Ft. N/A This OWTS Construction Permit is approved on the condition of compliance with the engineer design as submitted with the application and the specifications cited above. Changes must be approved by this Department and the engineer prior to construction. This permit is to amend an existing OWTS and replace the inlet and outlet tees in the existing tank. The outlet tee shall include an effluent filter and any modifications, if needed, to ensure easy access to remove the filter from the surface. If there is evidence of failure of any OWTS component, stop work and immediately call the Environmental Health Department. This Permit must be kept on -site during installation. The engineer must do a final inspection of the installation and submit an "as -built" letter to this Department within 30 days of the final inspection, unless a longer period of time has been agreed upon, in writing. This Department must also be called for the final inspection with a minimum of 48 hours notice. Minimum horizontal distances between components of the system and physical features shall conform to the requirements of the Pitkin County OWTS Regulation. This Permit is conditioned upon the property owner(s) providing for regular inspection, cleaning, and maintenance of the system by qualified personnel, in accordance with the manufacturer's recommendations and the requirements of the Pitkin County OWTS Regulation. The legal description of the 2.24-acre property is Parcel 1, Coates-Eubank Subdivision Exemption. No records were provided by Pitkin County Environmental Health Department (Parcel ID #2463-093-00- 013). The septic tank is located to the north of the residence. The manhole lids on the septic tank are accessible from grade and very heavy. Six feet of risers bring the manhole lids to grade. Given the depth of the septic tank, it was difficult to assess the condition of the tank. We could not see a tee on the inlet side of the septic tank. It was clear that the outlet pipe did not have a tee. We measured the sludge in the septic tank at the time of the inspection and there was approximately 2- inches of scum and 18-inches of sludge on the inlet side of the tank and no scum and 4-inches of sludge on the outlet side of the septic tank. We recommended pumping of the septic tank. We walked the approximate area of the soil treatment area (STA) and this is part of the yard. There is a concrete slab farther to the north, which was formerly a shed (as shown on the Google Earth image from 2015). There was no surface saturation in the approximate STA and no evidence of failure at the time of our inspection. The septic tank was pumped by Altitude Septic on November 25, 2016. They observed some backflow into the septic tank at the time of pumping, likely due to a low spot in the outlet pipe. Altitude Septic personnel recalled the outlet pipe being jetted in the past (over 5 years ago). It is likely that this pipe has a belly or low spot just outside of the septic tank on the way to the STA. Additionally, they were unable to verify an inlet tee or baffle, sometimes tucked under the lid, at the time of pumping. Altitude Septic was unable to put a tee on the outlet pipe because it was not perfectly round, and the depth to the pipe made manipulating the tee onto the pipe difficult. Repairs required prior to receiving an OWTS Use Permit for this system include repairing or verifying the line from the tank to the field is in good condition, clear of debris, and has a minimum 1% grade from the tank to the field, in addition to adding an outlet tee to the pipe exiting the tank. We recommend verifying or adding an inlet tee; however, this repair will not be required due to the amount of digging that would be required. We also recommend adding an effluent filter to protect the field from solids. If this this filter is added, it must include a handle extension and must be cleaned annually, or as needed. This inspection is good for one year. 0012.2016.POW2 Recommendations: • Verify or add an inlet tee. • Clean effluent filter annually, or as needed. This report, verification of repairs completed by a Licensed OWTS Contractor, and a completed OWTS Use Permit Application must be submitted to the Pitkin County Environmental Health Department. The water rights evaluated included surface diversions, reservoirs, wells and the associated augmentation plans. This letter does not depict the history of the water rights as it can be complicated to follow, however a summary table for each lot details all associated water court cases should further research be required. A map of the two parcels and the identified water rights is attached as Figure 1. A few definitions should be clarified in order to better understand the water rights. Flow rates for water rights are typically shown as cubic feet per second (cfs) however, many of the water rights associated with the Waterstone lots are smaller and are referenced in gallons per minute (gpm). Volumes of water are referred to as acre-feet (AF) or gallons. WaterstoneWay20&40(Lot1) Waterstone Way 20 & 40 is 2.24 acres and is the southernmost lot of the two (Figure 1). The Lot currently has two homes with the main residence (40 Waterstone Way) located near the Roaring Fork River and the older home (20 Waterstone Way) located east and up the hill from the main residence. DomesticWaterSupply The only well on the Lot 1 is called the Coates Well and is authorized by the state with Permit #67812-F and currently serves Waterstone Way 20. The well permit allows for indoor use on up to two residences and does not allow for any outdoor uses. The well is allowed a maximum pumping rate of 15 gpm and annual volume not to exceed 0.784 AF. The Coates Well was drilled to a depth of 80 feet and collects water from the bottom 20 feet. In 2009, the well was tested and found to supply approximately 18.75 gpm. The well is augmented by the Basalt Water Conservancy District (BWCD) in Contract #567. Waterstone Way 40 is served by the Eubank Well on Lot 2 along with the residences at Waterstone Way 30 & 50. The Eubank Well is pumped to a 27,354 gallon underground tank which then serves the three residences. The Coates Pump & Pipeline currently collects water from a shallow wetwell located near the bank of the Roaring Fork River as shown on Figure 1. The water right is absolute for up to 0.055 cfs (25 gpm) allowing up to 8 animals and 1.5 acres of irrigation. This water is augmented by