The Provision of Task Order C-5: Housing/Employment Impact Analysis entered into pursuant
to the Implementation of Community Growth Committee Recommendations Master Service
Agreement (the “Contract”) dated July 8, 2024 between the Board of County Commissioners of
Pitkin County, Colorado (the “County”) and Design Workshop (the “Contractor”), is hereby
amended as follows:

After completing an update to the employee generation rates for the (1) construction and
(2) operations and Maintenance of residential units in Pitkin County, the staff and BOCC
raised questions regarding the application of these new standards, and the resulting fee
to be paid by prospective developers/homeowners. There are options available to the
County to lower the fee, such as reducing the mitigation rate; however, there are other
factors within Chapter 8 of the Pitkin County Land Use Code - Development Exactions
and Impact Fees - that also affect the magnitude of the fee and warrant evaluation. The
following tasks have been identified to enable County staff and the BOCC to evaluate
options and identify which factors warrant modifications.
EPS will construct a financial model that accounts for each factor within the current land
use regulations, specifically section 8-30-20. Building from work provided by the County
Attorney’s office, EPS will construct the model to derive the current fee, incorporating
the ability to conduct sensitivity analyses on the factors used to determine the fee.
EPS will evaluate factors used to determine household revenue, specifically the target
income, and the assumptions pertaining to taxes, insurance, assessments, mortgage
insurance, and interest rates.
EPS will document the current method of collecting Pitkin County Assessor data to
calculate the rolling median value of home sales, excluding unheated floor area, sales of
restricted properties, sales of fractional ownership, sales of mobile homes, sales of mixed

use structures, sale of properties with more than one residence, as well as sales of
structures located on parcels of more than five acres. An additional factor that required
employee housing to be a minimum of 1,100 square feet will also be evaluated.
EPS and RRC anticipate maintaining most of these factors and will consider additional
factors within the set of parameters that could be incorporated to reflect the nature of
the options that are most relevant to employees. These factors could include location,
age, size, type, and other objective metrics that can be incorporated into the analysis and
replicated annually moving forward.
EPS will document the fee requirements of other peer communities, with a focus on
mountain resort counties located throughout the Rocky Mountain West. Communities
within the Roaring Fork Valley will also be documented. Using the financial model
constructed in Task 1, EPS will develop scenarios that show ways in which the County
can modify its set of parameters within the context of the peer community norms.
The team will also include construction cost estimates for building new housing within
the Roaring Fork Valley to compare the figures derived (based on County Assessor sales
comps) to the costs incurred to build new. The consultant team recognizes that Pitkin
County has some of the most expensive market rate real estate in the country, and thus
most challenging affordable housing gaps to close. The goal is to balance the need to
generate sufficient funds to cover the financial gaps found in employee housing
construction with the need to fall within the realm of peer standards and actual
construction costs.
EPS and RRC will develop approximately five scenarios, highlighting the factors that are
particularly strong drivers for each of the respective fee calculations. The team will
identify methods that can be used to bring the resulting fee closer to the set of peer
communities and actual construction cost and will look to the staff in this workshop to
help illuminate the option analysis should focus on. The purpose is to move forward to
the BOCC a limited set of options and clear rationale, such that the Board can set a policy
based on objective data.
EPS will draft a Technical Memorandum that summarizes the analysis and
recommendation. EPS and RRC will present the findings to the BOCC at one hearing and
incorporate direction from the Board to finalize the memorandum and the model. The
deliverables will include a slide deck to document the analysis, a report that provides
greater detail of the analysis, and the financial model (in Excel format), such that the
County has the information in-house and can update the mitigation fees annually in the
future, if desired.

The team is prepared to begin work immediately with a majority of the analysis
completed in December. The goal is to schedule the staff workshop in early January, with
a BOCC meeting following the workshop, based on the availability and capacity of the
BOCC agendas. The budget reflects the combined resources of RRC and EPS, with EPS
taking the lead for this analysis.
