This application was continued from last month’s meeting so that the Applicant’s representative
could attend. The Applicant requests Front and Rear Yard setback variances for the
redevelopment of a single family residence. The lot contains approximately 35,109 sf and is
located in the R-15 zone district.

Dear Joanna and Members of the Board of Adjustment:
The Applicant and property owner, Choi Family Trust 4/22/2004, is formally requesting a
Board of Adjustment (“BOA”) hearing for the setback variances necessary to redevelop
proposed improvements in the front and rear yard setbacks. The Applicant owns the
0.806-acre (approximately 35,109 square feet) lot at 308 S. 7th Street, in Aspen. The
property is located at the base of Shadow Mountain, inside the Aspen Urban Growth
Boundary, and it is zoned R-15 (i.e., where there is a Floor Area Ratio of 0.16). Access from
S. 7th Street is obtained via a 20-foot utility and access easement (per Easement
Agreement recorded in Plat Book 405 at Page 839; see attached Survey at Exhibit F).
The existing property includes three separate, non-conforming structures: a multi-story
residence, a two-story shed, and a two-story garage/apartment. In addition, an L-shaped
concrete retaining wall that was meant to mitigate rockfall hazards but has since been
determined inadequate in both height and breadth to provide protection exists along the
southerly boundary of the property. All these improvements will be demolished to
accommodate a comprehensive redevelopment.
Specifically, (a) the existing multi-story principal residence encroaches into both the front
and rear yard setback areas, (b) the existing two-story garage and apartment resides
entirely within the rear yard setback area, (c) the existing two-story accessory shed
structure also resides entirely within the rear yard setback area, and (d) the failed (i.e.,
inadequate and non-functioning) attempt at a rockfall/avalanche mitigation wall sits
entirely within the rear yard setback area.
The property is a legally established conforming parcel of record in the R-15 Zone District,
and the existing structures were legally built with duly issued building permits for the
original construction. The residence was issued a Certificate of Occupancy on October 6,
1987, pursuant to Building Permit 9426; the garage/office structure was issued a
Certificate of Occupancy on January 18, 1995, pursuant to Building Permit 3-412; the
original shed structure was built without a permit but was legitimized some twenty years

later, in 2012, via adoption of Board of Adjustment Resolution No. 12-2012 (Reception No.
597001).
Being located within the R-15 zone district, which carries a 0.16 FAR, and inside the UGB,
this 35,109 square foot lot allows 5,617 square feet of Floor Area (FAR) and 5,750 square
feet of gross floor area exempt from GMQS without a TDR. The gross/final maximum floor
area allowed on the property with TDRs is 10,367 square feet. The home design approved
with the Site Plan Review process uses one TDR for development of up to 8,250 square
feet of gross floor area as follows:
• 5,102 square feet of above grade floor area (2,299 square feet on level one and 2,803
square feet on level two),
• 551 square feet of garage (133 square feet exempt), and
• 2,594 square feet of below grade space (2,500 square feet exempt).
As such, the total above grade space complies with the 5,750 square foot base maximum
without exceeding the 5,617 square feet of allowable FAR or the 10,367 square feet of
final maximum gross size/floor area. Should the use of a TDR prove impractical due to
market conditions, the Applicant maintains the right to adjust the floor plans within the
footprint to utilize the allowable FAR and develop the 5,750 square feet of base maximum
square footage without affecting the Activity Envelope and Site Plan Review approvals.

vicinity map below (larger version attached).

The reason everything built on the property encroaches into the setback areas is simple:
it is an unusually narrow/shallow, triangular lot with abundant site-specific environmental
and topographic constraints that require pushing all development into the narrow portion
of the property, where the required setbacks leave insufficient area to accommodate the
permitted structures or floor area. These issues have been recognized and relieved by the
County in the past, and the image below makes these points obvious:
The entire eastern side of the property is affected by steep slopes, and rockfall and
avalanche hazards. In addition, Mr. Jonathan Lowsky, County-Certified Wildfire Expert, has
stated that, while the entire property should be considered “severe hazard,” as compared
with the rest of the property, the westerly portion of the property is at the lowest wildfire
risk. Given the previous determinations of hazard areas and maximum practicable
avoidance considered when the Activity Envelope and Site Plan Review approvals
(Administrative Decision No. 063-2022, Reception No. 690990) were recently granted, the
only available area on the property to accommodate development while also complying
with zoned setback requirements is indicated by the red triangle in the diagram above
(full-size version attached). The red area is clearly too narrow to enable development of
the allowed floor area on the property while remaining within zoned building height
limitations. The dashed pink lines are the footprints of the existing non-conforming
structures to be removed.

