HomeMy WebLinkAboutbocc.ord.021.2025 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, AMENDING ORDINANCE NO. 008-2017 ESTABLISHING FEES FOR THE COMMUNITY DEVELOPMENT DEPARTMENT ORDINANCE NO. 021-2025 RECITALS WHEREAS, Pursuant to 30-35-301 C.R.S., the Board of County Commissioners (“BOCC”) of Pitkin County, Colorado a Home Rule County is authorized to make and publish ordinances for carrying into effect or discharging the powers and duties conferred upon such counties by law and as seems necessary, and; WHEREAS, Pursuant to Section 2.8.1 of the Home Rule Charter (“HRC”), the BOCC is authorized to take official action by Ordinance for certain matters where action is prescribed pursuant to the Colorado Revised Statutes as amended, and; WHEREAS, Pursuant to Ordinance No.012-2016, the Board of County Commissioners adopted the current Community Development Department fee schedule. WHEREAS, Pursuant to Ordinance No.008-2017, the Board of County Commissioners amended the building permit flat fee, increasing from 2% to 2.7% of the project valuation. WHEREAS, The policy of the Pitkin County Board of County Commissioners is that development shall pay the cost of development review in Pitkin County. WHEREAS, the Board of County Commissioners has determined that reducing permit fees would encourage projects to develop smaller, all-electric, and/or less energy-intensive new single-family dwellings. WHEREAS, The BOCC finds that adoption of this ordinance is in the best interest of the citizens of Pitkin County. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Pitkin County, Colorado that it hereby adopts an AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, AMENDING ORDINANCE NO.008-2017 ESTABLISHING FEES FOR THE COMMUNITY DEVELOPMENT DEPARTMENT, and authorizes the Chair or the Chair’s designee to sign the Ordinance and upon the satisfaction of the County Attorney as to form, execute any other associated documents necessary to complete this matter. Building Permit Fees 1) Building Permit Fees ● Single Family Residence Permit Fee (Census Code 101 & MH) ○ Tier 1 - (0–3,250 SF) ■ All-Electric AND Not Installing Exterior Energy Uses 1.6% Valuation Fee ● *Exempt up to 5,000 watts of heat tape and one pre-packaged electric spa ■ Fossil Fuel and/or Installing Exterior Energy Use 2.7% ○ Tier 2 - (3,251-5,750 SF) ■ All-Electric AND Not Installing Exterior Energy Uses 2% Valuation Fee ● *Exempt up to 5,000 watts of heat tape and one pre-packaged electric spa ■ Fossil Fuel and/or Installing Exterior Energy Use 2.7% ○ Tier 3 - (5,751-9,250+ SF) ■ All-Electric AND Not Installing Exterior Energy Uses 2.3% Valuation Fee ● *Exempt up to 5,000 watts of heat tape and one pre-packaged electric spa ■ Fossil Fuel and/or Installing Exterior Energy Use 2.7% ● All Other Building Permits ○ 2.7% Flat Fee Note: ● The fee percentage of the actual project valuation is based on the 16 Division Schedule of Values provided by the applicant at submittal as a job cost estimate and as a final actual job cost prior to final inspection. These Schedules of Values are subject to the Building Official's review and potential audit. ● Floor Area as defined by the Land Use Code 2) Change Order Permit fee Change orders shall be calculated at 2.7% of the additional job cost shown on the applicant's Schedule of Values provided for the Change Order scope of work. If the Change Order scope of work has no additional valuation associated, then the Permit fees will be calculated on an hourly basis. 3) Repair Permit fees $200.00 Repair Permit flat fee Note: A repair permit shall be issued only for an emergency repair for stopping a leak or cleaning up after a single catastrophic incident (ie: fire or flood) and the associated investigative process for eventual repairs. The actual additional repair of the structure and replacement of materials or systems shall require an actual building permit and/or appropriate sub-permit (s). Repair permits shall be used for minor repairs (ie: temporary structural shoring and deck board replacement). 4) Fire Sprinkler Fee Fire sprinkler fees are based on the valuation of the fire sprinkler system and calculated according to the currently adopted Fire Code Fee schedule policy for each jurisdiction. For fire jurisdictions without an adopted code fee schedule, the Fire Sprinkler Permit fee is the total of the permit fee (calculated on the valuation of the system using a 2% multiplier) 5) Party Tent Permit Fee $150 Flat Fee. Note: Permit applications must be submitted 3 days prior to the event date or a double fee will be charged. 6) Red Tag Fees For work performed without required permits, building permit fees are doubled as a penalty Note: (see also Contractor Red Tag Fee) 7) Address Fees Per the currently adopted address fee ordinance B. Other Building Inspections and Fees Inspections outside of normal business hours (minimum charge - two hours @ $150.00 per hour) $300.00 Reinspection Fee $150.00 Inspection for which no fee is specifically indicated, per hour (minimum charge one hour) $150.00 Additional plan review required by changes, additions, or revisions to plans or plans for which an initial review has been completed (minimum charge one-half hour) $150.00
