JULY ! , 1974 WHEREAS, Burt Simons has filed an application to rezone approximately 15 acres in the Woody Creek area from A.F.-2 to A.R.-2 in order to allow construction of an apartment complex of 122 units, and WHEREAS, on October 31, 1973, the Pitkin County Planning Commission by resolution recommended that the Board of County Commissioners deny such request for zoning change for the reasons therein set forth, and WHEREAS, on January 21, 1974, the Board of County Commis- sioners held a public hearing to consider such rezoning requests, NOW therefore be it resolved that the Board of County Commissioners hereby denies such request for zoning change, such denial being based upon the following findings and conclusions: 1. That the proposed rezoning does not conform to the recommendations of the adopted Master Plan (Aspen Area General Plan 1966, as amended). The presently existing zoning does not conform to such recommendations. 2. That the proposed development envisioned by the rezoning request would have an adverse impact on the existing land uses in the area which are primarily agricultural and very low density rural residential and would constitute a change in the character of the community and be sub- stantially incompatible with existing uses. 3. That the proposed rezoning and the attendant proposed high density development do not consti- tute a logical and contiguous extension of development within the county but in fact con- stitute "leap frog" development. 4. That the existing access roads are inadequate to handle the additional traffic loads which would be generated by the proposed development and would cause substantial congestion and burdens upon the Woody Creek Road, Highway 82 and various connecting roads in the area. That there are no immediate plans for the expansion of the road and access system in the area. 5. That it is desirable that high density develop- ment be served by municipal water and sewer systems to avoid problems with water supply or water pollu- tion or health hazards. That the area under appli- cation for rezoning is not within the service areas of any municipal or special district water supply system or within any municipal or special district sewage treatment service areas. -2' 6. That the proposed rezoning area is not located near any service, supply, recreational or employment centers which would make necessary substantial commuting on the existing overloaded road systems for the persons residing therein to obtain goods, food or employment. 7. That the proposed rezoning is not in close prox- imity to any of the existing schools and that additional bus routes or other transportation means would be necessary to move children residing in the proposed development to the Aspen area school systems. 8. That since 70 percent of the personal income of the residents of the County of Pitkin is derived from recreation and the tourism industry, it is necessary to maintain an aesthetically pleasing and unspoiled natural environment to preserve the quality resort experience without congestion or degradation of the quality of the air or water in the area or the disturbance of the visually pleasing natural setting of the area. That the proposed development is highly visible from the main entrance to the Aspen resort area, principally Highway 82, and that such development would be -3- a degradation of the quality of the resort in the natural setting of the area as well as con- tribute to air pollution and congestion. 9. That the population of Pitkin County has increased during the last five years at an estimated rate of 15 to 20 percent a year, which growth rate has created a serious lag in the ability of the governmental bodies to provide the necessary services and facilities to meet the community needs and that the community has reached the critical size such that if the growth rate con- tinues, the viability of local government to meet these needs will be seriously threatened. That such growth rates have caused a substantial impact by rapidly increasing the numbers of people who require public services such as roads and maintenance, water and sewage treatment, police and fire protection, airport, hospital, sanitary land fill, parks, and public transportation. That certain serious deficiencies exist in these services and facilities and that the rezoning proposed would significantly aggravate this deficiency and place additional untimely burdens upon the governmental bodies. 10. That the proposed rezoning area is located at a substantial distance from the center of the exis~ng -4- high density deVelopment areas and could not be adequately served by the eXisting police and fire protection response times.