In total, the primary constraints affecting the property – steep slopes, rockfall, avalanche
and wildfire hazards – all direct appropriately mitigated development to the same area,
namely the westerly half of the site. The existing structures are already located on the
westerly half of the property, and redevelopment within the same portions of the
property not only provides for maximum avoidance of the hazards but also ensures that
development is confined to the previously disturbed portions of the site. The replacement
structure will be built in compliance with the construction and mitigation requirements of
both the current Land Use Code and adopted Building Codes to include, but not be limited
to, a fully sprinklered home in accordance with NFPA 13D. As such, the new residence will
be at substantially reduced risk as compared with the existing residence and outbuildings.
In addition to the Chapter 7 constraints that force development onto the west half of the
lot, the parcel also has an unusual shape that makes full compliance with R-15 zone yard
setbacks impractical/impossible. The minimum front and rear yard setback requirements
are 30 feet, and the required side yard setback is 15 feet. The west side lot line is only
62.56-feet long, leaving 4’-3½” between the front and rear yard setback lines. At the
center of the setback-compliant red triangle area, the depth is merely 18-feet, and the
widest portion of the setback-compliant area is just 32’-3¼” deep (see diagram below).
The rear yard setback requirement was only 10 feet when the County accepted building
permit applications for the existing single-family residence and the detached accessory
structure. Due to the unusually narrow shape of the parcel and the geologic hazards
impacting the site, the Applicant is seeking Board of Adjustment relief to enable
development consistent with the recently approved Activity Envelope and Site Plan.
On November 6, 2012, the Board of Adjustment approved Resolution No. 12-2012
(Reception No. 597001). The Resolution legalized the previously permitted and built
garage/office structure by granting a 9-foot rear yard setback variance where 30-feet were
required and permitted a previously built shed structure by granting a 27-foot rear yard

setback variance where 30-feet were required. While these variances addressed and
eliminated the nonconforming status of the garage/office and shed structures, they did
nothing to address the fact that the existing house also fails to comply with the 30-foot
front yard setback requirement (it resides at approximately 15-feet from the front
property line), and its wood deck sits at approximately 24-feet from the rear property line
where 30-feet are required. The concrete retaining wall at the rear property line was
deemed in 1986 to be allowed without a setback variance since it is not more than 6-feet
tall, although it has no relation to access, exceeds the normally applicable 30-inch height
limit, and has since been determined to provide little to no protection from rockfall
hazards.
To be compatible with neighborhood development patterns and sensitive to immediate
neighbors, the replacement home has been designed to provide a 10-foot front yard
setback and a 25-foot rear yard setback, with the only exceptions (i.e., further reduced
setbacks) being a pair of proposed site walls for improved emergency access to the rear
side of the residence, as desired by the Aspen Fire Protection District, and improved
drainage. These two site walls may exceed the 30-inch grade restriction in the proposed
25-foot rear setback area, depending on the precise final measurements of natural and
finished grades. Rather than risk these walls later being found non-compliant, it seems
prudent to simply include them in the variance request. All portions of the proposed
structure(s) requiring setback relief are indicated in red on the reduced-size screenshot
provided below (the full-size diagrams are attached).

