'The use and occupancy of the Caretaker Unit shall henceforth be invited to occupancy by no more than two (2) adults and related children, who are employed in Pitkin County and who meet the .definition of "employee" as that term is defined by the qualification guidelines established and indexed by the Authority on an annual basis, or members of the .immediate family of the Owner. "Immediate family" shall mean a person related by blood or marriage that is a first cousin (or closer relative) and his or her children. Owner shall have the right to lease the Caretaker Unit to a "qualified employee" of his own selection. Such individual maybe an employee of the Owner, provided such person(s) fulfills the requirements of a qualified employee. 3. ' Percolation Testing: Percolation tests were conducted on September 29, 200 to evaluate the feasibility of an infililtration septic dispasal system at the site.. One profile pit and three percolation holes were dug at the Locations shown on Fig. 1. T;1e test holes (nominal l2 inch diameter by I2 imch deep) were hand dtig at the bottom of shallow backhoe pits and were soaked with water one day prior to testing. The soils exposed in the percolation holes are similar to those e:tposed in tht Profile Pit shown on Fig. 2 and consist of abort l'h Feet of topsoil overlying relatively dense silty to ciayey~ sand snd gravel with cobbles and small bauLders to the pit depth of S feet. The percoiarion test resales are presented in Table X. The percolation test results .indicate an infiltration rate between about 15 and 36 minutes per inch with an average of about 22 uFinutes per inch. Baseri on the subsurface conditions encountered and tL~e percolation test results. the tested area should be suitable for a conventional infiltration septic disposal system. Limitations: This study has. been conducted in accordance with generally accepted geotecltnical engineering principles and practices in this area at this time.. We make uo warranty either expressed or implied.. The conclusions. and recommendations submitted in this report are based upon the data obtained from the exploratory pits excavated at the locations indicazed oII Fig. 1, the proposed type of construction and flat experience in the area. Our findings include i,aterpolation and extrapolation of the subsurface conditions identified at the exploratory pits and variati©ns in the subsurface conditions may not become evufent until excavation is performed. The Hearing Officer heard this application at a duly noticed public hearing on July 17, 2001 and at a continued public hearing on July 31, 2001, at which time evidence and testimony were presented with respect to this application. 5. The Hearing Officer determined that the building envelopes for the single-family residence and swimming pool avoided significant wildlife habitat, wildfire. hazards and significant slope areas. 6. The Hearing Officer also,determined that the building envelope for the caretaker v - . ,~ dwelling impacted a severe wildfire hazard area, which is prohibited pursuant to Code Section 3-80-070 and was therefore denied pursuant to Hearing Officer Determination No 15-2001.., 7. Prior to submittal for any building permits, the Applicant shall record an amended 24 X 36 inch mylar 1041 Hazard Review Site Plan in accordance with. Section 5-70-040 of the Land Use Code. The site plan shall also be submitted in digital format for integration in to the County Geographic Information System (GIS} prior to submission of a building permit. 4. The Applicant shall design an accessory building envelope that excludes all slopes exceeding 30 percent in grade. S. The Applicant shall comply with the following wildfire mitigation measures: Defensible Space: Note: Actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions. A. Brush, debris, and non-ornamental vegetation shall be removed within a distance a 10 foot perimeter of all structures. B. For a distance of 15 feet around all structures, establish and maintain vegetation at 6 inches or less. This can be accomplished with mowed grass or low growing perennials. Rock mulch, pavers or sidewalk will also meet this objective. Woody vegetation should not be planted within this perimeter. In addition, flammable material (e.g., firewood) should not be stored here. C. