HomeMy WebLinkAboutbocc.res.027.1974 PITKIN COUNTY BOARD OF COMMISSIONERS RESOLUTION #74-27 EXEMPTION FROM THE DEFINITION OF A SUBDIVISION WOROBEC/WILSON WHEREAS on May 6, 1974, Joe Wilson made application for exemption from the definition of a subdivision as contained under the Pitkin County Sub-division Regulations to allow undivided joint ownership of an existing duplex, located on lot 43 of the Mountain Valley Subdivision, an accepted and recorded subdivision in Pitkin County, said final plat being page 2 of Subdivision Book 4 of the Pitkin County Clerk and Recorder's Office, and WHEREAS Joe Wilson and Dr. Worobec both agree to the following conditions: 1. Both owners will join any future road improvement district, and 2. Both owners agree that there will be no on-street parking, and 3. Both owners agree that short-term rentals shall be allowed only during the Christmas, Easter and Washington's Birthday holidays, and WHEREAS this Board may, by resolution passed under Section 1.4B of the Pitkin County Subdivision Regulations, make exemptions from the definition of the terms "subdivision" and "subdivided land," as defined within said Regulations, upon a finding that the proposed division is not within the purposes of the Regulations and would not adversely affect the uniform and objective application of sound land use regulations and land use planning in Pitkin County, Colorado, and WHEREAS, based upon the facts presented by the applicant, this Board has determined that the proposed division is the proper subject for an exemption, there being no useful purposes to be served. NOW THEREFORE BE IT FURTHER RESOLVED that an exemption be and it hereby is granted to the applicant to permit undivided joint ownership of the existing duplex, without full application of the Pitkin County Subdivision Regulations, conditioned upon there being no change in use of or development of the exempted parcel without compliance with or waiver of application of any applicable Pitkin County land use regulations, and BE IT FURTHER RESOLVED that the exemption herein granted shall be upon the condition and agreement that the covenants and commitments made by the appli- cants as recited in the preambles hereto shall be met and kept by them, their Pitkin County Resolution #74-27 Page 2 heirs, successors and assigns, and the same shall be covenants running with the land enforceable by the appropriate offices and agents of Pitkin County, Colorado, and/or any resident thereof.