the Coates Pump & Pipeline Augmentation Plan allowing for uninterrupted use throughout the irrigation season (April 1 through October 31). The irrigation wetwell providing irrigation water to Lot 1 is also a shared diversion with the Byers Pump & Pipeline which allows for irrigation on Lot 2. The wetwell collects infiltrated water from the Roaring Fork River and is also automatically supplemented by the Byers Pond. The wetwell has a float valve connected to a gravity fed pipeline from the pond which replenishes the wetwell when the water surface drops below required depths for the irrigation system to function properly. Although Byers Pond is located on Lot 2, it is decreed for irrigation of up to 6 acres to be shared between Lots 1 & 2. Lot 1 has shares in the Walthen Ditch for 0.05 cfs (25 gpm) of the second most senior right in the ditch, Priority #88. Walthen Ditch diverts from Woody Creek and runs through the northeast corner of the Waterstone Way Lot 2. Priority #88 is a very senior right as it was adjudicated on May 11, 1889. The decree for this water is difficult to follow but it appears that all Lot 1 shares are decreed for irrigation and filling of the Byers Pond. AugmentationPlans Coates Pump & Pipeline Augmentation Plan was decreed to allow for full irrigation season protection of the Coates Pump & Pipeline from senior calling water rights. The augmentation plan allows the BWCD (Contract #123) to release augmentation water from Ruedi Reservoir for all annual consumptive uses from the Coates Pump & Pipeline. Well Permit #67812-F is augmented by the BWCD Contract #567. BWCD filed an umbrella augmentation plan with the water court to cover many of their existing contracts for wells and water rights. The BWCD contract and augmentation plan covers the annual in-house uses allowed by the well permit from being subject to senior calling water rights. There is no augmentation plan for the Walthen Ditch shares. WaterstoneWay30&50(Lot2) Waterstone Way 30 & 50 is 2.974 acres and is the northernmost lot of the two. Lot 2 currently has two residences with the main residence (50 Waterstone Way) located near the Roaring Fork River and the older home (30 Waterstone Way) located east and up the hill from the main residence. DomesticWaterSupply Both homes on Lot 2, as well as the Waterstone Way 40 residence, are served domestic water from the Eubank Well located on the Lot. The well pumps to an underground 27,354 gallon tank located on Lot 2 south of the Byers Pond. The Eubank Well is currently authorized by the state with Permit #66854-F allowing for indoor use on up to two residences and does not allow for any outdoor uses. The well is allowed a maximum pumping rate of 15 gpm and annual volume not to exceed 0.784 AF. The Eubank Well was drilled to a depth of 85 feet and collects water from the bottom 40 feet. Results from an initial well test in January 1973 indicated the well production rate was 5 gpm, however a more recent test in completed by a pump installer in www.sgm-inc.com 3 December 2007 indicated a higher rate of production at 12.5 gpm. A new permit for this well is currently being pursued to allow use in all three residences. The well is augmented by BWCD (Contract #545) which is also being amended to cover the water depletions from all three residences. OutdoorWaterSupply The Byers Pump & Pipeline diversion is decreed to provide Lot 2 with stock watering and irrigation water from the Roaring Fork River. The water right is decreed absolute for up to 0.055 cfs (25 gpm) allowing up to 8 animals and 1.7 acres of irrigation. This water is augmented by the Byers Pump & PL Augmentation Plan allowing for uninterrupted use during the irrigation season. The Byers Pump & Pipeline Enlargement was decreed to provide water to the Byers Pond from the Byers Pump & Pipeline. The decree is absolute and allows for diversion rates up to 0.11 cfs (50 gpm) for filling of the Byers Pond. Although this right was historically the only filling source for the Byers Pond it currently does not serve as a filling source. Byers Pond is located on Lot 2 and is decreed absolute for a storage volume of 2.0 AF (~650,000 gallons) and has a decreed surface area of 1.63 acres (currently approximately 0.31 acres). The Pond is decreed to be used for irrigation, stockwatering, recreation, wetlands and fish and wildlife propagation. The pond is currently filled by the Walthen Ditch and is also decreed to be filled by the Byers Pump & Pipeline Enlargement. Lot 2 has shares in the Walthen Ditch for 0.05 cfs (25 gpm) of the second most senior right in the ditch, Priority #88. Walthen Ditch diverts from Woody Creek and runs through the northeast corner of the Lot 2. Priority #88 is a very senior right as it was adjudicated on May 11, 1889. The decrees for this right are difficult to follow but it appears that all Lot 2 shares are decreed for irrigation uses and to fill the Byers Pond. AugmentationPlans Byers Pump & Pipeline Augmentation Plan allows for full irrigation season protection of the Byers Pump & Pipeline from senior calling water rights. The Augmentation Plan allows the BWCD (Contract #126A) to release augmentation water from Ruedi Reservoir for all annual consumptive depletions from the Byers Pump & Pipeline. Similarly the Byers Pump & Pipeline Extension Augmentation Plan provides protection of the Byers Pump & Pipeline Extension rights from senior calling rights throughout the year allowing the Byers Pond to remain full as long as the Pond is being used as allowed in the decree. Well Permit #66854-F is augmented by the BWCD Contract #545. BWCD filed an umbrella augmentation plan with the water court (Case No. 02CW77) to cover many of their existing contracts for wells and water rights. The BWCD contract and augmentation plan protects the annual in-house uses from being subject to senior calling water rights. There is no augmentation plan for shares in the Walthen Ditch. Conclusion This documented provides a full summary of the known water rights associated with the two Waterstone Way lots. From preliminary reviews of the rights there appears to be sufficient physical and legal water to supply both lots with drinking water and irrigation water. Both lots are supplied with very senior irrigation water out of Walthen Ditch and have comprehensive www.sgm-inc.com 4 augmentation plans to protect their junior water rights (wells and pumps) during dry climate and low river flow conditions.
