RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS (“BOCC”) OF PITKIN COUNTY, COLORADO APPROVING A THIRD AMENDMENT TO A CONTRACT WITH THE COLORADO DEPARTMENT OF HUMAN SERVICES, BEHAVIORAL HEALTH ADMINISTRATION, PROVIDING FUNDING
FOR JAIL-BASED BEHAVIORAL SERVICES
RESOLUTION NO. 106-2024 RECITALS WHEREAS, Pursuant to Section 2.8.3 (Actions) of the Pitkin County Home Rule Charter (“HRC”) official action by formal resolution shall be required for all actions of the Board not requiring ordinance power on matters of significant importance affecting citizens, and;
RECITALS
WHEREAS, Pursuant to Section 2.8.3 (Actions) of the Pitkin County Home Rule Charter
(“HRC”) official action by formal resolution shall be required for all actions of the Board not requiring ordinance power on matters of significant importance affecting citizens, and; WHEREAS, The Colorado Department of Human Services, Behavioral Health
Administration through funds authorized by the Colorado General Assembly (SB 12-163),
intends to continue funding the Jail Based Behavioral Health Services Program (“JBBS”), and; WHEREAS, The goal of the (JBBS) program is to support County Sheriffs in providing
screening, assessment and treatment for offenders (over the age of 18 years) with substance
use disorders (SUD) and co-occurring substance use and mental health disorders, as well as transition case management services, and; WHEREAS, On May 25, 2022, the BOCC adopted Resolution No. 033-2022 approving a
contract with the Colorado Department of Human Services, Office of Behavioral health,
Providing funding for Jail Based Behavioral Services in the amount of $198,850.00 for the use and benefit of the Pitkin County Sheriff’s Department, and; WHEREAS, on June 14, 2023, the BOCC adopted Resolution No. 039-2023 approving
Amendment No. 1 to a contract with the Colorado Department of Human Services, Office
of Behavioral Health, providing funding for Jail Based Behavioral Services in the amount of 206,350.00, and; WHEEAS, on May 8, 2024, the BOCC adopted Resolution No. 027-2024 approving
Amendment No. 2 to a contract with the Colorado Department of Human Services, Office
of Behavioral Health, providing funding of Jail Based Behavioral Services in the amount of $175,000, and; WHEREAS, the Department of Human Services has awarded an additional 100% grant to
Pitkin County with specific conditions contained in the Amended Contract No. 3 attached
hereto as Exhibit A, which increases the FY25 Budget by $7,500 for Substance Use Disorder Treatment funds resulting in a new FY25 Budget of $182,500.00 for the year 2025, and;

WHEREAS, The BOCC finds that it is in the best interests of the citizens of Pitkin County to approve this Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado that it hereby adopts a Resolution Approving a Third Amendment
to a Contract with the Colorado Department of Human Services, Behavioral Health Administration, Providing Funding for Jail-Based Behavioral Services and authorizes the Chair to sign the Resolution and upon the satisfaction of the County Attorney as to form, execute any other associated documents necessary to complete this matter.

1. PARTIES
This Amendment (the “Amendment”) to the Original Contract shown on the Signature and Cover Page for this Amendment (the “Contract”) is entered into by and between the Contractor, and the State.
2. TERMINOLOGY
Except as specifically modified by this Amendment, all terms used in this Amendment that are
defined in the Contract shall be construed and interpreted in accordance with the Contract.
3. AMENDMENT EFFECTIVE DATE AND TERM
A. Amendment Effective Date
This Amendment shall not be valid or enforceable until the Amendment Effective Date shown on the Signature and Cover Page for this Amendment. The State shall not be bound
by any provision of this Amendment before that Amendment Effective Date, and shall have no obligation to pay Contractor for any Work performed or expense incurred under this Amendment either before or after of the Amendment term shown in §3.B of this Amendment.
B. Amendment Term
The Parties’ respective performances under this Amendment and the changes to the Contract
contained herein shall commence on the Amendment Effective Date shown on the Signature and Cover Page for this Amendment and shall terminate on the termination of the Contract.
4. PURPOSE
In accordance with the provisions of this Contract and its exhibits and attachments, the Contractor shall provide substance abuse and mental health treatment in the Pitkin
County jail. The purpose of this amendment is to update and replace the following exhibit with the most current version for Fiscal Year 2025: the Exhibit B-3, Budget.
This amendment increases the FY25 Budget by $7,500 for Substance Use Disorder Treatment funds resulting in a new FY25 Budget of $182,500.00.
5. MODIFICATIONS
The Contract and all prior amendments thereto, if any, are modified as follows:
A. The Contract Maximum Amount table on the Contract’s Signature and Cover Page is hereby deleted and replaced with the Current Contract Maximum Amount table shown on the Signature and Cover Page for this Amendment.
B. REPLACE Exhibit B-3, Budget, with Exhibit B-4, Budget, attached and incorporated by
reference.
6. LIMITS OF EFFECT AND ORDER OF PRECEDENCE
This Amendment is incorporated by reference into the Contract, and the Contract and all prior amendments or other modifications to the Contract, if any, remain in full force and effect except as specifically modified in this Amendment. Except for the Special Provisions contained in the

Contract, in the event of any conflict, inconsistency, variance, or contradiction between the
provisions of this Amendment and any of the provisions of the Contract or any prior modification to the Contract, the provisions of this Amendment shall in all respects supersede, govern, and control. The provisions of this Amendment shall only supersede, govern, and control over the Special Provisions contained in the Contract to the extent that this Amendment specifically modifies those Special Provisions.
