SUMMARY: Yhe Applicant is requesting approval to rezone and subdivide a 10+ acre parcel to
accommodate 2 free market lots. 2 RO lots, 10 deed restricted affordable housing units on 6 lots_ two
open space parcels and a common area parcel that encompasses the existing barn.
The Applicant is proposing to amend the southern boundary of the parcel to add approximately 1.3 acres
from the tree nursery parcel to the subdivision parcel.
The BOCC approved ~he final plat application on first reading on November 19. 2003. The conditions of
approval have been amended to reflect the phased approval of the subdivision, as discussed on the 19th.

LOCATION: The property is located at 145 High Country Lane (aka Hoaglund Rm~ch Road); north of
Mountain West Trees, south and west of the Holland Hills Subdivision. as~d west of the Morrow property.
ZONING: The Applicant's parcel is zoned AFR- 10 and contains 10.3 acres.
RECOMMENDATION: Staffrecommends that the BOCC adopt a motion to approve the Hoaglund
Ranch (Booher) Subdivision 'PUD Final Plat on second reading, subject to the attached resolution.
RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY, COLORADO, APPROVING THE HOAGLUND RANCH (BOOHER)
SUBDIVISION/PUD FINAL PLAT (PHASE 1) AND LOT LINE ADJUSTMENT AND
DESIGNATING THE HOAGLUND RANCH TO THE PITKIN COUNTY HISTORIC
INVENTORY

RECITALS
1. Ed and Cherie Booher ("Applicaut") have applied to the Board of County Commissioners of Pitkin
County, Colorado ("BOCC") for Final Plat approval to subdivide a 10-¢ acre parcel to accommodate 2 free
market lots, 2 resident occupied lots, 10 deed restricted affordable housing units on 6 lots, two open space
parcels and a common area parcel that encompasses the existing barn.
2. The parcel is located at 145 High Country Lane (aka Hoaglund Rancb Road); north of Mountain
West Trees, south and west of the Holland Hills Subdivision, and west of the Morrow property, and is
more specifically described in Exhibit A.
3. The parcel is .zoned AHP/PUD and contains 10.3 acres.
4. The BOCC granted approval of the Subdivision/PUD Conceptual Submission, GMQS Exemption
and 1041 Hazard Review, pursuant to Resolmion No. 010-2000. The B OCC also approved the rezoning of
the parcel from AFR-10 to AHP/PUD, pursuant to Ordinance No. 007-2000 (contingent upon recordation of
the Final Plat). The AHP/PUD zone distric{ was created as a result of this application, pursuant to Ordinance
No. 004-2000.
5. The BOCC considered the application at a duly noticed public heating on November 19, 2003 and a
public meeting on December 3, 2003.
6. The BOCC finds that the application is consistent with the applicable provisions of the Land Use
Code, the criteria of the AHP/PUD zone district and the conditions of BOCC Resolution No. 010-2000.
7. The BOCC further finds that it is only appropriate at this time to approve Phase 1 of the
subdivision (Lots 6, 8, 9 and 10), since ~here is an existing, legal water supply for those lots, and that
approval of Phase 2 shall only occur after the Applicant has demonstrated an adequate water supply for
Lots 1-5 and 7.
8. The BOCC further finds that the historic resources are eligible for designation to the Pitkin
County Historic Inventory.
NOW, THEREFORE, BE IT RESOLVED by the BOC'C that it does herebY designate the
Hoaglund Ranch to the Pitkin County Historic Inventory.
BE IT FURTHER RESOLVED by the BOCC that it hereby approves the Hoaglund Ranch
(Booher) Subdivision/PUD Final Plat (Phase I) and Lot Line Adjustment, subject to compliance with the
following conditions, whicb shall run with the land and be binding on all successors in interest:
1. The Final Plat shall be delineated by photographic methods on reproducible naylar 24 inches by
36 inches in size and shall comply with the provisions of Section 5-40-020 of the Land Use Code.

