HomeMy WebLinkAboutbocc.res.002.1974 RESOLUTION BOARD OF PITKIN COUNTY COMMISSIONERS PITKIN COUNTY, COLORADO NO. 74- 2 WHEREAS, by resolution dated December 19th, 1973, the Pitkin County Planning and Zoning Commission recommended the denial of the Aspen Racquet Club (Broker House Ltd.) subdivision sketch plan; and WHEREAS, at its meeting on January 14, 1974 the Board of County Commissioners considered the application of Broker House Ltd. for subdivision sketch plan under the County's subdivision laws and regulations and heard the presentation by the applicant and its attorney; and WHEREAS, the Board of County Commissioners are in substantial agreement with the reasons for denial given by the Planning and Zoning Commission in its resolution; Whereupon, upon motion made and seconded, the following resolution was adopted upon the unanimous vote of those present: BE IT RESOLVED that for the reasons expressed in the resolution of the Planning and Zoning Commission dated December 19, 1973, and for the following reasons, the Board of County Commissioners hereby deny sketch plan approval of the Aspen Racquet ClubrBroker House Ltd. application: 1. Section 6.4(C) (3) of the Subvidision Regulations requires a showing of the avail- ability of water, which showing is not met here because of the City policy expressed in City of Aspen Resolution No. 13, the applicant not having obtained the approval of the City Council for proposed water taps. 2. The County is obligated not to approve development plans in the vicinity of Sardy Field without a recommendation or report from DATED: the Federal Administration Agency, that Agency not having considered this applicant's proposal. 3. This applicant's proposal embodied in the sketch plan exceeds the permissible density in the applicable area as set by the 1966 Master Plan. 4. Pursuant to the recommendation of Trafton Bean, a planner retained by the County, the County is presently in the process of considering the down-zoning of the property here involved as well as other property to uses of lesser density. 5. It is contemplated that Highway 82 will be substantially improved. There is presently in process a highway design study for the improve- ment of Highway 82 in the vicinity of the property; and at the present time, it is not known where the improved highway will be located. However, it is of concern that the relocated highway will have a substantial effect upon the subject property and, therefore, development of the nature proposed by the applicant would be premature. 6. The property which is the subject of the application here considered lies within the noise perimeters, flight patterns and crash hazard areas of the Pitkin County Airport as determined by Isbill and Associates, Inc., Pitkin County Airport Planners and, therefore, is unsuitable for high density development of the type proposed by the applicant. BOARD OF COUNTY COMMISSIONERS OF %ITKIN CO_UNTY, COLORADO ~ *". ~tk.i-~ C~unty Clerk ~d Recorder ~ ~P~ IN C6~TY SEAL) Decemb~ PITKIN COUNTY PLANNING AND ZONING COb~tSSION RESOLUTION ASPEN RACQUET CLUB SKETCH PLAN WHEREAS, a sketch plan for Aspen Racquet Club located in Portions of Sections 2 and 3, T 10 S, R 85 W, has been submitted to enable the applicant to subdivide 19 acres, zoned AR-1 into 8 indoor and 5 outdoor tennis courts, 250 hotel or lodge type units, and 19,000 square feet Commercial space, and WHEREAS, the Planning and Zoning Commission has reviewed the subdivision application report dated March 6, 1973 submitted by Broker House Ltd., and WHEREAS, the Aspen Racquet Club sketch plan was considered by the Planning and Zoning Commission on March 21, 1973, November 7, 1973 and December 5, 1973 and after giving due consideration to all material presented finds as follows: 1. The intent and purpose of the Pitkin County Subdivision Regulations has not been met in that: a) The proposed sketch plan does not Contribute to orderly, efficient and integrated development of the county; b) The safety and general welfare of Pitkin County residents and visitors is not thereby promoted; c) It does not insure conformance of land subdivision proposals with the public improvement requirements of the county; d) Does not insure coordination of inter- ,ASPEN Page Two SKETCH PLAN governmental public improvement requirements, specifically trans- portation; 2. The land is deemed premature for sub- division because public facility capacities, particularly the highway, airport, hospital, are presently exceeded and must be expanded in a planned and orderly manner to meet existing requirements; 3. Drainage plans are not available for the area at this time, and~a project of such scale should not proceed until a general drainage plan is prepared for the Butter- milk area; 4. State Highway right-of-way, and transit rights-of-way in the area of the project are not adequately provided for; 5. Although tennis courts are not high traffic generators, the traffic increase result- ing from the project will unduly comjest the highway and create an unsafe condition for the residents and visitors of Pitkin County; 6. No facility is available at this time for the movement of pedestrians across the high- way from subject site to the Buttermilk base ski area, and such pedestrian facility should be designed concurrently with transit and highway facilities; ASPEN Page Three SKETCH PLaN 7. At the present time the site is served by a 1" water line, and it has been determined by the City of Aspen Engineer that adequate service would require an extension of the water utility; that the Pitkin County Planning and Zoning Commission does not recommend approval of said water utility extension at this time which would result in the addition of a substantial number of users; that by City Council Resolution No. 13 (Series of 1973), the City of Aspen has agreed to adhere to such recommendations; 8. The "1982 Composite Noise Rating Contours" map contained in the "Preliminary Report Master Plan Study Aspen Pitkin County Airport Aspen Colorado" September 1973 indicates that the subject site is located within the area covered by the 100 composite noise rating contours; that hotel and lodge uses are not consistant with the recommended land uses in "Noise Zones and Land Use ~ Criteria Sardy Field Aspen Colorado" report adopted by the Planning and Zoning Commission July, 1971; 9. Provision of four (4) employee housing units is inadequate to house employees needed to serve 250 hotel or lodge type units and 19,000 square feet of commercial space; AS PEN CLUB SKETCH PLAN Page Four 10. Although surplus school revenues are generated by the project, housing, trans- portation, and hospital revenues required to meet the needs of service population are not demonstrated; 11. "The Pitkin County Air Quality Impact Report" August, 1973 concluded that motor vehicle hydrocarbon emmissions must be reduced by 88% to insure maintenance of S~te and Federal Air Quality Standards; the Aspen R&cquet Club project would be in con- flict with auto restraints which must be implemented to meet said State and Federal Air Quality Standards; 12. Public utilities may not be available to the site; a moratorium is now in effect for gas connections and Colorado Ute Electric Commission has advised the Plann- ing and Zoning Commission that a loop high tension electric transmission line is required to maintain existing standards of service in the Aspen area, NOW THEREFORE BE IT RESOLVED, that the Pitkin County Planning and Zoning Commission hereby recommend denial of the Aspen Racquet Club Sketch Plan to the Pitkin County Board of County Commissioners. ~a~ounty~Planntng Commission Dated this (~ day of ~t.~-I ~ __, 1973.
