HomeMy WebLinkAboutbocc.res.115.2025 EMERGENCY RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS (“BOCC”) OF PITKIN COUNTY, COLORADO, AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH THE TOAN OF BASALT, CONCERNING THE PROVISION OF LAW ENFORCEMENT SERVICES BY THE PITKIN COUNTY SHERIFF’S OFFICE WITHIN THE TOWN OF BASALT RESOLUTION NO. 115-2025 RECITALS WHEREAS, pursuant to Section 2.8.3 (Actions) of the Pitkin County Home Rule Charter (“HRC”) official action by formal resolution shall be required for all actions of the Board of County Commissioners (“BOCC”) not requiring ordinance power on matters of significant importance affecting citizens, and; WHEREAS, pursuant to Section 2.8.5 of the HRC the Board is authorized to approve Emergency Resolutions, which shall become effective immediately upon adoption, and; WHEREAS, Sheriff Buglione prioritizes School Resource Officer (“SRO”) presence in all Pitkin County schools, and recognizes the reassignment of the Basalt Police Department (“BPD”) SRO during the 2025–2026 school year creates an immediate gap in school safety and youth engagement; and; WHEREAS, to facilitate the return of the BPD SRO to school campuses and to ensure continuity of public safety services within the Town of Basalt, the Pitkin County Sheriff’s Office (“PCSO”) will provide patrol coverage within the Town of Basalt during mutual agreed upon hours; and; WHEREAS, the County and the Town of Basalt, consistent with the authority granted under Article XIV, Section 18 of the Colorado Constitution and C.R.S. § 29-1-201 et seq. and 30-11-410(2), have collaboratively developed an Intergovernmental Agreement (“IGA”) authorizing PCSO deputies to provide law enforcement services within the Town; and; WHEREAS, the IGA establishes staffing coordination, supervision, reporting processes, cost reimbursement at a fully-burdened rate of $125/hour, and operational guidelines for patrol services provided from the date of execution through June 30, 2026, coinciding with the 2025–2026 academic school year; and; WHEREAS, the Basalt Police Department and Town of Basalt leadership have demonstrated commendable cooperation in seeking solutions to maintain law enforcement capacity while preserving school safety; and; WHEREAS, the BOCC finds that authorizing the IGA is necessary for the immediate preservation of public health, safety, and welfare by ensuring uninterrupted law enforcement coverage in the Town of Basalt and restoring an SRO presence within Basalt schools; and; 2 Resolution No. 115-2026 WHEREAS, the BOCC approved this Emergency Resolution at their regular meeting on December 17, 2025, and; WHEREAS, the BOCC after a duly noticed public hearing, confirmed approval of this Emergency Resolution at their regular meeting on January 14, 2026, and; WHEREAS, the BOCC finds that approval of this resolution is necessary for the immediate preservation of the public health, safety and welfare of the citizens of Pitkin County and therefore declares this Resolution to be effective immediately pursuant to the HRC Section 2.8.5. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado that it hereby adopts an Emergency Resolution of the Board of County Commissioners of Pitkin County, Colorado, approving an Intergovernmental Agreement Concerning the Provision of Law Enforcement Services By The Pitkin County Sheriff’s Office Within The Town of Basalt and authorizes the Chair to sign the Resolution and upon the satisfaction of the County Attorney as to form, execute any other associated documents necessary to complete this matter.
