EXEMPTION FROM THE DEFINITION OF A SUBDIVISION - James McKinney
WHEREAS, on November 21, 1974, James McKinney made
application for exemption from the definition of a subdivision
as contained under Pitkin County Subdivision Regulations for
the trans£er of real property, as shown on the attached
survey map, asserting that the proposed transfer of properties
is not within the spirit, intent and purposes of the Pitkin
County Subdivision Regulations, and
WHEREAS, a description of the exemption granted shall
be filed with the Pitkin County Clerk and Recorder, and
WHEREAS, this Board may, by resolution passed under
Section 1.4B of the Pitkin County Subdivision Regulations,
exempt the division of parcels of property therefrom upon a
finding that the proposed division is not within the purposes
of the Regulations and would not adversely af£ect the uni£orm and
objective application of sound land use regulations and land
use planning in Pitkin County, Colorado, and
WHEREAS, both the 9 acre tract and the 30 acre tract
are presently improved with a single-family dwelling on
each site and no further subdivision of either property is
contemplated,
WHEREAS, the 9 acre and the 30 acre parcel are physically
divided by the Crystal River, thus providing a natural bound-
ary for the two sites,
WHEREAS, based upon the facts presented by the applicants,
this Board has determined that the proposed division is the
proper subject for an exemption, there being no useful pur-
poses to be served by processing through Subdivision Regulations,
NOW THEREFORE BE IT FURTHER RESOLVED that an exemption
be hereby granted to the applicant to permit the transfer of
the property described on the attached survey map, without
application of the Pitkin County Subdivision REgulations.
