RESOLUTION
CONCERNING CASTLE CREEK UNDERPASS
WHEREAS Pitkin County is cooperating with the City of
Aspen, private property owners who grant trail easements over
their land, the federal government, the State of Colorado and
with the U.S. Forest Service in the creation, maintenance and
policing of a Pitkin County Trail System, and
WHEREAS said county trail system is defined as those
trails existing or to be created on the land area lying between
the Aspen City limits and the U.S.F.S. boundary, and if within
the City limits, or on City property, by specific agreement with
the City, and if on private property, by specific agreement with
the private property owners, and ~
WHEREAS said county trail system serves the public
purposes of recreation, tourism, emergency access, commuting,
enjoyment of nature and the reduction of reliance on the automo-
bile, and
WHEREAS certain portions of said county trail system
merge with and lie adjacent to State Highway 82, and
WHEREAS Pitkin County is, as aforesaid, desirous of
cooperating with the State of Colorado, as the said State of
Colorado and its interests and property are affected by said
county trail system;
NOW THEREFORE BE IT RESOLVED:
1. That the County of Pitkin shall maintain the said
county trail system at all locations where said county trail
system does in fact merge with and/or lie adjacent to State
Highway 82, and
2. That the County of Pitkin, by its Board of County
Commissioners does hereby agree to indemnify and hold harmless
the State of Colorado from any and all liability which may arise
as a result of the use by any person of the Castle Creek Under-
pass, which is to be a part of the said county trail system, and
which is to be an underpass under State Highway 82.
