HISTORIC INVENTORY

RECITALS
1. Ranch IV LLC ("Applicant") has requested that the Pitkin County Board of County Commissioners
("BOCC") designate the Bane Homestead to the Pitkin County Historic Inventory and grant a growth
management exemption. The Homestead contains the remains of 4 structures. The Applicant proposes to
rehabilitate two of the structures - the original homestead cabin as a dwelling unit and one accessory
structure - and to stabilize the other two structures to prevent further degradation of the resource.
2. The parcel is located west of Prince Creek and Dinkle Lake Roads, and is described as Bane Tract

3. The parcel is zoned RS-30/PUD and contains approximately 500 acres.
4. The Bane Tracts Plat was recorded in Plat Book 59 at Pages 62-68. The Hearing Officer granted
land use approvals in the spring of 2002 (Determination Nos. 22-2002 through 26-2002). The 1041 site
plans were recorded in Plat Book 62 at Pages 88-96. Each tract is also subject to a Development
Agreement with the County, recorded at Reception Nos. 474059, 474060, 474061, 474062 and 474063,
which provides for 20 year vested rights that shall expire on September 25, 2022. The Hearing Officer
approved minor amendments to the site plans pursuant to Determination No. 17-2003; the amended site plan
for Tract 5 has not yet been recorded.
5. The BOCC considered the request at a public meeting on August 27, 2003, at which time
evidence and testimony were presented.
6. The BOCC finds that the Bane Homestead cabins are eligible for designation to the Pitkin County
Historic Inventory, given that they are associated with the early settlement history of this area, and that
their preservation and rehabilitation in their original locations will continue their contribution to the
landscape.
7. The BOCC further finds that the Applicant is not eligible for the growth management exemption for
one additional single family dwelling unit on a parcel containing an historic structure, since the Applicant
has already obtained the right to develop one additional single family dwelling unit pursuant to the 500 acre
growth management exemption.
NOW THEREFORE BE IT RESOLVED by the BOCC that it does hereby designate the Bane
Homestead to the Pitkin County Historic Inventory and exempt the rehabilitated historic dwelling unit
from growth management, subject to the following conditions, which shall run with the land and be
binding on all successors in interest:
1. Prior to building permit application to rehabilitate the structures, the Applicant shall record a covenant
in a form acceptable to the County Attorney and the Historic Preservation Officer in which the Applicant
agrees to maintain and rehabilitate the historic structures in accordance with the Secretary of the
Interior's Standards for Rehabilitation. The covenant shall specify that the cabins will not be expanded,

except as shown on the plans dated August 13, 2003 that were reviewed and approved by the Historic
Preservation Officer and as necessary to comply with UBC requirements, and that no development will
occur within the designated historic envelope other than the rehabilitation of the cabins, and the well,
septic system and parking associated with the historic cabin.
2. Include a note on the 1041 site plan identifying the location of the Bane family grave sites.
3. The historic structures shall count towards the 15,000 square foot maximum allowable residential
floor area for the parcel.
4. The Applicant shall adhere to all material representations made in the application and public
meetings.
APPROVED AND ADOPTED on the 27th day of August, 2003.
