HomeMy WebLinkAboutbocc.res.123.2003 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, DENYING A REQUEST TO AMEND THE SAWMILL HILL DEVELOPMENT PERMIT TO INSTALL OVERltEAD ELECTRIC UTILITY LINES AND APPROVING INSTALLATION OF UNDERGROUND ELECTRIC UTILITY LINES OUTSIDE OF THE ACCESS DRIVEWAY Resolution No./~,~-2003 RECITALS 1. Karl Hipp, et al ("Applicant") has aPplied to the Board of County Commissioners of Pitkin C. ounty, Colorado ("BOCC") to amend Resolution No. 116-2002 in order to allow electric utility lines to be placed in an overhead configuration rather than buried in the driveways or access road as required by the Resolution. 2. The property is located south of Redstone, above Cleveholm Manor (see Exhibit A). 3. The BOCC heard this application at regular meetings on January 8, 2003, August 13, 2003, and September 24, 2003, at which time evidence and testimony were presented with respect to the application. 4. The BOCC finds that the proposed amendment should be denied due to the significant off-site visual impacts and wildfire dangers associated with overhead utility lines. 5. The BOCC further finds that the East Creek alignment (as shown on Exhibit B) is' appropriate given the geologic concerns associated with undergroundifig the lines within the access road and the lack of an approved easement to extend the lines to the access road. NOW, THEREFORE, BE IT RESOLVED by the BOCC that it hereby denies the Sawmill Hill proposed amendment to a development permit to allow overhead utility lines. BE IT FURTItER RESOLVED by the BOCC that is hereby approves installation of electric utility lines underground along the East Creek aliga~ment, subject to the following conditions: 1. The conditions of Resolution No. 116-2002 shall remain in full force and effect, except as amended herein. 2. Condition No. 3E1 of Resolution No. 116-2002 shall be replaced with the following: Utility lines shall be placed underground along the East Creek alignment before dispersing to the various lots. The Community Development Department may allow overhead lines along the approv~l alignment, only if a determination is made that the environmental damage caused by undergrounding of the lines would be significantly greater than that caused by installing overhead lines. 3. An earthmoving permit(s) sball be obtained for undergrounding the electric utilities throughout the entire Sawmill Hill development. A drainage and erosion control plan shall be provided with the permit(s). 4. The earthmoving permit to underground the Utility line up the East Creek alignment shall include a revegetation plan to address the impacts of undergrounding and a remediation plan 10/21/2003 08:51~ Resolution No.] t~ -2003 Page 2 for the clearing done on the "East Creek" hill, which shall ensure that the area is returned over a reasonable period of time to its state prior to the disturbance in the fall of 2002. The revegetation/remediation plan shall be submitted to and approved by the County prior to issuance of the earthmoving permit. Implementation of the revegetation/remediation plan must be completed within 90 days of the installation of the utility line. Financial security in an appropriate amount determined by the Land M~agement Department will be required to insure completion and success of the revegetation/remediation.