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around a structure built on flat ground. D. Spacing between clumps of brush and vegetation within the 30 foot perimeter shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall not exceed 10 feet. All measurements shall be from the edges of the crowns of the fuels. E. For a distance of 30 feet uphill, thin and clump existing vegetation. Lower limbs of all shrubs in this 30-foot radius should be removed up to half the height to remove ladder fuels. F. All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and removal of ladder fuels from around trees and brush. G. Tree crown separation within a 30 foot perimeter shall have a minimum of 10 feet between the edges of the crowns. This does not apply to mature stands of Aspen trees where the above recommendation for removal of ladder fuels have been complied with. H. All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. I. The density of fuels within a i 00 foot perimeter around all structures shall be reduced where natural reduction has not already occurred. J. All deadfall within the 100 foot perimeter shall be removed or chipped. K. All flammable materials shall be stored on a parallel contour a minimum of 15 feet away from any structure. F. Weeds and grasses within the 15 foot perimeter shall be maintained to a height not more than 6 inches. G. Firewoodlwood piles shall be stacked on a parallel contour a minimum of 15 feet away from any structure. H. Swimming pools shall accessible: to Fire, Department.vehicles. I. Fences shall be kept clear of brush and debris. 3. Wood fences shall not connect to any structure. K. Any outbuildings or additional structures shall adhere to the same standards as structures. L. Fuel tanks shall be installed underground with an approved container. M. Propane tanks shall.be installed according to NFPA 48 standards and on a contour away from the structure with standard' defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around. the tank shall be constructed with materials approved for 2 hour fire resistive construction on the exterior side of the walls. N. Each structure shall have a minimum of one pound approved ABC fire extinguisher placed in a visible and accessible location. O. Addresses shall be clearly marked with 2 inch non-combustible letters and shall be clearly visible at the primary point of access from the public or common access road and installed an anon-combustible post. P. New utility lines shall be buried. Structural Desi and Construction A. An alternative construction method for such projections would require use of noncombustible building materials, or heavy timber or log wall construction, if the underside of the projecting portion is covered with materials approved for one-hour fire-resistive construction and if there are no inside angles of less than seventy-five degrees (75°). Areas below such projections shall be void of vegetative or other combustible materials. These areas below projections shall be protected from accumulation of vegetative materials by placement of a vegetative barrier covered with rocks or gravel or by coverage with concrete or stone. There shall be no storage of combustible materials under projections. The walls underneath projections shall be constructed with materials approved for one-hour fire- resistive construction on the exterior side of the wall. Window openings in walls below projections shall be tempered glass. Doors shall be noncombustible or one and three-fourths inch (1 3/42) solid wood. B. Windows and Glass: Glazed openings shall be provided with closable, solid, exterior non- flammable shutters or shall be tempered glass. C. Exterior Walls and Siding: Siding and exterior wall construction shall have a minimum one-hour fire-resistive rating ground level to roof-line. Exterior doors shall be noncombustible or one and three-fourths inch (1 3/4) solid wood. W D. Foundations: Foundations, skirting and crawl space openings shall be fully enclosed and constructed with materials approved for one hour fire-resistive ~ ~ N ~ construction on the exterior side of the walls and shall extend from the tap of ~ a m m grade to the underside of the floor decking or walls. The Applicant shall comply with the following caretaker dwelling unit standards: A. The unit shall not exceed 700 square feet of floor area. B. One off street parking space shall be provided for the unit. C. A deed .restriction shall be placed on the unit. and shalt be recorded prior to °" building permit issuance. D. The kitchen shall contain at least a twa-burner stove with oven, standard sink, and at least a 6-cubic foot refrigerator plus freezer. E. Housing Office staff shall conduct an inspection of the unit for compliance: prior to issuance of a Certitieate_of Occupancy. 9. The Applicant shall install bear-proof trash containers. 10. Fencing outside the building envelope must comply with County standards at the time of building permit issuance. 11. Pursuant to Ordinance No. 022-2000, the Applicant is subject to the Fair Share Requirements and shall pay a road impact fee as calculated at the same time as building permit issuance. 12. Blocking of Aspen Oak Drive shall not be permitted at any time daring construction. 13. Floor area on the parcel shall be limited to 5,750 square feet exempt from growth management. Floor area shall be calculated based on the definition in effect at the time of building permit submittal. 14. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 4-140 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on January 9, 2005.
