RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS (“BOCC”) OF
PITKIN COUNTY, COLORADO APPROVING, AN INTERGOVERMENTAL
AGREEMENT BETWEEN THE BOARD OF COUNTY COMMISSIONERS ON
BEHALF OF PITKIN COUNTY HUMAN SERVICES WITH GARFIELD
COUNTY HUMAN SERVICES FOR CHILD SUPPORT SERVICES.
RESOLUTION NO. 118-2024
RECITALS
WHEREAS, Pursuant to Section 2.8.3 (Actions) of the Pitkin County Home Rule Charter
(“HRC”) official action by formal resolution shall be required for all actions of the Board
not requiring ordinance power on matters of significant importance affecting citizens, and;
WHEREAS, Pursuant to Title 29, Article 1, part 2, Colorado Revised Statutes, as amended
(the “Intergovernmental Relations Statutes”) and Article XIV, Section 18 of the Colorado
Constitution, governments may contract with one another to provide any function, service or
facility lawfully authorized to each of the contracting units and any such contract may provide
for the joint exercise of the function, service or facility, including the establishment of a
separate legal entity to do so, and;
WHEREAS, The Board of County Commissioners (“BOCC”) on behalf of the Pitkin
County Health and Human Services desire to enter into contract with Garfield County to
provide Child Support Services; and
WHEREAS, Both Pitkin County and Garfield County are governments authorized to
enter into agreements pursuant to C.R.S. § 29-1-203 for purposes including the
provision of any function, service, or facility lawfully authorized to each; and
WHEREAS, Under Part D of Title IV of the Social Security Act and the related
administrative requirements (“IV-D”), Pitkin County has been delegated responsibility for the
development and implementation of a program to secure support and establish paternity for
any person(s) eligible for IV-D services within the meaning of federal regulations; and
WHEREAS, Pitkin County desires to enter into an agreement with Garfield County to assist
Pitkin County in providing the services necessary to establish paternity, establish support
obligations, and secure support for any person(s) eligible for IV-D services within the
meaning of federal regulations; and
WHEREAS, Performance goals are established by the State, including: paternity
percentage; percent of current support paid; percent of IV-D cases paying on arrears; and
medical support and percent of IC-D cases with support orders; and
WHEREAS, It is specifically understood that Contractor uses the services of the Garfield
County Attorney’s Office to represent the People of the State of Colorado/ the Contractor in

paternity and child support enforcement judicial cases, the parties understand and agree that
the Department will also be represented by the Garfield County Attorney’s Office under the
terms of this agreement; and
WHEREAS, Pitkin County budgets $25,000.00 to cover the cost of child support services,
which is covered through human services allocations in the Colorado Department of Human
Services; and
WHEREAS, The BOCC finds that it is in the best interests of the citizens of Pitkin County
to enter into this agreement with Garfield County in order to ensure the health and welfare
of its citizens.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin
County, Colorado, approves a Resolution and authorizes the Chair to sign, an
Intergovernmental Agreement between the Board of County Commissioners on behalf of
Pitkin County Human Services, with Garfield County Human Services for Child Support
Services as attached hereto as Exhibit A in substantially the same form satisfactory to the
County Attorney, and authorizes the Chair or designee, to sign the resolution and the
agreement on behalf of Pitkin County.
