SUMMARY: The attached resolution of the Planning and Zoning Commission forwards the Rural Area
GMQS scores for the competition for additional floor area. The following development applications
were submitted for the July 2003 competition:
· Mathys: requesting an additional 4,650 square feet of floor area for a property located at 0299
Conundrum Road and described as a parcel of land being part of H.E.S. No. 112, Township 11 South,
Range 85 West of the 6~' P.M.
· Miller/Staley (Pitkin Exchange Holdings of Aspen, I,I,C on their behalf): requesting an additional
3,000 square feet of floor area for Tract 1, J.H. McCabe Ranch Tracts.
· Bay Oil USA, Inc.: requesting an additional 5,500 square feet of floor area for Lot l 1, Castle Creek
Valley Ranch.
· Bay Oil USA, Inc.: requesting an additional 5,500 square feet of floor area for Lot 12, Castle Creek
Valley Ranch.
There are 26,500 square feet available in the Rural Area for the second round of competition for additiolml
floor area (l 3,500 square feet were allotted in the first competition). The 4 applicants requested a total of
18,650 square feet of floor area.
The Commission scored the applications as follow:
· Mathys: 46 points
· Miller/Staley: 57 points
· Bay Oil USA, Inc. (Lot I1): 48 points
· Bay Oil USA, Inc. (Lot 12): 48 points
Three of the applications met the minimum threshold score of 48 points AND achieved the minimum
threshold score for each scoring category, as required to be eligible for an allotment. These applications are:
Miller/Staley and both Bay Oil lots. The Mathys application did NOT meet threshold.
In summary, the Commission recommends allocation ora total of 14,000 square feet of floor area, which
is less than the amount available.
Pursuant to Section 9-150-040, any appeals of the scoring must be filed in writing within 15 days of the
Commission's public hearing. Staff has forwarded the scores within the appeal period, which will expire
on September 24. A majority of at least a quorum of the BOCC may vote to rescore an application.
the 15 day appeal period has expired, the BOCC shall by resolution allocate the allotments. Once
RECOMMENDATION: No action is required at this time.
RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF PITKIN COUNTY,
COLORADO, FORWARDING THE 2003 SECOND COMPETITION RURAL AREA GROWTH
MANAGEMENT QUOTA SYSTEM SCORES FOR ADDITIONAL FLOOR AREA TO THE
BOARD OF COUNTY COMMISSIONERS

RECITALS
1. On September 9, 2003, the Planning and Zoning Commission ("Commission") held a duly noticed
public hearing at which time evidence and testimony was presented with respect to Growth Management
applications.
2. The Commission reviewed the following applications for the 2003 Rural Area GMQS competition
for additional floor area (2'd competition):
· Mathys: requesting an additional 4,650 square feet of floor area for a property located at 0299
Conundrum Road and described as a parcel of land being part of H.E.S. No. 112, Township 11
South, Range 85 West of the 6~ P.M.
· Miller/Staley (Pitkin Exchange Holdings of Aspen, LLC on their behalf): requesting an
additional 3,000 square feet of floor area for Tract 1, J.H. McCabe Ranch Tracts.
· Bay Oil USA, Inc.: requesting an additional 5,500 square feet of floor area for Lot 11, Castle
Creek Valley Ranch.
· Bay Oil USA, Inc.: requesting an additional 5,500 square feet of floor area for Lot 12, Castle
Creek Valley Ranch.
4. There are 26,500 square feet available in the Rural Area for the second round for the 2003 GMQS
competition for additional floor area (13,500 square feet were allotted in the first competition).
5. . The Cmm~ission scored the applications as follows:
· Mathys: 46 points
· Miller/Staley: 57 points
· Bay Oil USA, Inc. (Lot 11): 48 points
· Bay Oil USA, Inc. (Lot 12): 48 points
6. Tbe Miller/Staley and Bay Oil (both lots) applications exceeded the minimum threshold score of 48
points and achieved the minimum threshold score for each scoring category, and are, therefore, eligible for
allotments. The Mathys application did not meet threshold, and, therefore, is ineligible for an allotment.
NOW, THEREFORE BE IT RESOLVED by the Commission that it hereby forwards the 2003
Rural Area GMQS scores for additional floor area (2~d competition) to the Board of County Cormnissioners.
