RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY,COLORADO,GRANTING A SUBDIVISION EXEMPTION FOR A MAJOR
PLAT AMENDMENT FOR ROBERT AND KAREN CALENTINE
AND THE MOOSE GROUP

RECITALS
1. Robert and Karen Calentine and the Moose Group("Applicant")have applied to the Board
of County Commissioners of Pitkin County,Colorado("BOCC")for a subdivision exemption for a
major plat amendment to exchange an equal amount of land between Lots 10 and 11 in order to
vacate a private access easement. This exchange will accommodate the driveway to Lot 11 on Lot
11,whereas the driveway currently crosses Lot 10. In addition,the exchange will increase the floor
areas for both Lots 10 and 1 I by 337 and 91 square feet,respectively.
2. The lots are zoned R-30 and contain 38,643 and 40,978 square feet,respectively.
3. The lots are located at 649 and 309 Hunter Creek Road,and are described as Lots 10 and 11,
Block 4,Red Mountain Ranch Subdivision.
4. The Planning and Zoning Commission considered the application at a regular meeting on
January 4,2000,and recommended approval by a vote of 5-0.
5. The BOCC heard this application at a duly noticed public hearing on February 23,2000 at
which time evidence and testimony was presented with respect to the application.
6. The BOCC finds that the application generally complies with the applicable sections of the
Code.
NOW,THEREFORE,BE IT RESOLVED by the BOCC that it does hereby grant
approval of the Calentine/Moose Group Major Plat Amendment, subject to the following conditions,
which shall run with the land and be binding on all successors in interest:
I. The Applicant shall submit an amended plat for the two lots to the Community
Development Department for approval and recording,prior to submission of any building
permit applications. The plat shall also be submitted in digital format for integration into the
County's GIS system.

2. Prior to issuance of any building permits,the Applicant shall pay all of the exactions
required by the Code at that time for the proposed development.
3. The Applicant shall request a variance from the Board of Adjustment if the improvements to
the driveway on Lot 11 exceed 30"above or below natural grade within the setback.
4. The Applicant shall adhere to all material representations made in the application or in
public meetings.
NOTICE OF PUBLIC HEARING PUBLISHED in The Aspen Times Weekly on the
22nd day of January,2000.
APPROVED AND ADOPTED on the 23rd day of February,2000.
