Permit Conditions:
This OWTS Construction Permit is approved on the condition of compliance with the engineer design as submitted with the application and the specifications
cited above. Changes must be approved by this Department and the engineer prior to construction.
The existing tank will be removed and a new 3250 gallon FLXX 3-compartment tank and two Advantex AX-20 units
(secondary treatment) will be installed. Effluent will be pumped to a central manhole, then entering the distribution pipes.
Since the new field is proposed in the area of the existing field, the existing field must be removed. The new field will consist
of distribution pipes set in 1 ft of /" washed rock over 6 ft of 1 Y" screened rock. The 6 ft of washed rock will be at different
elevations due to the clay layer discovered in the southern portion of the drywell excavation. *In that half of the drywell, 4 ft of
recompacted native soil will be installed to compensate for the "confining layer. Dimensions of each half of the drywell will be
20.5 ft x 51 ft. The inlet pipe will enter the manhole at the elevation specified on the engineer design. There will be a
significant amount of backfill over the top of the field, with depths to vary depending on grading between the driveway
contours.
Calculation of the area was done using sidewall and bottom area (subtracting 66 sq ft for the large rock), as is typical to
calculate area of a drywell. With the varying soil conditions, an "average" percolation rate of 110mpi was used, and calculating
drywell capacity with percolation rates exceeding 60 mpi is not allowed per regulation. Using the deep gravel formula, the
engineer has confirmed a length of 49 feet would be required. The system will have 51 ft of length, exceeding the minimum
required capacity.
This Permit must be kept on -site during installation. The engineer must do a final inspection of the installation and submit an "as -built" letter to this
Department within 30 days of the final inspection, unless a longer period of time has been agreed upon, in writing. This Department must also be called for
the final inspection with a minimum of 48 hours notice.
Minimum horizontal distances between components of the system and physical features shall conform to the requirements of the Pilkin County OWTS
Regulation.
This Permit is conditioned upon the property owner(s) providing for regular inspection, cleaning, and maintenance of the system by qualified personnel, in
accordance with the manufacturer's recommendations and the requirements of the Pilkin County OWTS Regulation.
THIS PERMIT IS EXPRESSLY CONDITIONED UPON COMPLIANCE WITH ALL REQUIREMENTS OF THE PITKIN
COUNTY OWTS REGULATION, INCLUDING BUT NOT LIMITED TO THOSE CONDITIONS SPECIFIED ABOVE.
Plans and specifications for the proposed OWTS have been reviewed and are considered satisfactory. Permission is hereby

With this letter we are also providing the plan as -built of the Terral OWTS.
The swing -ties were provided by ICM Group.
The system was observed during construction, and the design intent to deal
with the slow percolation rates on the south-westerly side of the field was
generally followed. The plan does not show any separation between the
south-westerly side of the field and the north-easterly, because in fact there
is none. The revised design for the two sides of the field is generally
accurate, and can adequately serve as an as -built of the system.
We observed the operation of the pumps and AdvanTex system, and all
appeared to be operating satisfactorily.
We are aware of no significant deviations from the design intent and the
permitted plans (as revised).

Dear Carla:
Well, once again the Terral system has to undergo changes, this time
precipitated by the conditions discovered at the bottom of the excavation
for the drywell. What we found, in a nutshell, was as follows:
1. The southerly side of the field, closest to the house and garage, has
significant areas of very clayey soils, some that formed near perfect
"ropes" when rolled between the palms of one's hands. The clayey
soils appear to be confined to the southerly side of the field, and do
not extend into the sides, except at the extreme south corner, closest
to the house. This side of the field was excavated deeper than we
had anticipated, with the cut -slope approximately 18-feet deep. We
had anticipated a maximum depth of approximately 16-feet. We
are taking the approach that this side of the field has a bottom that
is effectively a "confining layer".
2. The northerly side of the field, had some small areas of clayey soils,
apparently isolated to the extreme north corner, otherwise, the
bottom of the field percolated, though with highly variable rates
(222-mpi to 5-mpi).
3. In addition, on the northerly side of the field, a very LARGE rock was
encountered, which was too large to be removed with the equipment
available. The decision was made to leave this rock in place, and
adjust the area available on both the bottom of the field and on the
sidewall of the field by the area "occluded" by the rock. Rough field
measurements were made, and a conservative value was
established for the bottom and side areas of the rock.