The mylar copy of the site plan must be signed by the owners prior to submittal for recording. The
Final Plat shall be amended as follows:
Tile access point(s) and easements, if reqnired, from High Country Lane to Lots 3-I 1
shall be designated.
The plat shall differentiate between Phases 1 and 2, and include a note that only Phase 1
is approved at this time.
Prior to recordation of Phase I of the Final Plat, the Applicant shalh
A. Present proposed names for roads witliin the subdivision, if required, to the Community
Development Department to ensure the name is unique and does not duplicate all existing
road name in the Connty.
B. Submit the lot line adjustment plat to the Community Development Department for approval
and recordation. The signature block shall be changed from fl~e Community Development
Director to the BOCC.
C. Submit the amended Subdivision Improvements A~'eement, Protective Coveuants and
historic preservation Covenant for review and approval by the Community Development
Department and the County Attorney for form and compliance with the development
approval.
Submit the Master Deed Restriction for the 2 resident occupied and the 10 category
affordable housing units to the Housh~g Office for review, approval and si~maature. The
deed restrictions shall specify that existh~g tenants shall be given the right of first refusal to
purchase the unit where they reside.
Provide documentation to the Environmental Health Department to verify the adequacy
of the existing sewage disposal systems that serve the existing dwelling units on Lots 6,
8, 9 and 10. Any required upgrades to the systems shall occur prior to recordation of
Phase 1 of the Final Plat.
Submit a plan for improvements to the existing roads for review and approval by the
Basalt and Rural Fire Protection District and the County Engiueer.
Provide certification from the County Treasurer's office that all ad valorem taxes applicable
to the parcel have been paid for all prior years. '
Submit a PM10 mitigation plan to the Environmental Health Depamnent for review and
approval.
Concurrent with recordation of Phase 1 of the Final Plat, the Applicant shall:
A. Record the Improvements Agreement ahd Protective Coveuants.
B. Record the Master Deed Restriction.
C. Record a covenmlt in a form acceptable to the County Attorney in which the Applicant
agrees to maintain the historic structures.
Prior to deed restriction of the existing units, the Applicant shall comply With Part VII, Section 14 of
the 2003 Housing Guidelines to the satisfaction of the Housing Authority.
With the application for Phase 2 of the Final Plat, the Applicant shall:
A. Submit a detailed plan for sewage disposal for Lots 1-5 and 7 to the Environmental
Health Department. The plan shall also address ongoing maiuteuance and inspection of
all of the septic systems within the subdivision.
B. Contact CDOT to determine if new or revised Access Permit is required.

C. Provide evidence of an adequate water supply to the satisfaction of the County Attorney.

Prior to building permit application for any new units, the Applicant shall obtain all required
permits from local, state and federal agencies, including a Storm Water Management permits
(obtained through the CDPHE Water Quality Control Division).
The Subdivision Improvemeuts Agreement shall be amended as follows, prior to recordation:
A. Require an overall site Drainage and Erosion Control Plan and a detailed Construction
Management Plau, for review and approval by the County Engineer, prior to commencement
of any work.
B. Item #6 shall include road improvements required to satisfy the Basalt and Rural Fire
Protection District.
C. Item # i 6 shall include an additional provision that Certificates of Occupancy for the
remaining 5 category units should be issued prior to or concurrent with issuance of the
Certificate of Occupancy for the first free market unit.
D. Require a fixed water supply tbat satisfies the Basalt and Rural Fire Protection District.
E. Require revegetation of disturbed areas no later than one growing season after completion
of work.
8. The Protectiv~ Covenants shall be an*ended as follows, prior to recordation:
A. Subsection #4A shall be mnended to eliminate "except for rental."
B. Specify that no development can occur outside of the designated building envelopes, as
specified in condition #10 of Resolution No. 010-2000.
C. Define the uses that are allowed on the Common Parcel:
D. Include limitations on development below the ditch, as specified in condition #12 of
Resolution No. 010-2000.
E. Include the provisions specified in conditions #4 mxd #5 of Resolution 010-2000.
F. Add the wildfire mitigation provisions as specified in co3~dition #9 of Resolution No. 010-
2000, except subsection "C" shall be replaced with the following language:
Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in
the UBC ]997Section 1504. Wood shake/shingle roof coverings areprohibited Roofs with
less than a 3:12 pitch are not permitted unless they comply with the following:
(a) All roof coverings shall be noncombustible materials as defined in the Uniform Building
Code (UBC) 1997 Section 1504 and installed on a Class A roof assembly.
(b) All roof coverings shall have a surface that shall facilitate the natural process of
clearing the roof
(c) ,4ll roof designs shall facilitale the natural process of clearing roof debris. Protrusions
above the roofline, such aa'parapets, shall be prohibited
(d) Roofs shall be installed as required by UBC 1997 Chapter J5 and shall have a minimum
slope of 1:48.
(e) ,4ll roof designs, coverings,.or equivalent assemblies shall be specifically approved by
the Fire Marshal prior to submittal of a building permit application.
G. Include the height limitations as specified in condition #7 of Resolution No. 010-2000.
H. Include the floor area/square footage limitations, including the following:

1) Development within the Hoaglund Ranch Subdivision/PUD shall be limited to no
more than 30,000 square feet of floor area as calculated pursuant to the Lm~d Use
Code.
2) A maximum floor area shall be designated for the category and RO units, in
addition to the "net livable" and !'gross square footage" calculations referenced in
the Housing Guidelines.
3) Each of the two free market residences shall be limited to a maximum of 5,000
square feet of floor area.
4) Agricultural buildings within Open Space Parcel 1 shall count towards the total
allowable floor area for Lots 1 and 2.
5) Each of the two RO units shall be limited to a maximum of 2,200 gross square feet
per residence, plus a 500 square foot garage and an 800 square foot basement.
6) The 10 category unitg shall be limited to a total of 11,600 net livable square feet,
exclusive of garages, as calculated in the Housing Guidelines.
The Applicant shall adhere to all material representations made in the application or in public
meetings or hearings.

Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin CounW Lm~d Use
Code, § 4-140 and C.R.S. § 24-68-I05. The statutory vested rights granted herein shall ~xpire on
December 3, 2006.
