RESOLUTION OF THE PITKIN COUNTY, COLORADO
BOARD OF ADJUSTMENT
GRANTING A MAJOR ROAD SETBACK VARIANCE AND SIDE YARD SETBACK
VARIANCE TO LOT 1, BLOCK 4, KNOLLWOOD SUBDIVISION
Resolution No. 08-2014
WHEREAS, River Rock Corp, owner of42302 East Highway 82, Aspen, is requesting a 35 foot
Major Road Setback Variance where 100 feet is required from the Highway 82 right-of-way, and a
5 foot East Side Yard Setback variance where 15 feet is rewired for the construction of a new
residence; and
WHEREAS, the parcel is described as Lot 1, Block 4, Knollwood Subdivision; and
WHEREAS the lot contains 30,990 sq ft and is located within the R-15 zone district; and
WHEREAS the 100' Major Road setback was adopted after the platting of the Knollwood
Subdivision, and affects those lots that abut East Highway 82; and
WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by
virtue of Section 2-3 0-30(d) of the Pitkin County Land Use Code: and,
WHEREAS, based on the evidence presented, the Board of Adjustment makes the following
findings:
1. Proper notice procedures, including the notification of all adjoining property owners, have been
show is by the applicant.
2. The required hardship or practical difficulty has been established.
3. Granting such relief will not cause substantial detriment to the public welfare and will not
substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment that a 35 foot Major Road
and Setback Variance and a 5 foot Side Yard Setback Variance be granted to construct a single
family residence as shown on Exhibits A-B, due to topographic hardships.
WARNING: Any violation of the terms of this resolution may result in rehearing and possible
revocation.
The Resolution was adopted by vote of the Board of Adjustment of the County of Pitkin. State of
Colorado.