half of the field by a separation fabric (either Mirafi 140-N, or 600X, per plans). The
replaced native soils on the southerly side of the field serve to raise the gravel bed on that
side above the confining layer by a minimum of 4-feet. In addition the native soil backfill
places the gravel on that side on a level with the faster percolating soils previously
discovered, so that the sidewalls will percolate at a reasonable rate. Above the native
soil, the installed 1 1/2-inch minus screened rock has a surface area of 20.5-feet by 52-
feet, and a depth of 6-feet (not including the 1-foot depth of washed rock at the top),
giving a volume of 6,396-cubic feet. Within this rock volume, there is at least a 10% void
space, or approximately 639-cubic feet of storage volume, equating to 4,784-gallons of
liquid.
On the northerly side of the field, there is approximately the some volume of rock, and
correspondingly the same void space and storage volume, though the large rock will
occupy perhaps as much as 450-cubic feet of space (a very conservative [i.e. large]
volume estimate).
The northerly and southerly halves of the field will be in contact and free to pass effluent
between them from the bottom of the southerly field to the top of the northerly field, a
height of approximately 2-feet. Disparities in the bottom and/or sidewall percolation
rates between the two sides of the field will most likely allow more of the effluent to pass
to the northerly side.
The required minimum area of the absorption field, adjusted for the use of the AdvanTex
advanced treatment system, and also adjusted for the use of a dosing pump in the third��ayl "
compartment of the septic tank, is 2,518-square feet.

The AdvanTex advanced treatment system will help minimize the formation of a bio-mat,
and help keep the system from plugging. In addition, the fact that there are
approximately 9,568-gallons of available storage in the void spaces of the gravel will
help mitigate any areas of slower -percolating soils, by allowing a longer time for the
effluent to drain.

Dear Nancy:
This letter is to serve as an addendum to the plans package which we are
submitting today for the above referenced project.
Our site inspection of the proposed area for the absorption fields at this
residence revealed an issue that needs further exploration to confirm our
suspicions. In our inspection of the profile hole, we observed some
evidence of water on the rocks and in the soil in one are of the hole. We
believe that this mottling of the soils was due to the presence of an existing
(and to be abandoned) absorption field for the original residence. This
belief is based on the following information:
1. Original OWTS permit documents, showing an 18' by 51' gravel
and pipe absorption field in the approximate area of the profile
hole.
2. Review of the CTL/Thompson Soils and Foundation Investigation for
the Terral Residence Additions of May 20, 2008, which includes the
log of a bore hole drilled near the garage, showing that no water
was found to a depth of 20-feet. A copy of that report is attached,
refer please to Figures 1 and 2.
3. Review of the Soil Conservation Service soils maps and tables,
showing that the two soils present in the area, "67" Jerry-Millerlake
Loams, and "110" Uracca-Mergel Complex, do not have water at
any depth up to 6-feet.
In order to be sure that the absorption fields are not constructed in an area
of high groundwater, we are proposing that the absorption field areas be
excavated to the full depth as shown on the plans submitted with this letter,
and that in each of the two fields, an additional 8-foot deep profile hole be
excavated below the bottom of the field. The current plans show that the
new profile holes would be excavated in the middle of the width of the
fields, towards the southeast end of each field (the deepest end). If Pitkin

