Contractor’s Obligations. Contractor shall complete the analysis and reporting services listed in the attached Proposal (“Attachment A”) to assess and report on the transition to a Growth Management Quota System (“GMQS”) as part of the Community Growth Committee Recommendations Project. This includes: Task 204: Technical Analysis Task 304: Phase 3 Relationship Analysis Task 404: Phase 4 Scenario Refinement Task 504: Phase 5 Recommendations Report 2. Compensation and Expenses, Invoicing, Payment and Offset. The County shall compensate Contractor for its services in accordance with the Project Budget and Schedule set out in Paragraph 1 of this Task Order. It is expressly understood and agreed that in no event will the total compensation and reimbursement to be paid hereunder exceed the sum of Sixty-One Thousand Five Hundred Fifteen dollars and Zero cents ($61,515.00) for all services rendered. By Task Order or Task Order Amendment, the County and Contractor may reallocate the budget among project tasks if the total budget amount remains unchanged. Contractor shall invoice for the project monthly based on hours worked, with payment expected within thirty Master Service Agreement #: 163.23 Rev: 2018-10-10 btf 2 (30) days of invoice, but any payment by the County may be offset by any amount the Contractor owes the County for any reason. Based on our conversation with you on 4/18/2024 we understand that the following services under Phase 2, 3, 4, and 5, require approval under a task order request in order for the project team to meaningful move forward with next steps: The project milestones for every task are outlined in the Data Framework: ●case studies + staff workshop ●relationship analysis + focus group ●scenario modeling + focus group + staff workshop Task 204 Technical Analysis – GMQS Analysis and Case Study Review ($15,960) Purpose:Review historical data from 2010 to present in order to determine trends in Pitkin County over time and review recommended changes from the CGAC to the overall Growth Management Quota System (GMQS) including how square footage allotments are made and what types of development are subject to GMQS. GMQS is foundational to all of the County’s existing land use regulations, and findings from the CGAC indicate that the current system does not need an overhaul but should be revised to better achieve the County’s goals. Currently, the GMQS competition is for (1) new lots/parcels and (2) additional floor area. More specifically, the CGAC highlighted keeping the GMQS competition as a tool for pacing new subdivisions/development but exploring the option to remove the competition for additional floor area. The CGAC also identified that the current system is underutilized due to the relative certainty and faster process offered by Transferable Development Rights (TDRs). The County is also interested in understanding how peer communities use growth management quota systems or other programs to manage growth, with a focus on regional, national, and global examples that are relevant to Pitkin County’s rural area profile and residential economy. The case study approach will enable the team to understand how GMQS tools are utilized in other relevant communities. Focus groups and staff would be engaged at this step to review the findings and discuss potential relevance for Pitkin County (Focus Groups are included in Task Order B-1-A , Community Engagement). Teaming:Design Workshop, Alan Richman and White & Smith will lead this analysis, with GBSM providing support through the Data Team. Coordination with Pitkin County Community Development Staff to provide input to this research process, as outlined in the scope below. Scope:Design Workshop will lead team research on GMQS focusing on the possibility of maintaining the current quota while revising scoring and competition to reflect the current goals and values of Pitkin County Attachment A Vision 2050.Additional considerations will be given to innovative growth management policies,encouraging reductions in development impacts,and the potential for a tiering system that relates to square footage where applications of growth management apply beyond the typical use of an urban growth boundary and which may consider factors such as size,amenities and environmental impacts. Tasks: A.Utilize existing available information and data from Pitkin County to research the GMQS program and its associated exemptions,looking at all allocation types,including demolition permits,to determine a baseline. B.Review of up to six total case studies.Specific Communities /Case Study locations to be approved by Pitkin County prior to report drafting. C.This research will include meetings with Pitkin County Community Development staff to inform the research. D.Continued coordination outside of PMT meetings via phone or email including engagement with Pitkin County's Data Team as needed. E.Analysis of GMQS-related recommendations in the CGAC Recommendations report,including but not limited to:allowable floor area and square footage cap,tiering system,square footage quota system (SFQS),CDU exemptions from GMQS/SFQS/square footage cap,etc. F.Summary of State legislative landscape for quotas. Deliverables: A.Kick-off meeting with County staff –Design Workshop,Alan Richman Planning,and White &Smith anticipated to be in attendance. B.Up to two (2)30-minute coordination meetings with County staff. C.Up to three (3)30-minute research meetings with County staff. D.Design Workshop will assemble a report describing findings including an executive summary,tables and graphics (up to 5 anticipated,if needed).Report should provide adequate information to feed into the Pitkin County Vision 2050 Data Framework,as needed,and will include summaries on case studies.This will be delivered in Microsoft Word (Google Document preferred)for one round of review with County Staff.Anticipated to be 5-10 pages in length. E.Final report with tables /graphics to be provided in PDF format. F.Presentation slides formatted using Google Slides for use in public and BOCC /Planning Commission presentations.Up to ten (10)slides are anticipated. Task 304 Phase 3 Relationship Analysis -GMQS Analysis ($19,190) Purpose:Identify a narrow range of options for updates to the GMQS program inclusive of growth-related CGAC Recommendations including potential tiering,to establish an understanding of the interplay between levers and alignment with community values. Teaming:Design Workshop,Alan Richman,and White &Smith will lead this analysis,with GBSM providing support through the Data Team.Coordination with Pitkin County Community Development Staff to provide input to this research process,as outlined in the scope below. Scope:Utilize existing information and data