Administrative Decision No. 063-2022 was approved and recorded (Reception No.
690990) in October of 2022 granting approval of an Activity Envelope, Site Plan, and
Growth Management Exemptions for a Replacement Residence and Use of a TDR.
Condition #5.A. of this Decision explicitly anticipated the need for setback variances on
this Property:
Recital 6 of Administrative Decision No. 063-2022 more or less summarizes the site
constraints described above, as follows:

Applicable Code
Pursuant to Section 2-10-30(d) of the Code, the BOA is authorized to hear requests for
variances from the structure height or yard and road setback provisions of the Code,
subject to the procedures established in Section 2-40-110, which states the following at
subsection (b):
The Board of Adjustment shall only approve a variance where, by reason of
unusual narrowness, shallowness, or shape of a specific piece of property
at the time of the enactment of the regulation, or by reason of unusual
topographic conditions or other situation or condition of such piece of
property, the strict application of the height or Road and Yard setback
regulations of this Land Use Code would result in peculiar practical
difficulties to, or undue hardship upon, the owner of such property, and the
granting of relief from the strict application of this Land Use Code will not
cause substantial detriment to the public good and will not substantially
impair the intent and purpose of the Pitkin County Comprehensive Plan and
this Land Use Code.
Conformance with the zone district standards for front- and side-yard setbacks is not
feasible for the subject property due to its unusually narrow/shallow, triangular shape
with abundant site-specific environmental and topographic constraints that require
pushing all development into the narrow portion of the property, where the required
setbacks leave insufficient area to accommodate the permitted structures or floor area.
Previously approved setback variances for the structures existing on the property today
were granted in recognition of the unusual site-specific constraints resulting from
topographic hardship, site constraints, and the narrow shape of the property, all of which
are conditions that remain.
Indeed, the already granted Site Plan Review approval memorializes the subject property’s
development rights, noting that the lot allows 5,617 square feet of Floor Area (FAR) and
5,750 square feet of gross floor area exempt from GMQS without a TDR. The gross/final
maximum floor area allowed on the property with TDRs is 10,367 square feet. The home
design approved through the Site Plan Review process uses one TDR for development of
up to 8,250 square feet of gross floor area as follows:
• 5,102 square feet of above grade floor area (2,299 square feet on level one and 2,803
square feet on level two),
• 551 square feet of garage (133 square feet exempt), and

The rear yard setback requirement was only 10 feet (or only 1/3rd of today’s minimum
setback requirement) when the County accepted building permit applications for the
existing single-family residence and the detached accessory structure. Due to the
unusually narrow shape of the parcel and the geologic hazards impacting the site, the
Applicant is seeking Board of Adjustment relief to enable development consistent with
the recently approved Activity Envelope and Site Plan.
Not only are all the site constraints described above present, but the property’s only
access is via an easement through the neighboring property and adequate area for turning
around a fire truck is required within the property boundaries, at the end of the driveway
easement. This requires pushing the residence to the east, even further restricting the
developable area of the property. By providing a new firetruck turnaround that does not
currently exist, and as requested by the Fire Protection District, the proposed site
improvements will further reduce the risk to the property.
Holding the property to the strict application of the zoned setback limitations would very
much result in peculiar practical difficulties to, and undue hardship upon the Applicant as
there would be no conceivable way to realize the recognized and accepted development
rights associated with the Property. Clearly the granting of relief from the strict application
of the zoned setback requirements is needed to enable development of a home that is
consistent with neighborhood character and the standard rights afforded by the zoning.
Granting of the requested relief will not cause detriment to the public good, nor will it
impair the intent or purposes of the Aspen Area Community Plan or the Land Use Code.
If any such detriment or impairment would result, then the Activity Envelope and Site Plan
Review application never would have been approved. (Also see Recital 6 of Administrative
Decision No. 063-2022, pasted above.)

As the above-cited Recital #6 from Administrative Decision No. 063-2022 explains, the
approved Site Plan will not cause any detriment to the public good, nor will it impair the
intent or purpose of the Pitkin County Comprehensive Plan or the Land Use Code. The
variance request meets the criteria established in §2-40-110 and should be approved
accordingly. Without the requested variances, the property is practically undevelopable,
and the Applicant would be forced to work within the footprints of the existing structures.
However, the existing structures are not adequately mitigated against the present
avalanche, rockfall, or wildfire hazards, meaning they cannot be considered safe; nor do
they comply with existing site constraints, as stated above.
The approved redevelopment plans accommodate all necessary hazard mitigations and
are, therefore, a great improvement relative to the health, welfare, and safety
requirements of the Land Use Code. As an additional result, the four (4) separate, existing
structures that encroach into the front and rear yard setback areas will be eliminated
altogether. The elimination of these structures for replacement with the approved
residence represents a significant improvement for the property and surrounding
neighborhood.