County so desires, these profile holes could be pushed to the east side of
each absorption field, and after excavation and inspection, a permanent
observation pipe could be set in the excavation, and extended to the
surface, for observation purposes throughout the year.
In the unlikely event that groundwater is encountered in either of the
excavations, we would revise the system drawings to provide for a
minimum of 4-feet of separation between the top of the groundwater
surface, or the top of the mottled soil layer, and the bottom of the
absorption field(s).
Because the three percolation tests made on this site were made at the
standard depth of 3-feet below ground, and because the design of the
proposed absorption fields extends to depths of approximately 10.85-feet
below existing ground, we are proposing an additional series of percolation
tests be performed at the actual proposed depth of the absorption fields.
We are proposing that two additional tests be performed at the bottom of
each of the excavations for the absorption fields, as shown on the design
plans submitted with this letter.
In the event that the percolation rate established by these supplemental
tests is significantly higher than the design percolation rate of 40-minutes
per inch used with these plans, we will revise the design drawings to
accommodate the change. Our approach will be to use the "deep gravel"
formula to accommodate the slower percolation rate. In the event that the
percolation rate established by the supplemental tests is faster than the
design percolation rate, we would propose no changes to the current
design. It should be noted that the design percolation rate of 40-minutes
per inch is the slowest of the three rates recorded in our testing on October
30, 2007.
On the checklist for the OWTS plans package, an item to be explored is the
location of any wetlands on the project site. While there has been no
formal site inspection by the U.S. Army Corps of Engineers, nor by a
qualified wetlands botanist/geologist, we feel confident, based on our site
inspection, and review of the Soil Conservation Service maps and
documentation, that the soils in the area are not at all conducive for the
production of wetlands. Both the Jerry-Millerlake and Uracca-Mergel
Complex soils present on the property are considered "Very Poor" or "Poor"
soils for wetlands habitat, and do not have any wetlands species growing
upon them.
Our inspection of the profile hole showed a layer of topsoil, well vegetated,
with roots, at varying depths of 6-inches to 1-foot. Below this was a tan

layer of soil and small rocks, about 1-foot deep, with fewer roots. Below
this was a layer of sandy, rocky soil, with larger rock, to a depth of about 4-
feet. The remainder of the profile hole was a darker brown soil with many
rocks of all sizes from gravel to boulders, down to a depth of 8-feet. No
free water was observed in the hole, and a perforated pipe was set in the
hole for future observation.
The site for the septic tank and the absorption fields have been staked in
the field, no vehicular traffic or materials storage will be allowed over these
areas.

SUMMARY OF RELEVANT PARTS OF APPLICATION: The applicant is requesting Activity
Envelope and Site Plan approval for 178 Aspen Oak Drive. The applicant is proposing to add
two new additions to the existing 5,097 square foot home, for a total of 8,000 square feet.
DISCUSSION: The Pitkin County Environmental Health & Natural Resources Department has
reviewed the details of the Terral Activity Envelope and Site Plan Review application under the
authority of the Pitkin County Land Use Code and the Pitkin County Onsite Wastewater
Treatment System (OWTS) Regulation, effective March 8, 2008, and has the following
comments.
On April 8, 2008, Carla Ostberg, Mike Kraemer, and Cari Ann Holcomb of the Pitkin County
Community Development Department and Graeme Means, representative of the applicant,
conducted a site visit to the property. Snow covered the site, which did not permit a good
evaluation of the area of the existing septic system. The applicant did not indicate that an area
for a new OWTS was being investigated. This alternative should be considered in the event
that the existing system is not able to be used for purposes of establishing an Activity Envelope
that could accommodate a new OWTS.
--- WATER SUPPLY:
This property is served by a private well. No well permit was provided in the application;
however, in connection with any OWTS Construction Permit for the property, this
Department will require a copy of the well permit issued by the Colorado Division of
Water Resources, the well driller's report, and a recent pumping report. Under current
guidelines, the well must be capable of producing 100 gallons/person/day (assuming 2
persons per bedroom in a dwelling). There must be storage or yield capable of a 24-hr
supply.
--- SEWAGE TREATMENT AND COLLECTION:
The existing septic system on the property was originally permitted in 1977 and consisted of a
1250 gallon tank and 918 square feet of absorption area to accommodate four bedrooms. A
drawing was provided to show approximate locations of the tank and absorption field.

The owner's representative indicated that the new house would have five bedrooms. This
existing system is not adequately sized to handle the addition of a potential bedroom. However,
if the number of potential bedrooms in the home would not increase, it is possible that the
existing system may be used, depending on its condition. There are two alternatives:
1. If the existing system is proposed to be used, it must be evaluated by a Registered
Professional Engineer (RPE) and a report of the evaluation submitted to this
Department for review.
2. If the existing system requires repair, or a new system is proposed, an OWTS
Construction Permit issued by the Environmental Health & Natural Resources
Department would be required, and must comply with the County's OWTS
Regulation.
The County cannot issue a Building Permit until an OWTS Construction Permit has been
obtained, or the exiting system has been assessed as suitable to serve the proposed
development.

