HomeMy WebLinkAboutbocc.con.058.1974Supplemental Contract No. 1 ~ract No )6-700-4799 Iq 7¥ - $8 UNITED STATES DEPARTMENT OF THE INTERIOR BUREAU OF RECLAMATION WESTERN SLOPE UNIT FRYINGPAN-ARKANSAS PROJECT, COLORADO SUPPLEMENTAL CONTRACT NO. 1 BETWEEN THEUNITED STATES AND PITKIN COUNTY, COLORADO, FOR RELOCATION AND IMPROVEMENTS OF COUNTYROAD IN CONNECTION WITH CONSTRUCTION OF RUEDI DAM AND RESERV01R AND ACCESS TO THE WESTERN SLOPE COLLECTION SYSTEM THIS SUPPLEMENTAL CONTRACT, Made and entered into this 25th day of A_~ , 19 74, pursuant to the Act of Congress of June 17, 1902 (82 Stat. 388)~-~nd acts amendatory thereof or supplemen- tary thereto, referred to as the Reclama{ion Laws, and particularly the Act of August 4, 1939, Section 14 thereof (53 Stat. 1187), and Section 207 of the Flood Control Act of 1960, as amended by Section 208 of the Act of October 28, 1962, (Public Law 87-874); 76 Stat. 1196 , 33 U.SoC. 701r-l, 1958 ed. Supp. IV, between THE UNITED STATES OF AMERICA, herein- after referred to as the United States, acting for this purpose by the officer executing this contract, and the COUNTY OF PITKIN, a body politic and corporate in the State of Colorado, acting by and through its duly authorized representatives, hereinafter referred to as the County, WITNESSETH: WHEREAS, the parties hereto did, on May 6, 1965, enter into Contract No. 14-06-700-4799 entitled, "Contract between the United States and Pitkin County, Colorado, for Relocation and Improvements of County Road in Connection with Construction of Ruedi Dam and Reservoir and Access to the Western Slope Collection System," which said contract is now in full force and effect; and WHEREAS, delays in completion of the Western Slope features of the Fryingpan-Arkansas Project have prolonged the use of the County Road No. 104 by the United States far beyond the period originally anticipated in Contract No. 14-06-700-4799, which has resulted in greater deterioration and the necessity for increased maintenance of County Road No. 104; and WHEREAS, the United States hereby desires to amend said contract to surface the 10.8-mile reach of County Road No. 104 extend- ing east from the Pitkin County line at Ruedi Reservoir with a 2-inch plant mix bituminous mat; and '! WHEREAS, the County is agreeable to amending this contract as hereinafter provided, NOW, THEREFORE, in consideration of the premises, it is hereby agreed by and between the parties hereof as follows: 1. The following provision for construction of bituminous road mix surfacing on the desiguated reach of County Road No. 104 is included as a part of the said contract dated May 6, 1965, and is identified as Article 21: "21.a. The County agrees that it will surface at the expense of the United States that reach of County Road No. 104 which extends 10.8 miles from the Pitkin County line at Ruedi Reservoir east to Nast. Surfacing shall consist of a 2-inch plant mix bituminous mat. Prior to commencing the surfacing work provided herein, the County shall submit their work proposals to the Construction Engineer, Salida, for apprDval. The proposals shall include an estimate of the equipment, supplies and personnel required and the estimated cost of performing the specific items ofwork. " b. Payment of amounts due the County will be made in monthly installments as the work progresses, based on item- ized certified cost statements from the County showing the costs of the work accomplished. However, it is agreed, that the total amount which the United States will rein~burse the County for surfacing the said reach of County Road 104 shall not exceed $285,000° Itemization shall be subject to veri- fication by audit as provided in Article 9 hereof. Payment of the costs by the United States shall be contingent upon the appropriation of money and the allotment of funds being made by Congress." 2. All other terms and conditions of the said contract dated May 6, 1965, between the parties shall remain in full force and effect. IN WITNESS WHEREOF, the parties hereto have executed this contract as of the day and year first herein written.
