Planning application fees are being increased generally slightly less than 3%, and some referral agency fees are increased by slightly less than 4% this year, with the fees to be reviewed annually rather than making large increases every several years. 2. Building permit fees are increased by 4%, with fees to b~ reviewed annually rather than making large increases every several years. 3. Fee schedules for contractor licensing and testing are removed from Chapter 11.36 of the Building Code and are placed in this ordinance to make them more easily available for annual review. The Board approved this ordinance on first reading on March 10, 2004, and on second reading March 24, 2004. A third reading/public hearing has to be held because, though the public notice was correct, the printed ordinance in the Board's packet did not properly reflect the increased referral agency fees. RECOMMENDED BOCC ACTION: Approve at public hearing. AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, ESTABLISHING FEES FOR THE COMMUNITY DEVELOPMENT DEPARTMENT AND REPEALING AND REPLACING ORDINANCE 007-2003 Ordinance No. -2004 RECITALS Pitkin County proposes to set fees for the Community Development Department that are consistent and fair to the public and reflect the expense incurred in providing such services to the public. Certain fees currently charged for development review no longer reflect the cost of providing the necessary levels of such services. The policy of the Pitkin County Board of County Commissioners is that development shall pay, in full, the cost. of development review in Pitkin County. Long .Range planning shall be funded through the general fund. Payments due to the County for obligations due to sales and tax are not regarded as fees and therefore not included in the Ordinance. The Ordinance does not reflect an encompassing fee schedule. Planning fees are proposed to be increased slightly less than 3% this year, with the fees to be reviewed annually rather than making large increases every several years. The Intergovernmental Agreement between the County and the City of Aspen Community Development Departments requires that building fees be consistent with the City of Aspen in order to make the building permitting process seamless for the public. 6. The BOCC considered the proposed fees at a regular meeting on March 10, 2004, and on March 24, 2004, at a second reading and public hearing, and voted to approve the proposed fees at a public hearing on third reading on April 14, 2004. NOW, TItEREFORE, BE IT ORDAINED by the BOCC that it does hereby adopt fees for the Community Development Department as follows: 1. Planning, Zoning Review and Referral fees shall be based on the attached fee schedule (Exhibit A). 2. Building permit fees shall be based on the attached fee schedule (Exhibit B). 3. Mechanical permit fees shall be based on the attached fee schedule (Exhibit C). 4. Plumbing permit fees shall be based on the attached fee schedule (Exhibit D). 5. International Fuel Gas Code explained in Exhibit E. 6. National Electric Code Permit Fees permit fees explained in Exhibit F. 7. In the event that the fees that result from accumulation are found by file Community Development Director to be excessive in relation to the number of hours it is anticipated to require to process the application, the Community Development Department may waive or adjust the accumulation requirement. 2. Additional charges shall be billed on an hourly basis beyond the base fee only if the time exceeds the average by more than 20% in the processing of an application. 3. Public Notices for Code Amendments will be billed for actual costs. 4. Additional charges shall be computed at the rate of two hundred and fifteen dollars ($215.00) per hour of additional Community Development Department staff time required The Community Development Department shall identify, prior to or at the time of submission of a land use application, whether an application is to be referred to the County Engineer, Wildlife Biologist, Housing Office, Environmental Health Department, Airport or RFTA. Additional charges will apply as shown below. 6. An applicant may request that the BOCC waive fees for projects serving a public purpose, proposed by a non-profit organization, or in order to dispute the fee charged. B. Plan check fees are based on the building permit fee and equal to 65% of the total building permit fee. Energy Code Fees 1. Energy code review fees are based on the building permit fee and equal to 10% of the total building permit fee, with a minimum charge of $25.00. Fire Sprinkler Fees 1. Fire sprinkler fees are based on the valuation of the fire sprinkler system and calculated according to the Building Permit Fee Schedule. The total Fire Sprinkler Permit fee is the total of the permit and the plan check fees. Excavation/Foundation Fees 1. The excavation/foundation permit fee is 35% of the building permit fee.
