The Provision of Single Stream Recycling Transfer Services (the “Contract”) dated August 20,
2019 between the Board of County Commissioners of Pitkin County, Colorado (the “County”)
and Waste Management of Colorado, Inc. (the “Contractor”), is hereby amended as follows:
Description of Change:
1. Upon execution of this Change Order/Contract Amendment by the County and the
Contractor, the Contract is extended for the fourth of five (5) additional terms of one (1)
year, as authorized by Section I of the Contract. The new expiration date will be
8/31/2024.
2. Allocation of funding in the amount of $475,000.00 for the new extension term of the
Contract.

Expiration of the current extension term and allocation of funding for the new extension term.

Dear Ms. Hall:
It has been a pleasure serving Pitkin County. Waste Management (WM) sincerely values your patronage and looks forward to continuing our partnership. This letter services as WM’s request for Contract extension and notification of annual rate adjustments. Summary of Adjustments:
• Contract Extension – Per Section I Term of Contract: At the expiration of the initial term, the contract may be extended for five (5) additional terms of one (1) year by the express written consent of both parties. WM respectfully requests a one (1) year contract extension, September 1, 2023 – August 31, 2024.
• Rate Adjustments – Per Section II Contractor’s Obligations: Haul Cost will increase by a fixed 3.5% annually. Processing fee adjustment will be based on the average CPI for the twelve-month period preceding the anniversary. The CPI for Water and Sewer and Trash Collection Services for June reflects 5.1% and is attached for reference. Please let me share some additional information concerning the cost increases we are seeing in our industry, and their impact on our ability to provide our services. As you know, the US
economy has continued to experience adverse impacts caused by inflation driven primarily by the response to COVID-19, as well as labor market and supply chain constraints. For WM, disruptions in the supply chain for critical materials and equipment, labor shortages, and
significant increases in fuel costs have substantially increased WM's cost to provide services. The following are examples of some of our industry’s inflationary increase:
• Front-line labor costs – These costs comprise a substantial portion of WM’s overall costs and, at their peak, have nearly doubled since 2020. Economists are projecting continued
labor shortages posing upward pressure on labor costs. The Waste and Recycling Industry is experiencing the same increased commodity prices, supply constraints, and higher wages caused by labor shortages.
• Fuel Increases – The price of fuel for both diesel and Compressed Natural Gas (CNG) that WM uses in its vehicles to service our communities and customers has increased.
At peak, CNG increased more than 300% and Diesel WTI futures peaked up 99% since 2020.

• Recycling – Current pricing is volatile, and it is unknown when the markets will recover, creating significant uncertainty going into 2023. Economic pressures, both globally and in North America, are likely putting pressure on packaging manufacturers who have previously committed to increasing their recycled content usage.
Some additional inflationary examples affecting WM are:
• Resin/HDPE Increases – Carts to service our customers has increased over 50% vs. 2020
• Hot Rolled Coil Steel - The price of the steel WM needs for solid waste and recycling vehicles and containers increased more than 200% at its peak over 2020. The impacts of inflation on the providers of goods and services such as WM are exemplified by the Producer Price Index (PPI) and the Producer Price Index Trucking.
• The Producer Price Index (PPI) is a government economic report that measures the average change over time in selling prices received by domestic producers of goods and services.
• The Producer Price Index (PPI) measures inflation from the perspective of costs to industry or producers of products. Because it measures price changes before they reach consumers, the PPI can be an earlier predictor of inflation than the CPI, which is typically viewed as a lagging indicator.
• PPI and PPI Trucking are both leading indicators of the increased costs WM is experiencing to deliver services.
• As of May 2023, the Producer Price Index (PPI) has risen 26% since January 2021. The Producer Price Index Trucking rose nearly 31% at its peak in November 2022.
Due to these unforeseen and extraordinary market conditions, which the parties could not anticipate at the time the contract was executed, WM respectfully requests a Processing Fee extraordinary increase of $5.00 per ton to allow WM’s compensation to better keep pace with
WM’s operating costs to provide critical services in your community. Although many of WM’s contracts include annual price adjustment mechanisms, in most instances those mechanisms do not provide an adjustment to offset the inflationary pressures WM has absorbed over the
past years. For that reason, WM is respectfully requesting this immediate relief. Summary of Adjustments:

Getting paper or electronic copies
