PAEPCKE, PETER NITZE and STEPHEN Mck. DuBRUL, JR., as Trustees of the Walter P. Paepcke Life In- surance Trust, of the real property described on Exhibit A hereto (Tract "C") and by ELIZABETH H. PAEPCKE, PETER NITZE, and STEPHEN Mck. DuBRUL, JR., as Trustees of the Walter P. Paepcke Life Insurance Trust as to an undivided one-half interest and the Estate of J. V. Spachner, deceased, as to the remaining undivided one-half interest of the real property described on Exhibit B hereto (Tracts B-4 and B-5): WHEREAS, it appears to the Board of County Commissioners that the proposed conveyances are not within the purposes of the Pitkin County Subdivision Regulations and that the exemptions should be granted; NOW, THEREFORE, BE IT RESOLVED that the petition for an exemption from the definition of the terms "subdivision" and "subdivided land" with respect to the above-described conveyances be and hereby is granted pursuant to paragraph B of Section 1.4 of the Pitkin County Subdivision Regulations; PROVIDED, HOWEVER, that the application for exemption is granted subject to the conditions set forth in the June 21, 1974 letter of appli- cation for Tracts B-4 and B-5 from Charles T. Brandt, attorney for applicant, and in Charles T. Brandt's October 31, 1974 letter of application for Tract C, namely that the grantee shall leave said tracts in their present state until a development plan is under consideration for all on a portion of the property, at which time subdivision and rezoning applications will be sub- mitted to Pitkin County for consideration.
