AUTHORITY DENYING THE JEFFREY D MOHSENIN AND MARY ELIZABETH
DIOHSENIN SHORT TERM RENTAL LICENSE
Short-term Rental Licensing Authority Decision No. 003-2024
RECITALS
1. Jeffrey D Mohsenin and Mary Elizabeth Mohsenin ("Applicants") have applied to the Short-term
Rental Licensing Authority ("Licensing Authority") for a Short Term Rental ("STR") License,
pursuant to the Pitkin County Code Title 6, Short Term Rental Code Section 6.50.050 ("Code") to
utilize their caretaker dwelling unit ("CDU") for short-term rental activity.
2. The property is located on 35 Stark Mesa Road and is legally described as Lot 2 of the Stark Mesa
Subdivision. The property is approximately 5.37 acres in size and zoned Resource-30 Acre ("RS-
30"). The parcel identification number is 246314101002.
3. The Licensing Authority finds that the Application does not comply with the Code Section
6.50.053(11). Licenses are not available for employee, affordable or other managed or covenant
restricted housing. Administrative Decision No. 33-2005 (Reception No. 508793) approved the CDU
and the Occupancy Deed Restriction and Agreement is recorded at Reception No. 515576.
THE LICENSING AUTHORITY DOES HEREBY DENY the Molisenin Short-term Rental
application for the reason set forth above. The Applicant may appeal the decision of the Licensing
Authority pursuant to Pitkin County Code, Title 6, Section 6.50.051.
DENIED on the 6th day of December, 2024.
