RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY COLORADO, APPOINTING MARK BERGMAN AS AN
INDEPENDENT REFEREE (HEARING OFFICER) TO SIT ON BEHALF OF
THE BOARD OF EQUALIZATION TO HEAR TAX PAYER’S APPEALS OF
THE PITKIN COUNTY ASSESSOR’S VALUATIONS
RESOLUTION NO. 058-2023
RECITALS:
WHEREAS, pursuant to Section 2.8.4 (Actions) of the Pitkin County Home Rule Charter
(“HRC”), all matters not required to be acted upon by ordinance or formal resolution may
be acted upon by informal resolution, and;
WHEREAS, pursuant to C.R.S. 39-8-101, the Board of County Commissioners (BOCC)
of Pitkin County shall comprise the Board of Equalization (BOE), and;
WHEREAS, the BOE is charged with the duty of assuring that the Assessor fairly and
equally applies appraisal procedures, and;
WHEREAS, the volume of appeals in 2023 will exceed the amount of time that the
BOCC has available to sit as the BOE, and;
WHEREAS, pursuant to C.R.S. 39-8-102(2)(i) the BOE has the authority to appoint
independent referees (hearing officers) who are experienced in property valuations to
conduct hearings, and on behalf of the BOE, make findings and submit recommendations
to the BOE for its final action, and;
WHEREAS, On June 14, 2023, the BOCC approved Resolution No. 035-2023 appointing
three hearing offers and a list of arbitrators, and;
WHEREAS, On July 12, 2023, because of the volume of appeals received from tax payers,
the BOCC extended the hearing time for appeals to the BOE to September 15, 2023, and;
WHEREAS, Due to the volume of appeals received or postmarked as of the deadline of
July 17, 2023 coupled with the fact that some of the current hearing officers are not able
to serve past certain dates until September 15th, the BOCC has determined that there is a
need for another hearing officer to hear appeals, and;
WHEREAS, The BOCC wishes to appoint Mark Bergman as a hearing officer to hear
appeals through September 15, 2023, and;
WHEREAS, the BOCC has considered the qualifications of Mark Bergman acting as a
hearing officer on behalf of the BOE and desire to appointment Mr. Bergman at this time,
and;
WHEREAS, The BOCC finds that it is in the best interests of the citizens of Pitkin

County to approve this Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Pitkin County, Colorado that it approves a resolution of the Board of County
Commissioners of Pitkin County Colorado, Appointing Mark Bergman as an Independent
Referee (hearing officer) to Sit on Behalf of the Board of Equalization to hear Tax
Payer’s Appeals of the Pitkin County Assessor’s Valuations and Authorizes the Chair to
Sign on Behalf of the County.
