COUNTY, COLORADO RESTRICTING TANDEM AXLE TRUCKS AND TRACTOR
TRAILERS FROM THROUGH TRAFFIC ON OWL CREEK ROAD, EAST SOPRIS
CREEK ROAD. WATSON DIVIDE ROAD, MCLAIN FLATS ROAD AND BRUSH
CREEK SUBDMSION ROAD
ORDINANCE NO. tg.a ~' -2003
1. The Board of County Commissioners desires to restrict tandem axle trucks and tractor-trailers
from'through traffic on certain county roads to slow deterioration of the Pitldn County Road
system.
The County has the authority to restrict the use of its roads as provided in C.K.S. § 42-4-
106(3), which provides:
Local authorities, with respect to highways under their jurisdiction,
may also, by ordinance or resolution, prohibit the operation of trucks
or commercial vehicles on designated highways or may impose
limitation as to the weight thereof, which prohibitions and limitations
shall be designated by appropriate signs placed on such highways.
The 2003 Pitkin County Asset Management Plan also has a provision for the B0~d o~
County Commissioners to restrict vehicle use on any county road. It states the following:

appropriate public notices when such as closure or restriction occur.
Closures or restrictions of a more permanent nature, such as permanent
restrictions to motorized vehicles use, shall occur by oid~nance, with
proper notice to all property owners who access ttiek property b½ ~e
road proposed to be closed. When a request for closuro'is made in
connection with a land use application, it shall be referred to the Put31i~
Works/Engineering Deparmaent for procession in accordance with this
section.
4. Pursuant to C.R.S. section 42-4-106(8), any person who violates any provision of section
424-106-commits a class B traffic infraction.
NOW, THEREFORE, BE IT ORDAINED by the Board of County CommissioBers of Pitkin

Tandem axle trucks and tractor-trailers are prohibited on 'Owl Cieek
Creek Road, Watson Dtvlde Road. McLain Flat~ Rhhd ~ii,q~zC;;~x-
Roads unless they are accessing properties loCated 6fi-,'~-~ba~i¢)~/i
This ordinance repeals all previous Board approved resolutions and ordinances listed as
Ordinance g09-21 and Resolution # 87-54.
Signs shall be place,'on both ends of each'road restricting'tandem axle trucks,and ttac_tor-
Trailers from using these.roads as through traffic.
Violation of this ordinance is a class B traffic infraction pursuant to C.R.S. §42-4-106(8).
