OF PITKIN COUNTY, COLORADO, AUTHOR/ZING EXECUTION
OF AN INTERGOVERNMENTAL AGREEMENT BETWEEN
PITKIN COUNTY AND THE TOWN OF SNOWMASS VILLAGE
FOR THE PITKIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT
TO MANAGE THE TOWN'S CONSUMER PROTECTION PROGRAM
RESOLUTION NO. 0q3 -2003
Recitals
WHEAREAS, the Governments are duly constituted governmental entities governed by Boards
or Councils elected by qualified electors of the County and Town mentioned above, all of which
are located in Colorado; and
WHEREAS, the Pitkin County Environmental Health Department agrees to manage all
responsibilities within the scope of the Consumer Protection Program for the Town of Snowmass
Village; and
WHEREAS, the Board and Council of the respective Goyemments are authorized to execute
this Agreement on behalf of the Governments; and
WHEREAS, the Governments have determined it is in the best interests of the citizens of Pitkin
County and citizens of the Town of Snowmass Village to enter into this Agreement; and
WHEREAS, the Board and Council of the respective Governments authorize the Agreement to
be renewed annually after an administrative review and revision of the Scope of Work for
eligible services and amount of compensation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Pitkin County, Colorado, that it does hereby authorize the Chair to execute the attached
Intergovernmental Agreement (Exhibit A).

A RESOLUTION AUTHORIZING
INTERGOVERNMENTAL AGREEMENT
PROVISION OF SERVICES BY THE
DEPARTMENT.
THE ENTRANCE INTO AN

COUNTY ENVIRONMENTAL HEALTH
WHEREAS, the Town does not have an Environmental Health Department or a
department to administer Consumer Protection Program to provide for the inspection of
food service establishments and childcare facilities for compliance with State
regulations, follow-up inspections, enforcement actions, plan review for new
establishments and those proposing a remodel, meat sampling, complaint response,
and food borne illness investigations; and
WHEREAS, the Town Manager has determined that a contract with Pitkin County
fosters efficiency in government and fiscal responsibility; and
WHEREAS, the Town Council desires to approve and accept the proposal of
Pitkin County to administer a Town Consumer Protection Program; and
WHEREAS, the Town Council finds that the adoption of this Resolution is
necessary for the immediate preservation of the public health, safety and welfare.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of
Snowmass Village, Colorado:
1. A roval of Pro osal. The proposal of Pitkin County to administer a Town
Consumer Protection Program, in the form of the Intergovernmental Agreement
attached hereto as Exhibit "A" and incorporated herein by this reference, is hereby
approved and accepted.
2. Direction to Town Manaqer. The Town Manager is hereby authorized and
directed to execute the Intergovernmental Agreement and administer the services to be
provided by Pitkin County.
3. Severability. If any provision of this Resolution or application hereof to any
person or circumstance is held inValid, the invalidity shall not affect any other provision
or application of this Resolution which can be given effect without the invalid provision
or application, and, to this end, the provisions of this Resolution are severable.
