover would bring down their property value PAI FROM:   Beverley and Frank Hill  TO:   Pitkin County Board of Adjustment  SUBJECT:   Adjacent Property Owners Response to VARIANCE REQUEST 08‐2022    At the Oct. 4th meeting the applicant left, came over and took detailed pictures of our house and then  showed them during the final meeting session in an attempt to downgrade our property.  We certainly  don’t think our property is run down, but improvements such as building a garage/studio or making  needed repairs can always be done.    Downgrading the adjoining property as a means to somehow offset the negatives of a variance request  is not justified.   The status of an adjoining property doesn’t lower the standards or requirements for  obtaining a setback variance.  Per the Pitkin County Building Code “Rear yard setbacks are measured as the least horizontal distance  between any point on the rear lot line and point of the structure or use”.   In the Improvement Survey  Plat provided by the applicant the surveyor denotes this measurement as 8.1 feet at the northwest  corner of the RV Cover (carport) that has been partially built.   Therefore, the Rear Yard Setback appears  to be 8.1 feet and not 10 feet as stated by the applicant.   The setback variance as requested is not  adequate for the partially built (frame only) RV Cover.     The RV Cover extends several feet in front of the existing garage.   The front façade of the RV Cover is  only about 10 feet from the Riverside Road easement.   Refer to the photos or the Improvement Survey  Plat.   This is much too close in an already confined area.  If the 284 Riverside Road property is sold the new owner might not need a large RV Cover.   In that case  the structure could be enclosed and used for other purposes.   We know of several locations where this  has happened.   Depending on what it is used for it might create a lot of traffic in this area.  The applicants “Hardships for consideration” on the “South property” are leach field, mature 40‐year‐ old trees and steep slope on the east side of the property.   Two dead or dying willow trees could be  removed to create space for an RV Cover.   County building codes permit building within 5 feet of a leach  field.   The back end of the existing RV Cover (frame only) is built into the slope on the east side of the  property.   Building into the slope on the south side would be easier because the slope is not as steep as  on the north side of the property.   Therefore, an RV Cover could possibly be built on the south side of  the property.  As noted on the Improvement Survey Plat the owners of 284 Riverside Road also own the adjoining  property to the south.  If additional space is required on the south side of 284 Riverside Road to build an  RV Cover a small section of land could be deeded from the adjoining property.   This would not  negatively impact the adjoining property since the building area is located on the east lot line and is  accessed from North Bill Creek Road, not Riverside Road.  In conclusion we feel the large RV Cover (32 ft. X 15 ft.) located lengthwise 8 feet (where 30 ft. Is  required) from our front lot line and about 10 feet from the road is out of place and the variance request  should be denied.