available from Pitkin County to develop options for updates to the GMQS program based on the baseline identified in Task 204.This will enable the team to explore the potential impacts of proposed changes. Tasks: A.Based upon findings in Task 204,Design Workshop,Alan Richman Planning,and White &Smith,will develop a suite of options for GMQS updates with comparison to existing conditions.Conceptual options to be approved by Pitkin County prior to full development. a.Research questions to address: i.What would a new GMQS or SFQS program look like that incorporates the recommendations from the CGAC Report (p.20-22)? ii.How can tiering help inform updates to the program that help to achieve the County’s goals? iii.What are the (unintended)consequences of these changes? B.Design Workshop,Alan Richman,and White &Smith will document the relationship of the GMQS update options to the County values. a.What are the community benefits/GHG outcomes projected from these recommendations?How can program adjustments support community values? b.Describe how the methods relate to other recommended land use/building code tools,how it achieves Pitkin County’s goals and objectives,and any unintended consequences of the GMQS update options. C.This research will include meetings with Pitkin County Community Development staff to inform the research. D.Continued coordination outside of PMT meetings via phone or email including engagement with County staff members (to be identified by the County PMT). E.Focus group to review work in this phase prior to finalization.(Fee for the Focus group is covered in different Task Order) Deliverables: A.Up to two (2)30-minute coordination meetings with County staff –Design Workshop,Alan Richman Planning,and White &Smith anticipated to be in attendance. B.Up to three (3)30-minute research meetings with County staff –Design Workshop,Alan Richman Planning,and White &Smith anticipated to be in attendance. C.Design Workshop will provide a report describing GMQS update options including an executive summary,tables and graphics (up to 5 anticipated,if needed),including values analysis and identification of any unintended consequences.Report should provide adequate information to feed into the Data Framework,as needed.This will be delivered in Microsoft Word (Google Document preferred)for one round of review with County Staff and Focus Group.Anticipated to be 15-20 pages in length. D.Design Workshop will provide a final report in PDF format. Task 404 Phase 4 Scenario Refinement -GMQS ($8,730) Purpose:In tandem with other options from all the various CGAC recommendations,identify the merits of the proposed GMQS policy changes within the context of scenarios. Teaming:Design Workshop will lead this analysis,with support from Alan Richman and GBSM for QM reviews. Pitkin County Community Development Staff to provide input to this research process,as outlined in the scope below. Scope:Based on the options established in Tasks 304,this phase “test-drives”the GMQS options together with other CGAC recommendations.The intent is to determine how these tools may achieve Pitkin County's goals and objectives established in the CGAC Final Recommendations Report by testing the options in tandem with other “levers”from the CGAC report,as described below. A.Scenarios will be refined through focus group discussion and other engagement tools,as identified in the Community Engagement Plan (Included in a different Task Order). B.Continued coordination outside of PMT meetings via phone or email.Including engagement with Pitkin County's Data Team as needed,anticipate up to (2)coordination check-ins. C.Anticipate two (2)Staff Workshops (included in a different Task Order).This research will include meetings with Pitkin County Community Development staff to inform the research. D.Continued coordination outside of PMT meetings via phone or email including engagement with Pitkin County's Data Team as needed. Deliverables: A.Up to two (2)30-minute coordination meetings with County Data Team staff –Design Workshop,Alan Richman Planning and GBSM anticipated to be in attendance. C.Identification of preferred scenario,to be documented in Task 504. Task 504 Phase 5 Recommendations Report -GMQS ($17,635) Purpose:This work will document the preferred scenario from Task 404 in a compiled Recommendations Report (inclusive of all the other technical recommendations)that provides granular detail about the intent and content of Code Amendments that will be drafted in subsequent phases. Teaming:Design Workshop will lead this effort,with support from Alan Richman Planning,White &Smith,and GBSM for QM reviews.Pitkin County Community Development Staff to provide input to this research process, as outlined in the scope below. Scope:Provide detailed information describing the preferred scenario in an effort to streamline Land Use Code Amendment drafting. A.Summary of preferred GMQS update options and implementation analysis.Document will be delivered in Microsoft Word for one round of review with County Staff.Anticipated to be 5-10 pages in length. a.The summary will include details from the CGAC report in order to thread recommendations through the work completed as part of this scope and address outstanding questions from the CGAC,where possible. b.The summary will also include a written recommended implementation framework,including consideration of how an applicant would submit required documentation and how the County would review and confirm compliance. c.The summary will also include considerations for monitoring levers for GMQS. d.The summary will define indicators that evaluate the success of the new program in preserving the backcountry. e.The summary will include a cursory review of how the proposed code amendments would create additional non-conformities in the County and initial discussion of how that may be addressed,with the recognition that a larger non-conformity study is anticipated as a separate task order. B.This research will include meetings with Pitkin County Community Development staff to inform the research. C.Continued coordination outside of PMT meetings via phone or email including engagement with Pitkin County's Data Team as needed. Deliverables: A.In the context of a compiled report with other technical recommendations,Design Workshop will document the preferred GMQS update options including an executive summary,tables and graphics (up to 5 anticipated,if needed),including values analysis and identification of any unintended consequences.Report should provide adequate information to feed into the Data Framework,as needed.This will be delivered in Microsoft Word (Google Document preferred)for one round of review with County Staff.Anticipated to be 5-10 pages in length.
