RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY, COLORADO, GRANTING MAJOR AMENDMENT TO A SPECIAL
REVIEW APPROVAL TO THE KAMINS FAMILY TRUST FOR A
CARETAKER DWELLING UNIT AND MORE THAN FIVE BEDROOMS

RECITALS
1. The Kamins Family Trust("Applicant') has applied to the Board of County
Commissioners of Pitkin County, Colorado (`BOCC"), for approval of a major
amendment to a special review approval which allowed a caretaker dwelling unit and
approval for more than five bedrooms pursuant to the Pitkin County Land Use Code.
2. The subject property is located in the Starwood Subdivision and is described as
Starwood Sixteen, Lot R-93.
3. An original special review approval was granted by Resolution No. 96-284. The
Applicant now requests a modification to that approval to accommodate a new design.
4. The Planning and Zoning Commission reviewed this application on January 4, 2000,
and directed staff to forward a recommendation of approval to the BOCC.
4. The BOCC heard this application at a regularly scheduled public hearing on January
26, 2000, at which time evidence and testimony were presented with respect to this
application.
5. The BOCC determined that the proposed activity meets the applicable criteria
established in the Land Use Code, provided the conditions listed in this resolution are
adhered to.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Pitkin County, Colorado, that it does hereby grant approval of the Kamins major
amendment to a special review approval, subject to the following conditions which shall
run with the land and be binding on all successors in interest:
1. All material representations of the Applicant shall be adhered to and considered
conditions of approval.
2. Any variances required must be obtained prior to issuance of any building permits for
the proposed expansion.
3. All conditions of approval contained in previous approvals for this property shall be
adhered to.

4. All new construction and additions shall comply with all Land Use, Fire, Building,
and Environmental Health Codes at the time of building permit issuance.
5. The Applicant shall pay all exactions required at time of building permit issuance.
6. The statutory vested rights associated with this approval shall expire on January 26,
2003.

WEEKLY ON THE 25th DAY OF DECEMBER, 1999.
APPROVED AND ADOPTED AT A PUBLIC HEARING ON THE 26th DAY OF
JANUARY, 2000.
PUBLISHED AFTER ADOPTION FOR VESTED REAL PROPERTY RIGHTS IN
