Home My WebLink Aboutbocc.res.079.2025 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS (“BOCC”) OF PITKIN COUNTY, COLORADO AUTHORIZING THE CHAIR TO SIGN A PASSENGER FACILITY CHARGE (PFC) APPLICATION #26-13-C-00-ASE WITH THE FEDERAL AVIATION ADMINISTRATION TO IMPOSE AND USE FUNDS AT THE ASPEN/PITKIN COUNTY AIRPORT RESOLUTION NO. 079-2025 RECITALS WHEREAS, pursuant to Section 2.8.3 (Actions) of the Pitkin County Home Rule Charter (“HRC”) official action by formal resolution shall be required for all actions of the Board not requiring ordinance power on matters of significant importance affecting citizens, and; WHEREAS, Pitkin County (County) is the owner, sponsor and operator of the Aspen/Pitkin County Airport (Sardy Field), (Airport) located in the vicinity of Aspen, Colorado, and; WHEREAS, Pitkin County operates, maintains, and develops the Airport, in part, with federal grants, state funds, Passenger Facility Charges (“PFC”), and user fees, and; WHEREAS, pursuant to Title 14 of the Code of Federal Regulations (CFR) Part 158, Pitkin County must proceed through a formal process to gain Federal Aviation Administration (FAA) approval to institute a PFC at Aspen/Pitkin County Airport, of a four dollar and fifty cents charge ($4.50) on passengers enplaned at the Airport, and; WHEREAS, the PFC application process requires a letter of Intent to initiate a PFC, an airline consultation meeting and a formal application (FAA Form 5500-1) affixed (as Exhibit A) with the Authorized County Representative’s signature submitted and approved by the FAA prior to receiving collection and use authority, and; WHEREAS, upon FAA approval of the application, it will result in the County being able to see FAA approval in the amount of $1,646,721 in a new PFC impose and use authority to 1) Acquire an Aircraft Rescue and Firefighting Vehicle and 2) PFC Application Services, and; WHEREAS, for the purposes of keeping the current collection authority granted under previous projects to continue until such time that the airport has another eligible project, staff is proposing an ARFF unit which will allow collection authority to continue (based on annual enplanement data) until the legal charge estimated date of November 1, 2026, or until collection authority has been reached, and; WHEREAS, the BOCC finds that it is in the best interests of the citizens of and the visitors to Pitkin County to approve this Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado that it hereby adopts a (Resolution Authorizing the Chair to Sign a Passenger Facility Charge Application #26-13-C-00-ASE with the Federal Aviation Administration to Impose and Use Funds at the Aspen/Pitkin County Airport and authorizes the Chair to sign the Resolution and upon the satisfaction of the County Attorney as to form, execute any other associated documents necessary to complete this matter.