AND SITE PLAN AND GMQS EXEMPTION FOR A TDR RECEIVER SITE

Tim Terra] (hereafter referred to as "ApplicanRECITALS
t) has applied to the Community Development Director of Pitkin
County, Colorado ("Director") for Activity Envelope and Site Plan Review for an addition to an existing legal
single family residence. The Applicant is requesting use of one TDR for the addition.
1 The Applicant submitted an application after July 6, 2006, therefore, the application is being considered
Pursuant to the 2006 Land Use Code, as amended.
2. The Lot is located at 178 Aspen Oak Drive and is within the Aspen Urban Growth Boundary (UGB), PID#:
2735-033400-024 (Legal Description, Attachment A).
3. The Lot is approximately 5 acres, is in the ARA 0 zone district, and is non -conforming in size.
4. The parcel is currently developed with a legal single family residence that received a Certificate of
Occupancy in 1978. No other previous land use approvals apply.
5. The Applicant has indicated the intent to apply one TDR to this Lot for a maximum floor area of 81250
square fee Pursuant to Section 6-30-50(bxl) the Applicant is exempt from Special Review for a TDR
because the Lot is located within the Aspen UGB,
6. The Lot is visible from Owl Creek Road. Staff has conducted a site visit and the proposed additions to the
residence will not obstruct a ridgeline as viewed from this Road. The parcel is not mapped within any big
game ranges. The Applicant has provided a wildfire report for the Lot which states it is encumbered by a
high wildfire hazard- The Applicant has included slopes > 45% to the south and west of the proposed
additions and along the driveway within the proposed envelope. The Applicant has argued that these slopes
can be considered anomalies pursuant to Section 7-20-20(cx3). During Staffs site visit it was determined
that these slopes are anomalies as they were created from the cut for construction of the existing residence
and during driveway constnuction. However the area to the east of the residence contains slopes > 45% and
is not an anomaly.
7. The Application was referred to the Aspen Fire Department, Buttermilk Metro District, Environmental
Health and Natural Resources (EH/NR), and the CDOW. Comments were received from all and are
outlined as conditions.
8. Public notice was published in the paper on March 30, 2008. No comments were received within 30
days.
9 The Director finds that the Lot is located within constrained areas however the constraints can be
mitigated.

3. At the time of building permit submittal, the Applicant shall surrender the TDR's for additional floor area up
to 8,250 square feet from a base 5,750 square feet.
4. Prior to submission of any future building permit applications, the Applicant shall be required to submit
for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope
in accordance with Land Use Code Section 2-30-20W and Application Manual Section 2-1.12. The above
referenced approvals shall be a condition precedent to finalization and recordation. The Site Plan shall
- include the following changes:
A. Draw the activity envelope to avoid areas of slopes > 45% east of residence;
5. No structural development, with the exception of fencing, in excess of 30" shall occur within the
setbacks of the Lot. Landscaping in the form of berms shall not exceed four feet from the most
restrictive grade. Any external development located within setbacks mandated by County zoning
regulations shall require a variance from the Board of Adjustment. Approval of a landscape envelope
within such setbacks does not assure approval of variance.
6. The residence shall utilize earth tone colors and non -reflective roofmg.
7. Prior to issuance of a building permit application, the Applicant shall:
A. Complete a fireplace/woodstove registration form with the Community Development
Department, if necessary.
B. Obtain a stormwater permit from the State of Colorado if site disturbance exceeds one (1) acre.
C. If necessary obtain a County accessWveway/tamaround permit acceptable to the Aspen Fire
Protection District and County Engineer.
D. Submit a drainage and erosion control plan for review and approval by the Planning Engineer. All
slopes steeper than 2:1 shall utilize erosion control blankets.
E. Submit a construction management plan for review and approval by the County Engineer
showing the locations of staging, material storage and employee and construction traffic
parking.
F. Pay the applicable road and employee housing impact fees.
G. Obtain necessary permits from EH/NR for septic construction. If the existing system is
proposed to be used, it must be evaluated by a Registered Professional Engineer (RP13) and a
report of the evaluation submitted to EH/NR for review. Or, if the existing system requires
repair, or a new system is proposed, an OWTS Construction Permit issued by the
Environmental Health & Natural Resources Department is be required, and shall comply with
the County's OWTS Regulation.
H. The Applicant shall PP provide a copy of the well permit issued by the Colorado Division of Water.
Resources, the well driller's report, and a recent pumping report. Under current guidelines, the
well must be capable of producing 100 gallons/person/day (assuming 2 persons per bedroom in
a dwelling). There shall be storage or yield capable of a 24-hr supply. If a well is not utilized,
the Applicant shall show proof of inclusion into the Buttermilk Metropolitan District.
8. If retaining walls are used they shall comply with the following standards:
A. Retaining walls may be permitted to support steep slopes but should not exceed four (4) feet in
height from the finished grade, except for (i) a structure's foundation wall, or (ii) as necessary to

