PITKIN COUNTY, COLORADO, AFFIRMING SUPPORT FOR CERTAIN STATE
AND LOCAL GENERAL ELECTION BALLOT QUESTIONS THAT ARE
CONSTITUTIONAL AND STATUTORY AS PRESENTED ON THE 2024
GENERAL ELECTION BALLOT
RESOLUTION NO. 097-2024
RECITALS
WHEREAS, Pursuant to Section 2.8.4 (Actions) of the Pitkin County Home Rule Charter
(“HRC”), all matters not required to be acted upon by ordinance or formal resolution may
be acted upon by informal resolution; and
WHEREAS, The Board of County Commissioners wish to affirm their collective support
for both State and Local ballot questions; and
WHEREAS, The Board of Commissioners affirm their support for Amendment J removing
the ban on same-sex marriage; and
WHEREAS, The Board of Commissioners affirm their support for Amendment 79
recognizing the right to abortion, and, in connections therewith, prohibiting the state and
local governments for denying, impeding, or discriminating against the exercise of that
right, allowing abortion to be a covered service under the health insurance plans for
Colorado state and local governmental insurance programs; and
WHEREAS, The Board of Commissioners affirm their support for Proposition JJ, without
raising taxes, allowing the state to keep and spend all sports betting tax revenue above
voter-approved limits to fund water conservation and protection projects instead of
refunding revenue to casinos; and
WHEREAS, The Board of Commissioners affirm their support for Proposition KK,
increasing taxes $39,000,000 annually to fund mental health services including for military
veterans and at-risk youth, school safety and gun violence prevention and support services
for victims of domestic violence and other violent crimes by authorizing a tax on gun
dealers, gun manufacturers, and ammunition vendors at the rate of 6.5% of the net taxable
sales from the retail sale of any gun, gun precursor part, or ammunition, with the state
keeping and spending all of the new tax revenue as a voter-approved revenue change; and
WHEREAS, The Board of Commissioners affirm their support for City of Aspen Ballot
Question 2A, allowing the City of Aspen’s existing 1.0% real estate transfer tax, which is
scheduled to expire on December 31, 2040, be extended through December 31, 2060; and
allowing the revenues and the earnings be a voter-approved revenue change that the city
may collect, retain and expend without limitation under Article X, Section 20 of the
Colorado Constitution (TABOR) or any other law; and
WHEREAS, The Board of Commissioners affirm their support for City of Aspen Ballot
Question 2B allowing the City of Aspen’s existing 0.45% sales tax for affordable housing
and day care, which is scheduled to expire on December 31, 2040, be extended through
December 31, 2060; and the revenues be collected, retained and spent as a voter-approved
revenue change without limitation under Article X, Section 20 of the Colorado Constitution
(TABOR) or any other law; and

WHEREAS, The Board of Commissioners affirm their support for City of Aspen Ballot
Question 2C which without imposing any new tax, allow the City of Aspen to amend its
Municipal Code to recategorize the taxes currently imposed on automotive vehicles sold,
registered and used in the City, currently 2.4%, to be a use tax on the same transactions, and
imposed at a lower rate of 2.1%. The revenues of such use tax could be used by the City for
the maintenance of roads and bridges and other transit related infrastructure. If the ballot
question is not approved, the City shall continue to impose its existing sales tax on
automotive vehicles at the existing sales tax rate; and would be authorized to collect, keep
and spend the revenues from such tax and any investment income therefrom
notwithstanding the limits of Article X, Section 20 of the Colorado Constitution; and
WHEREAS, The Board of Commissioners affirm their support for Town of Snowmass
Village Ballot Question 2D, without increasing taxes, be authorized to take actions
necessary to construct a new workforce housing project consisting of up to 79 units
containing 188 bedrooms, located uphill of and adjacent to Town Hall in the area known as
the Draw Site, at an estimated projected cost of up to $86 million, to be paid for by the
tourism tax revenues authorized for workforce housing purposes, rental income, potential
grant funds and/or private contributions; and
WHEREAS, The BOCC finds that it is in the best interests of the citizens of Pitkin County
to approve this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Pitkin County, Colorado that it hereby adopts a Resolution Affirming Support for Certain
State and Local General Election Ballot Questions Measures that are Constitutional and
Statutory on the 2024 General Election Ballot and authorizes the Chair to sign the
Resolution and upon the satisfaction of the Interim County Attorney as to form, execute any
other associated documents necessary to complete this matter.
