RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS (“BOCC”) OF
PITKIN COUNTY, COLORADO, AUTHORIZING TASTINGS ON THE
LICENSED PREMISES OF RETAIL LIQUOR STORES, LIQUOR LICENSED
DRUGSTORES, AND FERMENTED MALT BEVERAGE AND WINE RETAILERS
RESOLUTION NO. 042-2024
RECITALS
WHEREAS, Pursuant to Section 2.8.4 (Actions) of the Pitkin County Home Rule Charter
(“HRC”), all matters not required to be acted upon by ordinance or formal resolution may
be acted upon by informal resolution, and;
WHEREAS, pursuant to C.R.S. 44-3-301 the State of Colorado has granted to the BOCC
for each County in Colorado the authority to authorize by ordinance or resolution the
practice of tastings at retail liquor stores, liquor licensed drugstores, and fermented malt
beverage and wine retailers within its jurisdiction;
WHEREAS, pursuant to C.R.S. 44-4-107 (7), a fermented malt beverage and wine retailer
may allow tastings of fermented malt beverages or wine to be conducted on the licensed
premises if the licensee has received authorization to conduct tastings pursuant to section
44-3-301;
WHEREAS, "Tastings" means the sampling of malt, vinous, or spiritous liquors that may
occur on the premises of a retail liquor store licensee or liquor-licensed drugstore licensee
by adult patrons of the licensee pursuant to the provisions of section 44-3-301 (10);
WHEREAS, the BOCC has determined that there is a desire for tastings in Pitkin County
and that it is in the best interest of the public health, safety, and welfare to adopt regulations
and procedures for the conduct of tastings by a retail liquor store or liquor-licensed
drugstore;
WHEREAS, the BOCC has adopted the limits of C.R.S. 44-3-301 and allows tastings
pursuant to said statue; and
WHEREAS, The BOCC finds that it is in the best interests of the citizens of Pitkin County
to approve this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Pitkin County, Colorado that it hereby adopts a resolution authorizing tastings at retail
liquor stores, liquor licensed drugstores, and fermented malt beverage and wine retailers
and authorizes the Chair to sign the Resolution and upon the satisfaction of the County
Attorney as to form, execute any other associated documents necessary to complete this
matter.
