COLORADO, APPROVING A 1999 SUPPLEMENTAL BUDGET EXPENSE ITEM FROM
THE PITKIN COUNTY 1/2 CENT TRANSIT SALES AND USE TAX FUND

RECITALS
1. The Aspen City Council, the Pitkin County Board of County Commissioners and
the Town Council of Snowmass Village (the "Parties") have previously identified general elements
of their Comprehensive Valley Transportation Plan (the "Plan") which are eligible for funding from
the Pitkin County one-half cent transit sales and use tax.
2. By intergovernmental agreement dated September 14, 1993, the Parties agreed:
a. to conduct regular public meetings to continue to refine and agree upon
proposed projects and transportation elements consistent with or complimentary to
the Plan; and
b. that all expenditures and projects to be funded from the County -wide one-
half cent transit sales and use tax shall be agreed upon by the Parties and evidenced
by a resolution adopted by the governing body of each party.
3. In November of 1993 Pitkin County voters authorized the issuance of up to
$13,650,000 of revenue bonds for the purpose of improving the public mass transportation system
in the Roaring Fork Valley (the "Revenue Bond Authorization") if such improvements are
authorized by agreement between the Parties.
4. At a public meeting held on August 10, 1999, the Parties considered and approved
supplemental funding in an amount not to exceed $40,000 for additional RFTA backup service as
needed for construction mitigation to help keep buses on schedule from the midpoint to the end of
their routes.
5. Pursuant to voter approval the use tax had to be used first for the acquisition of the
rail right-of-way and then for other transit projects.
6. The Parties desire to approrGe the attached 1999 supplemental budget item with the
understanding that upon the successful acquisition of the rail right-of-way in 1997, the one-half cent
use tax revenues became available for other transit projects on an equal footing with projects
funded by the one-half cent sales tax revenues.
7. By adoption of this resolution Pitkin County wishes to ratify the approvals given at
the August 10, 1999 meeting.
NOW THEREFORE BE IT RESOLVED by the Board of County Commissioners of Pitkin
County, Colorado, that the following 1999 one-half cent transit sales and use tax expenditure
budget item is hereby approved.
