COLORADO, DENYING AN EXTENSION OF VESTED REAL PROPERTY RIGHTS FOR
DAVID BORK & SUSAN MANCHEE

RECITALS
1. David Bork and Susan Manchee ("Applicant") have applied to the Pitkin County Board of County
Commissioners ("BOCC") to consider an Extension of Vested Real Property Rights pursuant to Section
4-140-30 of the Land Use Code ("Code").
2. The property is located off of West Sopris Creek Road, and is more specifically described as
Parcel 3, West Sopris Ranch.
2. The property is zoned RS-30/PUD and contains 35.14 acres.
3. The BOCC granted 1041 hazard review and general submission approval pursuant to Resolution
No. 95-179. The 1041 site plan was recorded in Plat Book 38 at Page 91. The BOCC subsequently
granted a reinstatement of the vested rights for parcel 3 and an amendment to the building envelope
pursuant to Resolution No. 192-2000. A revised site plan was recorded in Plat Book 66 at Page 22. The
current vested rights expire on September 27, 2003.
4. The BOCC heard this application at a duly noticed public hearing on September 24, 2003, at which
time evidence and testimony were presented with respect to this application, and adopted this Resolution at
a regularly scheduled meeting on October 22, 2003.
5. The BOCC finds that the proposed extension of vested rights does not provide any si~ificant
benefit to the County and is, therefore, inappropriate.
6. The BOCC further finds that Parcel 3 and Parcel 4 as presently configured are separately
developable. Pursuant to the County Land Use Code, development rights do not terminate by virtue of a
lapse of the vesting period; the current owner of these properties has not sought to evade County
regulations; and the properties herein referenced are in excess of 35 acres in size.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners
that it does hereby deny an Extension of Vested Property Rights for David Bork and Susan Manchee.