construct a driveway from the street to a garage or parking area, or (iii) as otherwise expressly
i
allowed by the Land Use Code.
B. A retaining wall should not exceed seven (7) feet in height. Retaining walls greater than four
(4) feet in height shall be supported by appropriate engineering and reviewed and approved by
the County Engineer,
C. Terracing should be limited to two (2) tiers, The width of the terrace between any two four (4)
foot vertical retaining walls shall be at least three (3) feet. Retaining walls higher than four (4)
feet should be separated from any other retaining wall by a minimum of five (5) horizontal feet Terraces created between retaining walls shall be permanently landscaped or revegetated with
native vegetation.
D. Retaining walls used to support existing road cuts may exceed (a), (b), and (c) of these
guidelines.
9. Standards Applicable to All Wildfire Hazard Areas: Development is allowed in wildfire hazard areas
subject to conformance with the following development standard.
A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may
limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire
defensible space considerations as follows (note: actual vegetation manipulation to meet these
conditions may not be necessary where the natural vegetation patterns have already fulfilled these
conditions):
A. Beyond the 15-foot area up to 65-feet down slope and 40-feet of the building cross slope and up
slope maintain natural and/or irrigated grass at less than 6-inches and thin existing trees and
brush into individual or clusters. Native brush should be thinned and clustered. Limbs within
clusters of oak should be pruned to one half the height of the tree or 10-feet whichever is less.
No brush or shrubs which when mature will be tall enough act as ladder fuel should be provided
or maintained around the oak.
B. Clusters of service berry, oak, bushes or shrubs should be separated from each other and from
those beyond the 65 and 40-foot areas by a distance of 2 V,, times the height of thee mature
vegetation. The diameter of a cluster should be limited to 2 %, times the height of the mature
vegetation. Plant material growing between trees and clusters of bushes or shrubs is grass
maintained at 6-inches or less.
C. Due to the steep slopes and dense vegetation along the driveway, Defensible space shall be
improved in this area.
D. All deadfall up to a one hundred (100) foot perimeter around the structure shall be removed.
E. No flammable mulches shall be placed within two (2) feet of a residence.
F. The property owner shall be responsible for the continued maintenance of the defensible space
vegetation requirements.
B. Access
A. Access roads and driveways shall be built to County standards; however, these standards may
be increased to mitigate wildfire hazards based on comments provided by the Colorado State
Forest Service, the Sheriffs Department, local fire protection districts and/or a person approved
by the County as an expert in wildfire area designation and mitigation.

a) When access to a public or private pressurized water system is not available or if it is necessary
to augment fire protection water systems, private ponds may be used if approved by the
Community Development Department and the local fire district.
b) Any fire department recommendation for individual structure water supply and storage shall be
accessible to fire department vehicles from the exterior of the structure through a fire
department approved mechanism (such as a fire hydrant). The Applicant shall have 20,000
gallons of water storage. This requirement can be mitigate with proof of the nearest hydrant
satisfactory to the Aspen Fire District.
c) All new development shall conform to the appropriate building Code(s) with regard to
sprinklering structures.
D. Roofing Materials, hoofing Vents and Projections At and Below Roof Line. Construction, of roofs and
projections at or below roof line in shall be constructed according to the following specifications:
a) Roofs shall be constructed with a Class A roof assembly as defined in the 2003 International
Building Code (IBC) Section 1505.2 Wood shake/shingle roof coverings are prohibited in all
wildfire hazard areas. Roofs with less than a 3:12 pitch are not permitted in wildfire areas unless
they comply with the following:
i. All roof coverings shall be listed for installation as a part of the Class A roof
assembly.
ii. All roof coverings shall have a surface that shall facilitate the natural process of
clearing the roof.
iii_ All roof designs shall facilitate the natural process of clearing the roof of debris.
Protrusions above the roof lure, such as parapets, shall be prohibited.
iv. Roofs shall be installed as required by the adopted building code and shall have a
minimum slope of 1:48.
v. All roof designs, coverings or equivalent assemblies shall be specifically approved
by the Fire Marshal prior to submittal of a building permit application.
vi. Vents shall be screened with corrosive resistant wire mesh, with mesh one -fourth -
inch ('!, ") maximum.
E. Building and Construction
a) No portion of the building(s) or addition(s) shall be constructed with unenclosed projections such as
decks. Eves shall be kept to a minimum on the down slope side and on the sides and should not
have ventilation openings unless the design and configuration of the openings are specifically
approved by Pitkin County. Projections may include, but are not limited to eaves; cornices; soffits;
roofs over open decks, cantilevered floors; bay windows; decks or balconies. Projections may cause
heat traps and should be protected as follows:
b) Any projection including guardrails shall be constructed with materials approved for one -hour fire -
resistive construction, any material underlain by 5/8" Type X gypboard or approved equal or Type
IV Heavy Timber materials per the currently adopted building code. Projections should have no
inside angles of less than seventy-five (75) degrees.
c) An alternative construction for projections will require the use of non-combustible building
materials or materials with a flame spread rating of less than twenty five (<25 tested to ASTM E84)
and listed for exterior use.
d) Areas below projections shall be void of vegetation or other combustible materials. The areas
below these projections shall be protected from accumulation of vegetative materials by placement
of a vegetative barrier covered with rocks or gravel or shall be concrete or stone. There shall be no
storage of combustible materials under projections. The walls under projections shall be
constructed of materials approved for one -hour fire -resistive construction on the exterior side of the
wall. Window openings in walls below projections shall be tempered glass. Doors shall be
noncombustible or one and three -fourths inch (1 3/4") solid wood.

F. Windows and Foundation:
a) Glazed openings shall be provided with closing, solid, exterior non-flammable shutters or shall
be tempered glass.
b) Siding and exterior wall construction shall have a minimum of one -hour fire -resistive rating
ground level to roof line, 5/8" gyphoard underlying combustible materials or cement stucco
with a minimum thickness of/4".
c) Exterior doors shall be noncombustible or one and three -fourths inch (1 3/,") sofid wood. If a
hardscape patio and masonry wall has been designed as a buffer, exterior doors having
tempered glass may be used if approved by the fire marshal.
d) Foundations, skirting and crawl -space openings shall be fully enclosed and constructed with
materials approved for one -hour fire -resistive construction on the exterior side of the walls and
shall extend from the top of grade to the underside of the floor decking or walls.
G. Maintenance:
a) Roofs and gutters shall be kept clear of debris.
b) Yards shall be kept clear of all litter, slash and flammable materials and debris.
c) All flammable materials shall be stored on a parallel contour a minimum of fifteen -feet (15')
from any structure.
d) Weeds and grass within the fifteen -foot (15') perimeter and under trees, bushes and brush shall
be maintained at a height of not more than six -inches (6").
H. Miscellaneous:
a) Firewoodhvoodpiles shall be stacked on a parallel contour a minimum of fifteen -feet (15') from
any structure.
b) Swimming pools shall be accessible to the Fire Department.
e) Fences shall be kept clear of brush and debris.
d) Wood fences shall not connect to structures.
e) Any outbuildings or additional structures shall adhere to the same standards described herein.
f) Each structure shall have a minimum of on one ten -pound (lo#) Class ABC fire extinguisher.
g) Addresses shall be clearly marked with two-inch (2")noncombustible letters and shall be
visible at the primary point of access from the public or common access road and installed on a
noncombustible post.
10. The Applicant shall comply with the following general conditions regarding wildlife:
A_ When existing native vegetation must be altered within the Activity Envelope, the
Applicant may be required to prepare a habitat mitigation plan acceptable to the County.
Such mitigation plan may substitute (in a nearby area on the subject property) vegetation
equal in type and quantity to that being removed to mitigate effects on wildlife species.
Should there be no opportunity on the property for habitat mitigation or restoration, off -site
mitigation benefiting the same species may be required, or financial mitigation may he paid
into a County habitat mitigation fund should such a fund be established in the future.
B. ]Manipulation of vegetation outside of the Activity Envelope is prohibited.
C. Mesh or woven wire fences are prohibited outside the Activity Envelope except hay
storage-
D. Wood tail fencing shall employ three (3) rails or less, be the round or split rail type, shall
not exceed fifty-four (54) inches in height above ground level, and twelve (12) inches in
width (top view), and shall have at least eighteen (18) inches between the lower two (2)
rails.
E. Wire fencing must be three (3) strands or less. The top wire should be a twelve -point -five
(12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The
middle strands (which may be barbed) should be located a minimum twelve (12) inches

apart and from the top wire preventing entanglement when mule deer jump over. The
bottom strand should be sixteen (16) inches from the ground.
F. Tall overly mature trees and standing dead trees (snags) should be retained at the rate of two
(2) to five (5) per acre whenever possible as nesting and perching habitat.
G. Fruit bearing trees and shrubs shall be prohibited within the Activity Envelope. This does
not include pre-existing native trees and shrubs.
H. Access shall be provided to the Colorado Division of Wildlife for trapping, tagging,
studying, or otherwise managing wildlife.
L Trash/garbage shall be kept in an approved bear resistant container or enclosure. These
containers shall be accessible to and use at all times by contractors on site.
J. Bird feeders, including hummingbird feeders, shall be hung away from any deck or
window, and be at least ten (10) feet from the ground suspended between two (2) trees or
posts. All seed feeders shall include a seed catchment pan to catch discarded seed.
K. Construction dogs are prohibited on site.
L. Tall trees shall not be planted next to the residence so that bears can climb to a 2Id floor.
11. Applicable road and employee housing impact fees must be paid at building permit.
12. No development shall occur outside the approved ac 'vity_envelope with the exception of vegetation
removal necessary to comply with the wi dfire mitigation measures described above. No structures
shall be permitted outside of the approved building envelope, Applicant shall be required to obtain an
Earthmoving Permit for any work outside the approved envelope.
13. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the
comers of the activity envelope and install construction fencing around the construction site within the
perimeter of the building envelope. The fencing shall remain in place until issuance of a Certificate of
Occupancy.
i 14. All areas disturbed by construction shall be re -vegetated with native shrubs and grasses within one
growing season of the project's completion.
15. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land
Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, §
2-20-170 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on June
-AWA 2011.
I & Failure to comply with the conditions of this approval may result in revocation of this approval, or any
subsequent permit(s) or approval(s) related to this property, or vested rights associated with this
property.

1) Topographic information by a Gamba & Associates, Inc. survey.
2) Initial percolation tests, performed on November 8th, 2005, were performed in the areas shown. The new Infiltrator Quick4 Trench system extends into a larger area, so
additional percolation tests are proposed for the un-tested area of the field.

4) Review of the site, and of the SACS soils information for this site indicate that the presence of any wetland, whether jurisdictional or otherwise, is highly
unlikey.
5) The profile hole excavated on this site revealed an area that had some water mottling of the soils. Upon examination of the information provided by Pitkin
County for the existing Onsite Wastewater Treatment System, it appears that the mottling observed was created by the existing absorption field, and not the
result of any groundwater.
6) Because of the extent of the proposed drwwell is beyond the area proposed in the original permit (#08046 of issued 03/09/08) an additional profile hole
shall be required to confirm that there are no confining layers present. If, in the opinion of the engineer of record, the soil exposed at the bottom of the
proposed drywell (1029.50±) is materially different in appearance or makeup than the soils in the original percolation test holes, an additional three percolation
test holes will be prepared. After the three additional percolation tests are performed, the design depth of gravel for the drywell may have to be adjusted.
Any confining layer (bedrock, water) found within the depth of the new profile hole will require an adjustment of the design to compensate.
